Judge rules minister must testify

The judge did the right thing here. I'm not clear on one thing though.
Was the minister the defendant at the hearing, or was it the murderer?
I ask, because the "defendant" said he didn't want the protection of clergy privilege, in that he wanted to testify. The news article wasn't clear to me.

From what I got the Defendant who is a JW didn't want to use the clergy privilege in this case. It was the minister himself that was trying to invoke the privilege so he wouldn't have to testify... The judge had made the decision I believe before the defendant waved that confidential privilege or in spite of it.

Which is really confusing me.
Because when the Gilbert Simental molestation case happened they claimed it was the defense attorney that pushed the whole clergy privilege thing and that the it wasn't that the elders didn't want to testify. Here we have both the Defense and the prosecution that wanted him to testify and yet again the minister was trying to use the clergy privilege in order not to.
So to me it looks like someone is telling these ministers to invoke that privilege. But who???

The 40-year-old mother of two was found dead April 28 inside her Tamarisk Street home. Kelle Jarka, 40, faces life in prison if convicted on charges of first-degree murder in connection with his wife's death and the special circumstance of committing this crime for financial gain.

Authorities have said Jarka took out more than $1 million in life insurance on his wife before her death. County records show Jarka was deeply in debt. Jarka missed two consecutive mortgage payments before his wife died, owed almost $30,000 in back taxes to the state and was ordered in November to pay a credit card company nearly $11,000, court and county records show.

Detective Jarvis also testified that someone used Jarka's laptop to perform Internet searches using the words: "How long does a life insurance policy need to be in effect to pay out?" And "Can you suffocate from a pillow?"

Defense attorney Mark Johnson asked the detective whether there was any way to tell who used the computer to conduct those online queries and when they were performed.

No, Jarvis replied.

Jarka was arrested in May, about a month after he called Murrieta police and reported that his home was burglarized. About 30 seconds into the call he said that his wife might be dead, according to police.

He told police he was out buying coffee and baby formula and returned to discover the home was burglarized.

Isabelle Jarka was found in the master bedroom, the couple's infant son not far away. She was hit in the head at least 11 times and the weapon used to kill her has not yet been found, according to prior reports from Murrieta police.

In testimony Wednesday, a Murrieta police detective explained why he believes the Jarka home was staged to make it look like someone broke in.

Three dresser drawers were placed beside each other on the floor near where Isabelle Jarka's body was found.

"I felt this crime scene was staged," testified Detective Andrew Dorcas. "Most crime scenes are not like this ... These drawers appear to be placed, put there, not just tossed like a burglar would do. They were placed somewhere in a specific manner."

Johnson asked how a bona fide crime scene would typically look.

Drawers would typically be thrown across the room. They would not be placed neatly by each other, he said.

Isn't it possible, Johnson asked, that a burglar could pull drawers out and they could just happen to land beside each other.

"Anything is possible," the detective replied.

Prosecutor Burke Strunsky asked Dorcas if there was any money found in the Jarka house.

Dorcas replied that $509 in cash was found in the master bedroom, about 8 feet away from the drawers.

The preliminary hearing resumes this morning.

Jarka is being held at the Robert Presley Detention Center in Riverside. He is ineligible for bail.

Why does someone else have to be involved who is to say he is not rying this on his own?

Does it not say in the article that there was a recent million dollar life insurance policy taken out which is now trying to be collected on?

I'm sure there has been more than one phone call to NY. Are there any pay phones anymore? I haven't noticed one lately but then I quit looking for them when I got a cell phone years ago.
