Nicholas Shooting Lawsuit

Those departments involved should pay for all this damage. This was clearly an outrageous overuse of force, to say the very least. And no, I am not a criminal. There were MANY OTHER CHOICES, that could have been made that day. But everyone with a badge, was angry and thus a knee jerk reaction began and tragedy resulted. Many don't think before they act, but law enforcement is supposed to be trained to do so. Clearly it was not applied in this case. These families were placed in imminent danger, and should be paid at least for the physical damages.
It is not that I do not appreciate what law officers are there for, what I don't appreciate are supposedly trained persons with guns who cannot control their emotions in a volatile situation, thereby increasing risk to innocent bystanders.

they should be charged with wreckless endangerment! it no wonder someone wasn't hit by stray bullet, hope they bankrupt Nicholas county!! GOOD LUCK!!

the report I read said it lasted over 3 hrs. that is not a knee jerk reaction and Mr Evans could have threw out his gun and ended the standoff at any time...

If Dallas Knight wouldn't have started crap with the old man, everything would be fine. The nerve of him suing over something that he caused. Maybe one of those stray bullets should have hit him & made everyone happy!!!

The tragedy started when they did not follow protocol and approach with caution and USE COMMON SENSE. And the second would most likely not have occurred if that second person, after 30 minutes, thought he could do any better than the first and regrouped instead.
Hopefully neighbors put their cell phones and cameras to use to help their case.
And if you are the trash man, they proved themselves to be as qualified as you.(That's not a compliment)jst to be clear.

All they should have done was shoot the poor guy in the leg. Took hiin in. End of story. There was all thise cops shooting at a little old man. Shame. Shame I hope coos have to pay. But they wint. Thing will ever come of this. They do what they want in this town.

First of all it WASN'T Dallas Knight that was fighting with him. I am not exactly sure which neighbor it was but I KNOW FOR A FACT that it wasn't him, so before u go running ur mouth get ur facts straight!!!!

Some of you should give your name to the cops and tell them to call you next time their is a crazy guy with shotgun blasting people. Then you can capture him alive and save the day. Problem is you will be cowering in the corner calling 911 begging for the police to save you.

yes please dont they show up at least 150 of them shooting in all different directions what would they do if they had more than one 84 year old man with birdshot they are very lucky they didnt shoot each other or someone else. god help us if the next person does this is not a senior citizen and has a gun capable of shooting more than 40 yards. this really brought out what our police can handle

Why dont you go to the Sherriffs and city office and tell every single officer this to their face,exspecially Buddy and Tommy!!!! Im sorry but if a person is shooting at me,in their right mind or not,I AM going to shoot back without any hesitation!!! GET OVER IT!!!!

may be one of the requirements for job any way, you would think they could at least hit the house they were aiming at but the didnt they hit it and one on each side i mean come on if you cant see how sad that is your a complete idiot. in a earlier post they said didnt have to end this way but once you shoot a cop they are going to shoot you no question there was no way it wouldent have ended this way this is how police wanted. youve never seen them go in a drug house with such force have you? i knew mr evans and if he wanted to he would have shot more than a leg his shooting skills were far superior to police he was trying to scare them off once you get that age your mind is not as clear as it was when you were younger. its really hard to say if he even had the gun when he exited house. this man was 84 if theyd backed off he would have been naping before long.

By the time all of the officers got there, was there one person in charge? One person calling all the shots? It sounds like it was " find a hiding place and start shooting". The Cool's house had at least 50 rounds on one end according to the tv news, did the elderly gentleman do that or the officers? I'm just curious, was our sheriff in charge or the state police or someone else?
I figure a quick settlement, too many things need to be hidden on this. I doubt anyone wants to hear the details of the condition the elderly man's body was in when the last shots were taken.
