TAZEWELL – A $25 million lawsuit against Tazewell County has tentatively been settled.
Patricia Stallard, administrator of the estate of Kevin J. Stallard, II, had sued the county, the school board and Richlands High School employees Karen Webb, Angela Cox, Debbie Smith and Bradley Strong for negligence in the death of her son, Kevin J. Stallard. Kevin Stallard died in physical education class at the high school in September of 2007.
The suit claimed the school system and its employees had knowledge that Kevin Stallard had a heart condition that prohibited him from taking part in physical activity. The suit also alleged that employees were slow in taking the appropriate steps once Stallard passed out.
While the settlement has not been approved by the court, both Michael Kernbach, attorney for Patricia Stallard and Erin Hapgood, who served the school system said an agreement had been reached.
Unless there is an order sealing it, the terms of the suit should be available once it is approved by the Tazewell County Circuit Court.

Knowing this won't bring back her son-but am glad that she finally got some kind of closure. RIP Kevin!

Brad Strong killed that boy and he should have to go to jail; however, because he is married to a Mullins he will get away with murder.

coach strong is hard but great guy i had him in class an palyed a little bit of ball for him too he pushes everyone to the max b/c he wants them to do their best im sure if he truely knew that the boy couldnt take it he would have never said a word at a certain age a person with a medical problem has to know where to draw the line i m sure he didnt know what that poor boy was feeling one has to look at things like this look at the kids today they are sorry and teachers spen 90% of the day with the kids of today so if they dont push them we all know most parents wont my heart goes out to the family of the child an also coach strong b/c i know he feels awful about it but it wasnt his fault he grew up around my family an played ball with my dad a long time ago so there is a little history there i guess but the thing is we all need to teach are children with medical problems when you feel like it may be to much dont be afraid to sit this one out

Oh and to a former student- Strong and everyone else knew about the child's heart condition. Strong kept pushing him to run even when the child tried to stop running. Strong killed him.

TAZEWELL - The mother of a Richlands High student who died in class last fall is suing the county, the school system and several employees of the system for $25 million.
The suit was filed March 6 by Patricia J. Stallard as the administrator of the estate of Kevin J. Stallard. It names Tazewell County, Tazewell County Public Schools, Richlands High Principal Karen Webb, School Secretary Debbie Smith, Nurse Angela Cox and Phys ed. Teacher Brad Strong as defendants.
The suit claims gross negligence and seeks damages for medical and hospital expenses, funeral expenses, mental anguish and loss by statutory beneficiaries. The suit alleges that Stallard had a heart condition that excused him from taking physical education and a note had been sent to the school explaining that.
It goes on to say that he was allowed to dress out for physical education anyway and was running wind sprints on the day he died. The complaint filed with Tazewell County Circuit Court states that Kevin J. Stallard developed a disabling heart condition during the 2004-5 school year.
The complaint states that Stallard was told to refrain from physical activities including physical education. Richlands Middle School officials were informed of the problem and he was excused from the physical education classes.
Those restrictions continued for the remainder of time Stallard was in middle school and Stallard advanced to Richlands High School for 2007-8. His condition was unchanged and his pediatric cardiologist wrote a note excusing him from physical activities.
The complaint states that the note was sent to Richlands High School before the first day of school and given to the secretary because the principal was not available. The complaint goes on to say that the principal was out that day but did call Patricia Stallard later in the week and discuss Kevin’s condition at length.
The suit states that when school opened at Richlands temperatures were high outside and interior temperatures were oppressive and excessive. It states that the temperatures exceeded 90 degrees and the school system had no central air system.
It also states that the school system did nothing to accommodate students with pre-existing conditions. Shortly after the start of school, Stallard’s mother said she asked her son if he had gone over his health restrictions with his teacher.
The suit states that Kevin Stallard told both his parents that his teacher knew about his condition and he had seen the note. The complaint states that Kevin Stallard was allowed to play basketball on Sept. 5.
The following day Stallard was supposedly running wind sprints when he collapsed in physical education class. The suit alleges that the physical education teacher did not take appropriate steps to render first aid.
It also alleges that the school nurse did not administer proper first aid or summon the proper medical authorities. The suit claims the Stallard home was called and his father was asked if the boy had any history of seizures or fainting.
The father then told them to get critical care treatment for the son. The suit claims CPR treatment and cardiac revival techniques were not properly administered. It also alleges that fire and rescue personnel were not provided an adequate medical history when they arrived at the school.

you say he was one of your teachers??? I guess it wasn't a course that required the ability to write clearly. Anyway, yes, he's well connected. I'll bet a lot of money is changing hands right about now, but his employer hasn't even reprimanded him.

Why should he be reprimanded anyways. Clearly if his employer had thought he had done something wrong, i'm sure some form of action would have taken place. The times we live in now. if a teacher even touches a kid its a law suit. So what are they to do I mean honestly.

Justice speaks the truth. There are some administrators as well whose "credentials" are basically paper ones, not based on serious academic preparation.

Strong was my PE teacher at Tazewell Middle School. I remember him well. I remember how he and several other male coaches would make lewd comments about girls who had developed early. It was sickening. I also remember how he and another male PE teacher would taunt a boy who had a learning disability. They would make fun of that child in front of other students. Then allow the other students to taunt the child. Strong has short man syndrome. He acts so macho to cover up the fact, he is a twerp. I hope he gets what is coming to him whether it is on earth or in the afterlife.

I've known coach strong foe a very long time an i find that hard to belive.
