No one should pay a contractor a dime before he starts to work, and therein lies the problem that could have been avoided here. As badly as Mr. Prveromo was shafted, why in heaven's name would he give his contractor half of the agreed price before the work commenced, it is not as though it was a $2,000 job, it was 80 grand! Good, honest contractors will usually get paid as the job progresses, he does some work..he gets some money, if the customer gets behind, the work stops and the contractor liens the property; if the contractor is a "no show" or isn't progressing in a workman like fashion, the customer with-holds funding. Banks dole out money on construction loans as work progresses, and honest contractors are used to getting paid that way.

This is yet another situation where Judges have lost track of common sense. The builder ripped off his client, loses the lawsuit and get everything he stole back, PLUS. If Rendlen weren't so narrow-minded and tunnel-visioned, he would know that his decision was stupid. It doesn't matter what his politics are, Republicrat or Democan, Common Sense needs to be used more than it is.

This story is unreal and sickening also. It just boggles the mind. Is the judge insane? I feel bad for the man. Never give a contractor money until they've started working.

How is the larceny victim a "creditor" subject to bankruptcy law? Common sense says that criminal restitution has nothing to do with people who voluntarily issued credit to the guy. What a joke. What a moron judge. Here's the link to his work number if you want to call and comment on his ruling.

Let us not lie!

This is a Republican judge, recommended by the Justice Dept and approved by Alberto Gonzales in 2006.

The victim appears to be an independent, no record of him being politically active.

Please, Republicans AND Democrats, quit lying... it really hurts your cause.

Besides... These laws were passed by Newt Gingrich and the congress of 1996-7 when they revamped the bankruptcy law to favor banks and penalize citizens.

The sad truth is banks and other large companies bribe congress every day... and now the laws favor the large creditors, at the expense of small business owners and individual citizens.

The judge was really constrained by the way the law is written. He really had to rule as the law was designed. Since the law was written by lobbyiests for the banking and credit card industry, little things like fairness were not even considered.

This was bad law the day the banking industry wrote it!
