Hey I just got one of those and the officer said it was because it was blocking Empire state. Can you send me that info you have?

I just had a "fabricated after the fact" ticket dismissed. I won't get into the particulars because I am going forward with other actions. All you have to know is that if the name "New York" could be seen and the Number On The License Plate could be read it is a legal plate. Dealers put these on your license plates all of the time so it is nothing new. If an officer gave you a ticket for the bottom of the plate "Empire State" being covered up, go back to the local traffic court and appeal. I hope you still have the frame/holder because it would be very helpful. There was a Supreme Court Case # 430 US 705, 51 L Ed 2d 752, 97 S Ct. 1428 Wooley vs Maryland (note this a Supreme Court Case so it covers all states) that shows that covering the state logo or in the case of a New Hampshire plate covering "Live Free or Die" is a persons choice to agree or disagree. In the Empire state logo...it means nothing to the plate number or New York. The DMV pointed this out. Some of you may have got a ticket like this from a particular Trooper and you did not think it was worth the trouble to fight. Or this may have been an additional ticket on top of other ones, well guess what...I did and the truth was made known. If you need more info, let me know. I will be glad to give you a copy of the judgement. Zeke

I'll bet most of these obstructed license plate tickets were given as an alternative to the real reason the person was actually stopped, like speeding. Most often this is the case. Be glad.

the information is in the postingS below. They do not have a leg to stand on. If you really want to get the police...drive up to their police barracks with a camera, take a picture of the license plate holders of their own cars, make copies and bring them to court. if they have cars in their yard with license plate holders covering up empire state, they are liable for DISCRIMINATION! Ok for them but NOT FOR YOU!!! DO NOT PLEAD GUILTY..ASK FOR A TRIAL....TAKE PICTURES OF THE CARS OUTSIDE THE COURYTHOUSE WITH LICENSE PLATE HOLDERS AND SHOW THE JUDGE. THEN ASLK FOR A HEARING ON DISCRIMINATION!!!LOUSY COPS THAT DON'T HAVE ANYTHING BETTER TO DO

MY E MAIL ADDRESS IS: SHELFRAN22@YAHOO.COM WRITE TO ME AND I WILL HELP.

IF YOU ARE FROM TICONDEROGA...ASK FOR JUDGE O'BRIEN....HE THREW MY TICKET OUT AND THEN I FILED CHARGES AGAINST THE TROOPER.

IF THE NUMBER ON THE PLATE CAN BE SEEN AND THE STATE CAN BE READ...PER DMV...THAT IS ALL YOU NEED. EMPIRE STAE IS THE STATE LOGO...HAS NOTHING TO DO WITH DISTUINGISHING THE LICENSE PLATE.
BRING THE PLATE AND THE HOLDER TO COURT LIKE I DID...ASK THE TROOPER OR COP TO READ THE STATE AND READ THE NUMBERS. IF HE CAN...THE JUDGE WILL THROW IT OUT. WHAT A BUNCH OF YO..YO..COPS

ACTUALLY.....THE TROOPER THAT DID THIS TO ME AND HE GOT IN TROUBLE FOR IT WAS JUST LOOKING FOR SOMETHING. WHEN I SHOWED THE JUDGE THAT I HAD BEEN DRIVING FOR 38 YEARS WITH NOT EVEN ONE TICKET OR ACCIDENT, HE REALIZED THE TROOPER WAS TRYING TO FRAME ME. HE THREW IT OUT..Never...never plead guilty to this type of ticket....Empire State is the state logo...means nothing just like New Hampshires logo...live free or die. that case went to the supreme court and the troopers lost Woolery vs Maryland.

Read the rest of the postings by Zeke....Woolery vs Maryland...supreme court decision covers all states. Search Google for: Woolery vs Maryland...print it out and take it to court. If the state and license number on the plate can be read...that is all that is necessary. Bring the plate and the license plate holder to court...ask the trooper or cop to read the plate number and state. If he can..it should be thrown out.

NOW...WHY WOULD YOU THINK THAT EVERYONE WHO GETS FRAMED LIKE THIS MUST HAVE DONE SOMETHING ELSE.. THE TROOPER IS A LIAR, SNEAK, AND SHOULD BE FIRED. HE THOUGHT THAT I WOULD BE SO SCARED I WOULD JUST PAY THE FINE! NOT ON YOUR LIFE. It takes all kinds.

On October 3rd, 2011 I received a ticket for obstruction of license plate. This was a Handicap plate and the owner's of the vehicle (my parents) were in the vehicle. The HWY officer, pointed out that her radar could not pick up the information. The only part that was not visible was www.pa.us.org . I pleaded guilty as I am not driving up to 4 hours to spend only an hour or so to plead not guilty. That ticket cost me $110 (Fine $25 /$85 Surcharge). What kind of BS is that. I am not permitted to deface my parents vehicle of any obstruction if there was any.

The trooper that gave you that ticket should be thrown in the lake. You see...once they stop you, they need to save face so they have to fabricate something, however, you should never plead guilty. You can even ask for a jury trial...does not have to be e bench trial. If they want to go through the trouble of calling a jury, supporting depositions etc. then let them. Guaranteed...they will throw the ticket out. They also target out of town vehicles....what they did wrong to Zeke was even though he had an out of town license plate, he was a Ticonderoga resident. Just for chuckles, I drove by the Ticonderoga police Department and saw that the local police, on their privately owned cars had license plate frames on them covering up Empire State!Wow...and the best one was, the local judge has one on his license plate too! So...what is wrong with this picture??? Where is Howard when you need him?:)

What a line of Bull....And you said "she" ...was she a blonde by any chance? The trooper said that She could not pick you up with the radar......and the tooth Fairy comes often. I personally would have made the trip....forget the $ 110.00. These guys should no get away with this.Unfortunately he played you and I am sorry that this happened to you. Joe Young

Here is a perfect example of why we need to get rid of the local police department! On top of saving tax payer money, with these local cop idiots out there making stupid arrests the town is going to get sued! The state police will come in and do the job for free, and they are so much more professional! Get rid of the local force!
Ok, your argument to get rid of local law enforcement is not valid. To assume the State Troopers do it for free is invalid. I will tell you why. Your state taxes pay the Troopers already and if you have a Sheriff Department then the county tax pays them. If you got rid of local law enforcement then your county and state taxes are going to go up and it will take longer for them to respond. Then you will be complaining about that. One more thing you should. Consider, all law enforcement officers have a knowledge of the laws but they are not expected to have them memorized. That is why the courts are there for.this way you can make your case. Your taxes already pays for that.

Wrong. These tickets are not given as "roadside reductions." They are given as retribution tickets when they make a mistake in a stop, like seat belts that are buckled, phantom cell phones, etc. Troopers don't like to be told they make mistakes.
They may not always be roadside reductions, but in some cases they are. I was happy to take the ticket for this kind of offense when I had really been pulled over for speeding (which I was in fact doing.)

I just got a ticket in Yonkers just a block away from where I live from local Yonkers police officer. I got stopped since my left break light was out (though I just had that fixed in May) and had the bill with me. On top of that, he gave me another ticket because the word "Empire State" was covered by the dealership license cover, which the car has had for over a decade and came with the car. I will try to fight this.
