Justice delayed is justice denied. It's about time to enact legislation preventing bonding out of jail when a DUI or drug charge is involved in a motor vehiclular death. There's too much protection for the crime committer and not enough speedy justice for the victim and their families.

I would like to say that I was once engaged to Dr. Brooksby, we shared a deep love that lasted until his death & lives on in my heart. He was an indominable force.... a man I could never get over.... a dedicated physician and father. A person I thought would live forever. He had a force of spirit I have never encoutered in any other person. I can still hear his snake skin cowboy boots in the hall, still see his sparkling eyes smiling at me, still hear him laughing, still feel his hands, still smell his skin, still see him standing in my doorway, still feel him dancing with me, still see him draping his house with Christmas lights (he was a real-life Clark Griswald :)), still waking up on my birhtday with a phone call from him singing to me....STILL. His book is titled "Be Still and Know," I sit still knowing that I will miss him forever.

Merry Christmas B....this day will never be the same because the world without you in it leaves me knowing that there is a hole in my heart and in the hearts of your children. It is my prayer that the person who killed you is never able to kill another person and that he comes to true repentance before the Lord.

I love you - your "Darlin"

Amanda...My heart goes out to you and all of the families of this senseless crime. You are all in my prayers!

Abate & DC...you are both correct! This man should have not been let out of jail to kill again. I hope he is still in jail and sobering up. He has serious problems with drugs, alcohol and authority.

Jeff...I understand why you want to defend your friend. Please put yourself in the families of these victims. Would you want this man free to continue to drink, drive and kill again? I doubt it. You may think I don't understand, but I do! As someone who was arrested for a DUI many years ago, I understand! Thank God, I did not hurt anyone!! But, I made a choice to never drink and drive again...the only way to be sure!! A few years later, I was hit by a man who received his 4th DUI the day he almost killed me. It changed my life forever...the pain I live with daily, finacially it ruined me, emotionally I think of it daily - but I have my life! Both of these events changed me & my family dramtically. The families of Rodney's victims are changed and will never be the same. So, please before you choose to get angry with people who have lost their loved ones...remember it could have been one of your loved ones or even Rodney that was killed in this crash! I only hope that he will never drink and drive again when he gets out of jail/prison...he has another chance unlike the ones he killed.

I just want to say that Rodney Newkirk is my husband...well soon to be ex husband. Nobody ever expects to wake up one day and realize ur entire life has been ruined by meth. That goes for the victims families and our families. I've talked with Rodney and he is very sorry for everything that he has caused. I honestly don't know how anyone could live with themselves after something like this. And even though I had nothing to do with this accident I feel guilty every single day, because instead of helping him with his problem I just left. And for that I am truely sorry.

Dear Biker,

My wounds are healing very slowly, neither my husband or I are back to work yet. We are however leaving all this in the hands of the Lord and the Prosecutor. I hope he is prosecuted to the fullest extent. The saddest part most don't know is that because of the wreck 11 children have neither a mother or father. Two of the killed met because they had lost their spouse.

Mrs. B -

My thoughts and prayers are with you and your husband. I know it can't change what has happened, but I am thinking of you. I understand the pain you are dealing with. Please contact Indiana Criminal Justice Institute http://www.in.gov/cji/comp/
they have a fund that can help you and your husband with these expenses. I was not given this information and it would have helped so much.

I know this won't solve everything or bring your friends back.

Please remember you are in my prayers!

We tried that but because there was some insurance money they cannot help. You divide the money 5 ways...not equal and see what you come up with. Oh well we will do what we can. I do appreciate your help. Our attorney is seeing what he can do to help us out.

I also am a survivor of this tragic accident. I just learned yesterday that Newkirk's public defender has requested another bond hearing. His bond was revoked after the second arrest, so he's been in jail and off the streets, thank God! The hearing is January 25 at 1:00 in the Montgomery County Courthouse. Any of us bikers who want to see people like this kept off the roads should show up at the hearing to show the judge that we are watching this case and concerned that they will let him out again, to get high again, and potentially kill other innocents on the roads.

I too survived this awful accident, and all of us who did are still dealing with the memories of that day and feel the loss of our friends, and the pain of their families. I just learned that Newkirk's attorney has asked for another bond hearing, since his bond was rescinded following his most recent DUI arrest. The hearing is set for January 25, 1:00 pm at the Montgomery County Courthouse. Some of us who were involved in the accident and some family members of the victims plan to go to show our concern to the judge if they let this repeat offender out again. Any fellow bikers or other concerned folks may want to consider showing up as well. He could have just as easily taken out your son or daughter in their car... Indiana's lawmakers need to take these types of offenses MUCH more seriously before more innocent people are killed...

First of all I would just like to say Thank you to everyone who has shown their support and comfort during this terrible tragedy that no one will ever forget. As for this IDIOT Jeff that feels it is nessesary to defend his worthless friend, I would like to believe that if it were one of my friends I would be the same way, BUT I can't! Close your eye's and picture yourself having the last conversation you will ever have with your father and tell me it doesn't bring a tear to your eye. The last conversation I had with my father was a message I left him telling him that I finally learned to drive a stick shift, which he never got because he was busy being killed by your alleged friend, which you are willing to defend. Now I dare you you walk up to any of the 11 children, which are now orphans because of this worthless, worthless man and ask them if they have a problem with him? And then tell them they can take it up with you! Let me know how that works out for you... Or better yet... I don't live far and I have a BIG Problem with him can I take it up with you? I figure I have lost everything because of this piece of crap... If your speaking for him, come chat with me, I am not hard to find, BRING IT!!!
And as for this hearing on the 25th, I strongly urge everyone who has an interest in this case to show up and make your presence known. The more people that show they are watching this case, the better. Believe it or not a strong public presence does make a defference. But, if for some reason they decide to let Rodney Newkirk out for the 2nd time (to slaughter more innocent people and orphan more children), I know I will not be able to leave my own house without wondering if he is behind me in a car. And I have no idea how I will be able to raise my daughter in a world that has no problem letting murderers and hibitual drug users out of jail and back on the streets to possibly sell his drugs to children to pay for his next lawyer.
My father was wonderful man who had an impact on so many people. Now not only have I lost my mother, but now I have lost my father, the only person who actually cared about our family as a whole, and because of that I have now lost my family. There aren't even words to discribe how much this hurts. I hope he burns in the firery depths of hell...

I am a survivor too of this horrible accident. This has changed my life forever. As for Newkirk, he'll never get what he deserves in my opinion. My heart goes out to all my friends and loved ones who had to see things that you should have never had to see. You can bet I'll be at all of the court appearances.

My heart & prayers go out to each and everyone that has been affected by this horrible crash! I wish there was something I could say or do to help ease the pain.

As victims of a violent crime, you have a right to read a victim's statement in court. Please do not allow this right to be taken from you. Also, use the word "crash" rather than "accident". An accident is unintentional, this was not! He made a choice to drink and drive. In doing so, there were many lives that were changed forever.

Sadly, this could take a long time to resolve. I know in Marion County, I had to stay on the Prosector's office. They failed to notify when my offender was going to court. I kept up on it myself and showed up when he was finally sentenced...not for my case, but his 3rd DUI. His 4th was plea bargained and dropped...yeah!! He served about 20 days. I was allowed to ready my victim statement after the sentencing (since the charges when he ran into me where dropped, I had to wait until after). The judge was angry that these charges were dropped. But a high priced attorney made a deal with my attorney & the prosecutor. Stay on top of these proceedings and attend...you have every right. My offender's attorney was madder than hell when he found out I was in the court room.

Please post the outcome from the hearing on the 25th. I hope and pray the judge denys bond!

Again, you are all in my thoughts and prayers!

I just want to be sure we're all clear, this wasn't just drinking and driving. He was high on multiple controlled substances, and drugs. Unfortunately, our laws in Indiana don't seem to take that as seriously as drinking and driving. We have put together a petition for people to sign and return via email, which we'll give to the prosecutor for the bond hearing next week. You can access it by going to thevmc.com . You can go in as a guest, go to Forums, then scroll down to "Great Lakes Region", then go to "Indy Powersports Chapter", and the thread is called "Petition - Newkirk Bond Hearing". Please help us keep him off the streets. And thanks for all your support!!

Jeff,
You Dullard. I think he woke up one morning and said "hey lets snort some coke. Then it sounds like a good idea nd lets go for a drive" And fortunately for us so does the prosecuting attorney. Now why is that important. because when you knowingly operate a motor vwehicle under the influence. Not only are you an idiot. But its almostlike pointing a loaded gun at someone and pulling the trigger. Sure maybe your friend Rodney is a good person. But the fact that he is a dumb person and then proved that to all of us by doing it AGAIN. Well he deserves what he gets. I am now part of a family that has been destroyed by this. You still have your friend. But I hope not for long. Prison should be fun for him. If he gets let on on new bail even after he committed a second offense. Well I'll be there.

there is nothing that they can do to Rodney that will ever take away the pain and heart ache I feel everyday knowing that the last thing I said to my dad was did you get the pictures? The day before he was killed. "Lucky" for me he did. He had only had the chance to get to know my oldest son. We had plane tickets for Oct 9th to come out and see him. He was for the first time going to get to see my baby girl she was just then 2. Now my kids will never get the chance to know what a great person their grandfather was/is. I had not had the chance in 3 years to go home and see my family. Anyone that can sit back and defend Rodney in any way is wrong. And anyone that can sit back and say that there was something between them and my father just has no clue. Maria was a great person I was able to speak with her twice on the phone and I know she is missed just as much as my father. Mike Bird was a great man also I have been told and I know that it is true with as many people that have talked to me about him.
This piece of crap that has taken my family and our lives and torn it all apart does not deserve to be around. He does not deserve to enjoy any holidays or visitors. He should be left in a room with Pictures of all the faces of everyone that he has affected around him. and even then that is not the tip of the iceberg. I hate this person for what he has taken from me and my children.
I love my dad with all my heart and would give anything and everything to have him back even if it were just for a moment. Just a hug to say it will all be alright
