If you got a traffic ticket for obstructed license plate..read this

OK...Everyone who has received a ticket for a license plate that the Officer, Trooper, or other Law official said was obstructed, get ready to file your appeal with the local Traffic Court.
I just had a "fabricated after the fact" ticket dismissed. I won't get into the particulars because I am going forward with other actions. All you have to know is that if the name "New York" could be seen and the Number On The License Plate could be read it is a legal plate. Dealers put these on your license plates all of the time so it is nothing new. If an officer gave you a ticket for the bottom of the plate "Empire State" being covered up, go back to the local traffic court and appeal. I hope you still have the frame/holder because it would be very helpful. There was a Supreme Court Case # 430 US 705, 51 L Ed 2d 752, 97 S Ct. 1428 Wooley vs Maryland (note this a Supreme Court Case so it covers all states) that shows that covering the state logo or in the case of a New Hampshire plate covering "Live Free or Die" is a persons choice to agree or disagree. In the Empire state logo...it means nothing to the plate number or New York. The DMV pointed this out. Some of you may have got a ticket like this from a particular Trooper and you did not think it was worth the trouble to fight. Or this may have been an additional ticket on top of other ones, well guess what...I did and the truth was made known. If you need more info, let me know. Here is a perfect example of why we need to get rid of the local police department! On top of saving tax payer money, with these local cop idiots out there making stupid arrests the town is going to get sued! The state police will come in and do the job for free, and they are so much more professional! Get rid of the local force!

Actually it was a State Trooper from Schroon lake and it happened here in Ti. Why the State troopers are even in Ti is beyond me. they should stay home.

Whatever, save tax dollars. They will work in ti for free! That is what we need to get done. Moriah does a good job relying on the state police, and Ticonderoga can do the same.

i got a ticket from a state trooper in a snow storm bc my back plate had snow on it.

a buddy of mine got a ticket for not having his front plate on back in 2000...the ticket was for 20 bucks from a state boy in Ti...now...with that being said your willing to pay a crap load more for the appeal, court fees so you can get the 20 bucks back? I'd say dump the appeal deal wit the cash gone and go about your life. Stop tying up our court systems with usless crap. I know Ti's court systems aren't much better but you get my point.

What everyone doesn't say is that those type of tickets are usually given out as a reduction for so other larger traffic offense so quit your complaining and pay your fine. You must have got away some other thing offense like speeding. Learn from your mistakes instead of filling everyone with bs about your ticket. You wonder why police in general don't like to give reductions now a days.....it's because of people like YOU who plead not gulity to that reduction in hopes that you can get away with nothing to pay. Grow up and learn from your mistakes!

If your inspection run's out and you are on your way to an appt. to get a new one and get pulled over you get an appearance ticket not a fix it ticket now.Does anyone know why?

There is a form for you to file your appeal. You do it yourself and it does not cost you anything and you may get your money back. Let me know and I will get you the form. Why pay for something you shouldn't have had to pay for? The truth is the truth.

You should reread that, I got a inspection ticket in February and was given a fix it ticket. I took my vehicle to a garage had it inspected, mailed the fix it ticket and the reciept from the garage to Ticonderoga Court and it was fine. Said fix it right on the ticket. Not sure where your getting your info, and yes ZEKE it was a Schroon Lake State Trooper lol

I get my info from the NYS Vtl. here it is
"section 376a(4) Any complaint issued for any violation of section three hundred seventy five, three hundred seventy six, three hundred eighty one on this article relative to required equipment, except a violation describedin sub 2 of this section sub forty seven of section three hundred seventy five of this article and except for a violation relating to service brakes, shall be dismissed by the court before which the summons is returnable if the violation set forth in the summons is corrected not later than one half hour after sunset on the first full business day after the issuance of the summons and proof of such correction as set forth in sub division five of this section is submitted to the court."

Notice it does not mention section 306 b uninspected Motor vehicle.
