LOWVILLE — A Port Leyden man admitted Friday in Lewis County Court to sexually abusing a young girl over the course of nearly two years.
Frank J. Mann, 52, of 6970 Sullivan Trailer Park Road, pleaded guilty to charges of predatory sexual assault against a child and endangering the welfare of a child. Sentencing was set for March 8.
He was accused of repeated acts of sexual contact with a girl under the age of 13 from January 2010 through September."
The age of the child is now being reported as 13 years old. I guess they used the two years of abuse to increase her age from 11 to 13 years old. March 8 will be the sentencing. He can get up to 25 years, see NY state guidelines below:
Rape in the 3rd degree:
This crime is considered a Class E felony, punishable by up to 4 years in prison. You may be facing this charge if any of the following apply:
1.You engage in intercourse with someone incapable of consenting or agreeing to it,
2.You are over the age of 21 and the other party is less than 17 years old, regardless of whether or not it is consensual, or
3.You have intercourse with someone without their consent.
Rape in the 2nd Degree:
Second degree rape is considered a Class D felony and carries a potential 7 years behind bars. You could be facing this charge if the prosecution has reason to believe you:
1.had intercourse with someone who is mentally disabled or incapacitated and unable to give consent, or
2.you are over the age of 18 and your partner is less than 15 years old.
Rape in the 1st Degree:
Rape in the first degree is the most serious rape offense and is considered a Class B felony. This carries a very hefty potential sentence of up to 25 years in prison. This rape charge could apply if you had sexual intercourse where:
1.It was by force,
2.the alleged victim was helpless,
3.the alleged victim was under 11 years old, or
4.the alleged victim was under 13 and you are over the age of 18."
A Port Leyden man has been charged after authorities say he engaged in sexual intercourse with a child under the age of 11.

There are only a couple of reasons you would take the time to come on here ... under the heading, "Port Leyden man charged, accused of sex with child under age 11", and comment in the way that you did.
And none of the reasons really point to good character.
I hope they throw the book at Frank J. Mann and give him what he deserves.
Everyone knows, tolerance has limits!

The reason why people comment the way they do to you is because you are ridiculous. I agree you need to find something else to do with your time. No woman would make the comments you do. You try to be holier than thou and yet you are worse than anyone on here. What gives you the right to name call and make assumptions based upon news stories? I agree this man deserves the book, especially since he plead guilty. We must remind ourselves, though, that sometimes people take plea deals when they may not be guilty or completely guilty. You try to pawn your beliefs off on other people. If you haven't noticed, your beliefs are not rubbing off on anyone.

He's lucky that it wasn't my child. There wouldn't be a need for a trial, well maybe one for me as I would kill the asshole and shove his cut off dick in his mouth. It sickens me that people rape/abuse innocent children. If you have such an uncontrollable urge to have sex buy a Hooker, don't violate a child and ruin their life forever.

Oh you are not an overly educated woman. If you were, you would realize that every news article is the interpretation of the writer and the reader. It's very obvious that you believe everything you read. There are many educated people on this site, but I can tell you are not one of them. Don't flatter yourself, no one reads your bizarre postings. If anything, it's called skim reading. You should be sorry about your name calling, you've done it plenty of times and not just the neanderthal comment under this posting.

Tolerance. I have them articles and I habe found others that shoot yours down full of holes. Yes sometimes people take a plea. See this isn't a big city with lots of lawyers and most can't afford decent ones and haveto use a pd that has any where from 300 to 500 cases going at 1 time in the public defender role and in private practice. I personally know a lady who has been waiting for almost 4 months to talk to her lawyer. She calls every day and stops in often trying to see him and only time she sees him is right before court each time. They are told to take the plea and they are in a way rail roaded due to this. I have no tolerance for the justice system half the time up here because of this and am just glad that I don't use a pd since they are over worked and under payed.

I'm sorry for that friend of yours and the story that you shared concening the pd. I have never (yet!) had to get a lawyer for an infraction, but if I do I will keep your advice in my back pocket! Thanks.
I am hoping this time our justice system won't let us down by giving Frank J. Mann a light sentence. Since less than 1-out-of-10 of these sexual abuse etc. incidents ever are reported, it would be a shame not to prosecute to the fullest extent.
I am so proud of the little girl, and the strength of her parents, to bring these allegations forward. The parents must have suspected the social stigma (to put it lightly) a story like this could bring to the family, but they did it anyway! What strength! I hope this little girl grows up strong like her parents and uses this horrible chapter in her life as a spring board for betterment. Because of them, this man has found justice and won't be a threat to others in the community, for awhile !

Tolerance I just wanted to point out that it says the girl was UNDER the age of 13 and he had been sexually abusing the girl over the course of two years therefore when he started abusing her she was about 10 or 11...Wow it takes a genius to figure that one out!

Thanks for your inquiry. You are correct, the abuse happened to this child BEFORE she was 11 years old.
Therefore, Frank J. Mann SHOULD be sentenced for abusing a girl UNDER THE AGE OF 11 not over the age of 13, since the abuse happened to her BEFORE SHE WAS 11.
A few posts back, the New York State Guidelines for Rape demonstrates how the sentencing is reduced as the child's age increases from under 11 to over 13.
So, my point was that they should not be allowed to use the TWO YEARS of abuse to artificially increase the VICTIMS' age from under 11 to over 13 in order to reduce this man's sentence. I believe this resolution was unscrupulous.
( As stated in the latest article ~ Feb 5, 2013 concerning this case, Frank J. Mann only plead guilty after her age was artificially increased !)

The names you have given may not help many people with the identity of these two gentlemen. Were they convicted? are they on a registry?
I have read on TOPIX you can refer to someone by name if the charges have already been published AND they are an adult. If both of these conditions aren't true, it's called slander.
