False Claim: Undocumented immigrants have no legal rights.

Truth: Undocumented immigrants DO have legal rights under the U.S. Constitution, as well as many federal statutes. As far back as 1896, the U.S. Supreme Court ruled that:

Wong Wing v. U.S., 163 U.S. 228 (1896) The 14th Amendment to the Constitution is not confined to the protection of citizens.

Detention or temporary confinement, as part of the means necessary to give effect to the exclusion or expulsion of Chinese aliens is valid.

The United States can forbid aliens from coming within their borders, and expel them from their territory, and can devolve the power and duty of identifying and arresting such persons upon executive or subordinate officials, but when Congress sees fit to further promote such a policy by subjecting the persons of such aliens to infamous punishment at hard labor, or by confiscating their property, such legislation, to be valid, must provide for a judicial trial to establish the guilt of the accused.

"The fourteenth amendment to the constitution is not confined to the protection of citizens. It says:'Nor shall any state deprive any person of life, liberty or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the law.' These provisions are universal in their application to all persons within the territorial jurisdiction, without regard to any differences of race, of color, or nationality; and the equal protection of the laws is a pledge of the protection of equal laws."

All persons in the U.S., therefore, have constitutional rights. Among these are the right to equal protection of the law and the right to due process.

Also, undocumented persons have a constitutional right under the Fourth Amendment to deny any officer from entering their residence without consent, absent a search warrant.

Further, ALL CHILDREN, regardless of their immigration status, are entitled to free public education, as required under the Equal Protection Clause of the Fourteenth Amendment. Plyer v. Doe 457 U.S. 202 (1982)

Additionally, under federal law publicly funded hospitals must provide emergency medical services to all patients, regardless of their immigration status. Emergency Medical Treatment and Active Labor Act of 1986 (EMTALA)

Moreover, under federal law, a person may recover money damages for loss of property, personal injury or death where damages occurred as a result of the "negligent or wrongful act or omission of any employee of the Government while acting within the scope of his office or employment, under circumstances where the United States, if a private person, would be liable to the claimant in accordance with the law of the place where the act or omission occurred."

These are just a few of the rights that our constitution and federal laws grant to all persons living in the U.S. These rights are intended to protect all U.S. residents from discrimination and arbitrary government action.

These rights are especially critical in times where hatred based on race, color, and national origin is on the rise.

When you state that illegal imigrants only pay .01% taxes, I must assume that either;

1. Your Ignorant

Increased enforcement may be playing some role in the profound changes both along the border and around America. But the real story here can be found the same way as with many other stories: follow the money.

It turns out that when illegal immigrants can't earn money here, they move away no matter what public benefits they might receive if they stay. So invasion and nationalistic desire for territory apparently never had much to do with illegal immigration. Rather, it's always been about jobs and the money those jobs allow immigrants to send their children and families who stay behind.

Lets not get the terms "rights" and "liberties" confused. A right is an idealistic term describing something that all people are endowed with by their creator, hence the term "God given right." It implies that all people have certain rights afforded to them because they were created by God (or simply members of the human race, if you aren't religious the ideology still applies). It is one of the founding principles of our country.

What we are talking about here are liberties afforded under ones Government. People always talk about how great America is because of the "rights" it affords its citizens, but the correct terminology is "liberties." Through liberty, America maintains these rights.

"I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands, one Nation under God, indivisible, with liberty and justice for all."

So the question shouldn't be whether or not they have rights, but whether or not our country should provide them with the same liberties afforded to its citizens. To say they have no rights goes against the very ideology that upholds America's reasoning for affording its own citizens (us) these liberties. I'm not saying that they should be afforded any liberties, they are here illegally and the consequences of entering a country illegally is to forgo the liberties one would be afforded under legal immigration.

Have you ever heard of the "Social Security Earnings Suspense File" Starting in the late 1980s the Social Security Administration received a flood of W-2 earnings reports with incorrect Social Security numbers. Simply because one is in the United States without permission does not give anyone a right to treat them any differently than one would treat a Citizen.

The Constitution, Federal Law, and Supreme Court Rulings have all made this "VERY" clear.

Why do people still think that just because one is here illegally that they deserve no rights or liberties?

In case you forgot, breaking the immigration law is a misdemeanor that carries a several hundred dollar fine, the legal equivalent of jay walking or public littering.

So why are you frothing at the mouth about it?

You justify the illegality of this act by the fact that the law interprets it as illegal, yet you seem to ignore the fact that the penalty is also extremely mild and that the "law" you rely on to pontificate also regards this crime as insignificant. Insignificant enough for the fine to be less than a speeding ticket in some places, so minuscule that people have to be caught doing it several times for it to be prosecuted beyond a littering ticket.

Surely we don't strip all a Citizens rights away when they commit an illegal act, why on earth does anyone feel they can do so to a non-citizen?

Illegal immigrants only have limited rights and liberties in the first place. In a nut shell, an illegal immigrants ultimate punishment is expulsion from the United States but while they are subject to the jurisdiction of the USA, they will continue to have rights and liberties until they are either given an opportunity to stay or extracted by ICE.

They enjoy the right to avoid paying taxes, the right to free health care, the right to drive without licences and insurance, the right to trepass on private property, the right to suck dry the education system by forcing every piece of text or literature to be written in English and Spanish, and apparently the right to a Monopoly-style get out of jail free card...

Nicely put in a prejudice kind of way!

Where you get mixed up is that many Americans also think they can get away with your aforementioned allegations and when caught the law hands the punishment both to the illegal immigrant as well as the American.

Manipulating facts is not what a true American should do. I recommend you refrain from this practice.

Well the USA does arrest, put on trial and deport illegal immigrants.

Don't forget, not all illegal immigrants come from Mexico, only 60% do according to many statistics. Lots of blame to be spread.

Alright, so let's assume there is an amnesty.....then make it the last one. If there is legislation, then make a provision that NO FURTHER AMNESTYS will be given....EVER. As for unification of families...ONLY if the party who is here can pay for their being here and it does not fall upon the citizens of California and the nation to support more foreign nationals.

By the way, comparing their situation to the civil rights movement takes cajones. Criminal behavior is not a civil rights issue.
