Sure is, but he was not back on 05/02/12 when this was opriginally posted, his Date Received (Original)is listed as 05//31/12, and he will be there for two years.I would have thought he would get a longer sentence than that.

yes i understand that, but he decided to go to jail 2 weeks before his sentencing thats why it says he went to jail on 5/2/12. I was thinking the same, hopefully the victim is getting her life back together

I know someone who.just slept with a 16 year old. He's 27 and she was more then willing. She admitted to me she slept with him. I turned it into the cops and the cops asked him and then asked her and they both said nothing happened..so now the cops r all done. They claim it was all a lie which its not. The cops just don't care. They just sweep. Shit under the rug. And this will happen again very soon. Im sure cause he's still txting her. Wat business does a 27 year old have taking to a 16 year old lil hirl

Maybe the judge didn't think this case was that bad? I am sure they have seen a lot and have grown immune to local crime.

I wish there was a manual for criminals to get a standard sentence for different infractions. It seems to me many other places put more emphasis on justice.

What can we do?? I wonder what other communities have done when they have found themselves in a position where they feel the criminal charges seem to be too lenient and the sentencing was too lenient?

It’s like the place is being slowly becoming more and more down-trodden and over run by low-lifes.

Even the undesirables from Utica come up to Lowville to steal from OUR Wal-Mart (Jan. 28, 2012)!! Maybe the word is out that if you want some leniency --- why not come to Lewis County!

From the article www.myabc50.com , 8/02/11 "A Lewis County man has been arrested for rape after forcibly having sexual intercourse with a 13-year-old female.
"State Police in Lowville have arrested Brian S. Burgy, 49, of 7176 Brewery Road in the Town of New Bremen, for rape 1st degree and endangering the welfare of a child."

I found the NY State guidelines and 1st degree rapists are supposed to get:

Rape in the first degree is the most serious rape offense and is considered a Class B felony. This carries a very hefty potential sentence of UP TO 25 YEARS IN PRISON. This rape charge could apply if you had sexual intercourse where:

1.It was by force,
2.the alleged victim was helpless,
3.the alleged victim was under 11 years old, or
4.the alleged victim was under 13 and you are over the age of 18."

Some people in the community are under the assumption leniency in sentencing implies he wasn't all-that-guilty. This is the wrong assumption. The leniency has to do with the judge. I wonder who this judge was?? Hopefully, he/she isn't "practicing" anymore.

BTW, what ever happened to Frank J. Mann? He was supposed to have his trial March 8, 2013 and so far no new news.

Robert L. Sixberry, Sr. 54, vanished after raping a 13 year old. He only received an appearance ticket but never showed up for his Aug 4, 2009 appearance date. Simply vanished.

But then again, Corey R. Passage who's victim was a 8-year-old girl in 2008 in Carthage just had is trial Mar 25, 2013 (5 Years Later). He only received 9 years, albeit better than 2, for 1st degree rape.

I know some of these gentlemen have only been accused ... but why do they get to walk around amongst for SO LONG without a trial? I believe this is giving some people in the community the wrong impression, as well. Besides, the consequences could be disastrous.

Daniel. S. Rounds and Patrick J. Elliott are supposed to get their trial May 17, 2013. Let's see how punctual this is.

i honestly think that he deserved many more years than 2 years, thats like a slap on the hand. Poor girl, couldn't even imagine what she has went through. Hopefully she continues to have strength to continue on with life, and not end it because of this a**hole. No girl ever deserves to go through what she did.

This girl is till dating older men with her mother's approval. I think he tried to help out and got accused of something he didn't do. Pretty hard to get a fair trial when the victim is posting all over the internet as to what "happened" to her. His lawyer gave him good advice. I wonder when telling someone they loved them became a crime. And I would put money down that she wont hesitate to try and contact him. I hope his family is vigilant.
