The Shared costs are the 8% -so if you got a $125K or more settlement the shared costs would be about $10K. The legal expenses are usually under $2000. and are itemized. Tthe shared costs (8%) and legal fees (24%) equal the 32%. Also, there is a 1% MDL fee. that is it.

So if i understand you right we got on our settelment for my mothers mi wich also caused her death just over $500k wich was split 4 ways ( myself and 3 siblings ) and we had deducted like said just short of $10k for the " shared cost " and that would be a " normal " amount for the settelment sum we recived

To confused Hoosier - you really have to discuss the settlement statement with your law firm - they get 24% to explain this to you. But out of $500,000 33% will come out plus legal expenses paid on your behalf to get medical records and copy them. If it is an estate and they had to go to a probate court there may be more fees. I cannot answer your question without seeing the settlement papers. You have to get a copy an review it carefully yourself!

Forget the split and lets just look at the basics. If your case got 500,000, then out of that you would pay 32% lawyer fees.(This INCLUDES the shared costs) and also a SMALL amount for office fees. This would include mailing costs (Over night FedEx or UPS) medical records and copying costs. You should get an itemized list for these expenses and I would guess they would be somewhare between $500 and $2,000. Mine were a little less that $1500 total and each item was listed and cost shown.

Bottom line, if the estate was awarded $500,000, it should get approx $330,000 and $335,000.(Then that would be split the 4 ways and the probate atty would get his, should be small, cut.)

I hope that was clear. I tend to ramble when Im trying to type off the top of my head.

After all these replys, I hope you realize if your atty is really charging your case $10K ON TOP of the 33%(24%+ 8%+ 1%) you and your siblings need to be raising he-- with your lawyer!!!!

I don't think you're confusing this $10K "shared cost" with the 8% "common benefit." On your case- the 8% is over $40K.

My husband has a MI case and his attorney is Weitz & Luxenberg in New York. We have not been able to get very much information from them (surprise). Does anyone out there have Weitz? They told us that Judge Fallon has decided that settlements can no longer be made in 2 payments. Therefore, we have to wait until they calculate EVERYTHING and make sure it is absolutely correct before they can send his one and only check. Weitz does not seem to be in any hurry to get this money out? It is so frustrating!

What a load of BS! Your attorney got a breakdown of monies owed and withheld..from Browngreer. All they have to do is deduct their charges and send you a check.. Call them back and tell them to get your check to you now...or you will call your Attorney General's office...and report them for "Fiduciary Malpractice ".

Why do we have to go through this?????

Any way i am American and i live here in Germany and work with the Dept of State at the American Consulate General in Frankfurt have been over here just short of 30 years including Military time and as you can see born and raised in Indiana.

I can't believe all that I am reading!! Everyone should be paid by now!! My wife received two checks in October. And we were told we were at the bottome of the list. If you have not been paid, I would contact Judge FAllons office! If that doesn't help, keep calling your atty...the squeaky wheel gets the grease!

Also Weitz is saying that money has not been released to them to pay the claims? Is that more BS?

I am glad we found this blog because the attorney's office isn't giving us much information. After waiting for so long to finally get an award you would think the attorney would try to get it paid and closed? And then to hear that so many have at least gotten some payment, why all of a sudden can they not pay an interim 40% payment and have to pay only once?
