UC Daily News (178 posters sued)

The authors of comments on the Topix.com Web site were secure in believing they were anonymous, however, a judge ruled their names should be revealed.

Mark and Rhonda Lesher lives in Northeast Texas; Mark practices law and Rhonda runs a beauty salon.

Last year, a woman and another, accused the couple of a sexual assault and then the anonymous comments about the incident started appearing on Topix.com .

Statements included that they were perverted, sick, vile and inhumane.

The couples' attorney, said that the comments were a form of persecution.

When the couple got their day in court, a jury found that the Leshers, along with their alleged accomplice were not guilty, but in the online Topix forum, it seemed, the trial continued.

The Leshers said it basically made them both feel like common criminals.

The Leshers said it made them feel as though someone had raped them of their reputation and standing in the community over and over and over again.

So, the Leshers sued 178 anonymous commenters on Topix.com and a Tarrant County judge ordered Topix to turn over identifying information about the users listed in the lawsuit.

Topix has until March 6 to comply with the ruling.

Topix Officials said that the Topix discussions are not necessarily a license to run people through the mud.

Topix said that if the line has been crossed and it seems reasonable, Topix will cooperate with the courts.

The lawsuit was brought in Tarrant County because it appears at least one anonymous poster lives there.

Just for the record, a few years ago a North Dakota professor was awarded $3 million over claims that a student Web site defamed him.

Wait until my case goes to Court. Any attorney will scoff at 3 million. Double digits are in line for mine. Especially since I am a pharmacist and my reputation has not been drug thru the mud, but bashed into a mud oblivion.

This is such old news. Topix did eventually comply with releasing the IP address information of 178 Topix users.

However, in the end I believe they only were able to identify 3 users. I can't find where any of their suits agains the specific users were ever settled or decided.

Most of the 178 posts were traced back to a local business where the owners were known to have had a feud with the plaintiffs. I believe it was settled out of court, but I don't know for how much.

The troubling thing Harold is that everything people said about you is true! You can't fight the truth.

The problem with suits like this is that you have to prove actual damages. Not just "my image was tarnished". You have to demonstrate that you suffered a tangible loss because of something that was false was said. And you also have to prove there was malicious intent to damage.

Another BIG problem is that someone needs appreciable assets to make them worth being sued. Does anyone really think the nitwits making idiotic post on this board have any appreciable assets? HAH--that's a good one.

FYI - I have been following this case closely and the court case is still pending. The jury trial is set to begin on December 6th in the 348th District Court of Tarrant County, Texas.

Out of 178 IP addresses most were traced back to six posters who have been named in the pending lawsuit. "Topix analysis indicated that about 70 percent of the defamatory comments included in the Lesher's petition belonged to a handful of IP addresses."

I have a lawsuit going now! Topix will be legally forced to hand over all the ip address. The real Danny Mauk did not post the above comment. The slander, libel comments, and intent to hurt a business is going to come back and haunt many people and cause a lot of attention to their names!

Harold,

I will have to admit there has been a lot of attacks aimed at you over the past 12 months or so. I'm not going to slander you but I will list a number of accusations made against you and you can reply to them individually.

Remember - the truth is not a form of slander

1) You ripped off bands on more than one occasion by either refusing to pay them or pay them a reduced amount.

2) You didn't pay DJ's and security workers so they had to sue you.

3) You hired Danny as a manager, paid him slave wages, then booted him out after you gained his knowledge.

4) You installed stripper poles so you can satisfy your carnal needs

5) You went to other bars and tried to hang up posters there - in essence trying to lure customers out of other bars.

6) Ditto on bartenders and managers. You tried to steal them for your place.

7) Every club you went to you acted like a total buffoon and tried to pick up anything in skirt.

8) You tried so hard to pick up your female patrons that you made women uncomfortable so they quit coming in.

These are a few of the multiple accusations the Topix people have landed against you. Look them over and tell who's slandering or just telling the truth.

You went broke at the Dawghouse because you do not have a clue on how to treat customers and treat staff! You tried to make it a personal playground but businesses don't work that way.

To " To Harold Ross". To start off, you are fake. You could not even use you real name. No worries, it will be revealed at a later date. I will say a Federal Judge will decide if all your allegations are slander and libel accusations. You say this a truth, I say you are a local competitor that will be revealed. Yes, I made mistakes, but not to the extent that you acclaim. Have a great day. At least I tried to give good entertainment to Terre Haute with a good dance floor. I would rather try and fail than not try at all.

I think your imaginary lawsuit will just bring more of the same attention to your name.
