PLEASANTON: 28-year-old pleads no contest, will serve three years in state prison

In a sentencing agreement with a judge in Hayward, a transient pleaded no contest Thursday to two counts of having unlawful sexual intercourse with two Pleasanton girls.
Under the agreement, Lemuel Lawrence Diggs, 28, will be sentenced to three years in state prison.
Diggs had previously rejected a plea deal with prosecutors. Deputy district attorney Delia Trevino said the major difference in her deal and the judge's offer was that she wanted Diggs to register as a sex offender whereas the judge said that would not be necessary.
Diggs had sex with two Pleasanton minors, one 15 and one 17, in 2005.
According to court records and Pleasanton police, Diggs helped a 15-year-old Pleasanton girl run away from home with him to San Francisco in October 2005, where they slept in parks and begged for money. Most of the money was used to buy drugs, which they smoked together, police said.
The girl said she had consensual sex with Diggs.
Diggs forced a 17-year-old girl to have sex with him twice. The victim reported being drugged unconscious when one attack occurred.
Pleasanton police Sgt. Barry Mickleburgh said police were alerted to Diggs' whereabouts by the 15-year-old's parents after the two returned from San Francisco.
Officers searched and found girls clothes in a room at a hotel at Hopyard Road and Owens Drive in Pleasanton where Diggs was registered.
Diggs and the girl were found at a nearby restaurant, Mickleburgh said. The girl reportedly told police what had happened.
Under the plea deal, Diggs will be sentenced to three years in prison. He will be eligible for parole after he serves 50 percent of the time. The maximum sentence is four years and eight months, officials said.
Diggs also has a conviction for raping a juvenile in 2003, according to court records.
He was on probation at the time the new crimes occurred and will be sentenced to one year in a county jail for a probation violation. He has already served that time, Judge Christine Moruza said.

This is so pathetic.
This guy has a prior for raping a minor. Rapes, kidnaps and gives drugs to two others and gets a 4 year sentence AND does not have to register as a sex offender.
He should be convicted as a "three-striker" and taken off our streets for life. He is a habitual criminal that continues to attack children.
This kind of crap makes me sick.

if im getting this info right this guy tried to ubduct 3 people in my naborhood in the past month luky for me i was in new jesrsy but my friends are scared to death!
he needs to be in prison much longer!

i am one of these girls, and this fool is still after me and nobody tried to stop this and he only had to do a year and a half? he knows where i live the cops knew this and still didnt have to register as a sex offender????? wtf!!!!!!

When I was 15 and he was about 19 we began dating. I got pregnant. When I was 8 months pregnant and he was 21 he left me for a 13 year old... 13!!! I can't imagine how many girls he has hurt since then. Just so you all know, he's back in jail for unrelated charges. Hopefully he'll be in there a long time.
