So there is a burn ban right now...what happens if you burn some old brush piles? How do you get caught and what happens if you do get caught?

How do you get caught? Seriously?
Probably by someone
1) seeing the smoke
2) smelling the smoke
3) seeing the fire
4) seeing you try to put it out once it gets out of your control and calling the FD while laughing at you
5) seeing you when they come to kick your a$$ for almost burning THEIR house down while being an idiot

I'm sure there are other ways, but those just came to mind right off...

Burning a pile of brush is ALWAYS illegal in Vigo County. Burning is only legal if done in a container with at least 4"side and covered with an ash grate.

It is also illegal even in an approved container if it represents a health hazard or nuisance to you neighbors.

Roy,

You could burn without a container in the county, but the city it is illegal to burn anything.

OK, so enough with the smart ass remarks. When I asked how you get caught, I meant by whom, the police or the fire dept?? Obviously I know someone may see it or smell it, duh. I am just asking how you get turned in to get in trouble and what is the trouble you get? How much of a fine, etc...geniuses on here geez. If you dont know anything dont waste your time answering.

The deal is, you can burn a tire filled with elephant manure as long as you are cooking food. They cannot stop you from cooking your food. ALWAYS have a pack of hot dogs on hand

Here's the County ordinance:

C. Open Burning.
1. APPLICABILITY: No person shall open burn any material except as provided in
the following exemptions:
2. EXEMPTIONS: The following types of fires are permitted:
A. Fires celebrating school pep rallies, scouting activities and camp fires
used solely for recreation purposes, where such fires are properly
controlled by a responsible person.
B. Residential burning where residence contains two or fewer units.
Burning shall be in a non-combustible container with enclosed sides, a
bottom and mesh covering with openings no larger than 1/4" square.
Burning is prohibited in apartment complexes and mobile home parks.
C. Farm burning of wood or wood products derived from farming
operations. Clearing operations are not considered farm operations.
D. These exceptions apply in all areas where they are not prohibited by local
ordinances or by other officials having jurisdiction, such as local fire
officials.
All exemptions shall be subject to the following:
1) Only wood products shall be burned.
2) Fires shall be attended at all times until completely extinguished.
iii. If a fire creates an air pollution problem, a nuisance, or a fire hazard, it shall be
extinguished.
**** 4) All residential and farm burning shall be conducted during daylight hours and
shall be extinguished at sunset.
**** 5) No burning shall be conducted during unfavorable meteorological conditions,
such as temperature inversions, high winds, air stagnation, etc.
**** During the months of October through March, the burning of leaves is
prohibited before 10:00 AM and after 5:00 PM each day.

As you can see---the ONLY legal residential burning in Vigo is to be done in a sided container with mesh grate and then of wood products only. Even then--if the fire represents a nuisance to ANYONE it is to be extiguished immediately.

I dont know that God has given anyone the right to burn anything, especially when it puts other people's property at risk. I know it makes for a nice, militant-sounding statement, but it's a little lean on facts, IMHO.
As for how you get caught, police or fire, I don't know for sure that it matters...anyone could observe what you are doing and report it. Most likely you'd have both...FD coming to put out your fire, and PD coming along to write you a ticket. Im not sure how much the fine is, because it differs depending on jurisdiction...county, city, etc...

I know it sounds stupid but if you have a hot dog on a stick they cant fine you. i have even got permission in the city limits to have a wiener roast in the past you have to call the fire chief. I had permission from paul mason several years ago to have a fire

Just set the fire then if its noticed just tell the authorities you don't know who set it. Then tell them neighbors have complained about the unsightly brush and you think one of them did it. If they can't prove ya did it they can't do anything.

heres an idea, instead of figuring out a way around it, why not just wait until the burn ban is over.
