Two security guards who shot a man to death March 1 at the Summit Square apartments were indicted Wednesday on charges of murder and abduction.

Indicted were Justin Wissinger, 24, and Christopher Tarbert, 32. Police said in March that the guards, employees of Ranger Security, said they had no choice but to shoot Dante Price because he tried to run them down with his car.

Montgomery County Prosecutor Mathias H. Heck, Jr. and Dayton Police Chief Richard Biehl said that Price’s shooting was not a hate crime. Price, 25, was black. The two guards are white.

But the two guards exceeded their legal authority in trying to detain Price and by using deadly force to try to make him comply, Heck said.

Back in 2010 Ranger security was justified in shooting a speeding suv that tried ot run them over:

DAYTON OH April 12 2010— A security guard who shot a man at Summit Square apartments on Sunday, April 11, had no choice but to fire at the man, Dayton police said Monday.
Police said the man attempted to run his sport utility vehicle over the security guard — a moment the security guard captured with a video camera he was wearing, according to a police report.

A large outdoor party was taking place at the Hoover Avenue apartment complex at about 8:30 p.m., when two vehicles drove through the area at high speed, according to Dayton police Lt. Brian Johns.
Johns said two Ranger security guards told the vehicles to stop, but the second vehicle, a large white SUV, drove into the grass at the officer. The man fired three shots and the vehicle fled the scene.

About 30 minutes later, a man arrived at Grandview hospital with a gunshot wound to the leg that was not life-threatening, and Johns said police had reason to believe he had been in the SUV.

Officers arrested Robert Brookshire, 18, and Allen Weaver each on a felonious assault charge after the two men showed up at Grandview Medical Center about 20 minutes later, according to a police report. Weaver was shot in the hand and underwent surgery to repair the wound, the report stated. Brookshire was not injured.

Weaver later admitted he was behind the wheel of the SUV when he tried to flee from security guard Gavin Bair, the report stated. He only admitted to driving after officers told him he was captured on a camera Bair was wearing on his uniform that captured video of the incident, the report stated.

Weaver told officers he was scared Bair, 27, of West Carrollton, was going to ticket him and that’s why he fled, the report stated. Officers said, after viewing the video, Bair had no other choice but to fire at the SUV, the report stated.

So, what's your stand? Are those two goons justified in the Dante incident, because of this previous incident?

I say it would be easier to tear down Summit Square, really. It's a very bad crime ridden area, and a blight on the community

The shooting in 2010 was a justifiable shooting according to the statements...but, the shooting of the thug dante price was not do to lack of evidence ..That being said the guards were suppose to use common sense when dealing with idiots like Dante... that is a problem with a lot of these security agencies that lack of training before sending out these people with a badge and gun and told to defend this property...And with alot of individuals that get hired to these agencies should never be allowed to be security guards for the reason the (Barney Fife mentality)..I would blame Dante for creating this mess and the guards for not using other avenues to solve a trespasser.

Like ya know, I only want to do it behind those nice TV/movie set consoles; listening to radio, typing and viewing DVDs on my laptop, and reading books and magazines, safe behind closed doors, away from pimps, drug thugs and whores, and people who are mean, while I scan my screens, working on midnight shifts alone, making my nice security job my second home, around which I'll occasionally walk and roam.

Didn't you used to be a police officer? What happened? Did you get tired or fired?

If Price was attempting to leave the scene then he was exercizing his duty to retreat. Unless he was firing at the guards, or actually driving toward them, they were wrong to open fire on him.

Public Servants aka government tax takers dislike or hate private citizens and contractors doing or taking or replacing or downsizing or replacing "their" jobs; thus taking away or reducing their profits, prestige, power and benefits. EVERY political patronage job adds to their employment, importantance and enjoyment with government employment. They want the glory and the territory. "Federalize to professionalize", they said about the new TSA...that will NEVER go away, no matter how far it goes astray.

For as long as I can remember Security officers working high crime housing projects have been detaining people for years on misdemeanors. The cops use to come out and pick um up for them. I'm not saying they are allowed to, but its been common practice since the 80s. Example if they caught a trespasser on property they would detain him or her until Dayton got there. The only crime I know they can hold you til the cops come is shoplifting or a felony. I agree these guys need more training and understanding of what they can and cannot do. It doesnt help their case when you hear the Dante blowing his horn at them to move out of the way on the 911 tapes.

I think he is talking about Dayton knocking down it's housing projects and sending them to the suburbs. Anyway, that's been going on for sometime now.

Well, he was trepassing, but it's not a felony. Legally, you're probably right, he had a right to get the hell out of dodge. The wild card in this(and we might or might not ever know), was he committing any other felonies during this visit?

It'll come out at trial, if so. I don't think his hands were totally clean either.
