SHAWNEE — A pair of Chandler grandparents have been granted temporary guardianship of their unborn grandchild.

A Pottawatomie County judge Thursday granted Chuck and Annette Deal temporary guardianship of the baby, which is scheduled to be born Friday to their daughter, Samantha Anne Deal, 21, said their attorney, Joe Vorndran.

Samantha Deal is the mother of Serenity Deal, 5, who died less than a month after child welfare workers recommended she live with her father, Sean Devon Brooks, 32. Brooks is accused of beating his daughter, and faces a first-degree murder charge in Oklahoma County District Court in connection with Serenity's June 4 death.

Serenity had been living with Chuck and Annette Deal until the state Department of Human Services removed her from their home, claiming the Deals were allowing Serenity to visit with her mother unsupervised. The Deals deny any wrongdoing.

Four child welfare workers from Pottawatomie and Lincoln counties were placed on administrative leave pending the outcome of an internal DHS investigation.

The grandparents were caring for Serenity and her younger sibling because Samantha Deal is accused of sexually assaulting a 10-year-old boy. Samantha Deal is scheduled to enter a blind plea Tuesday in Lincoln County District Court. Prosecutors have recommended she receive a 15-year prison sentence.

Her sentencing had been postponed because she is pregnant with her third child. Brooks is not the father of that child.

Vorndran said DHS officials Thursday argued vehemently against placing the unborn child with Chuck and Annette Deal. Since the child will be born in Oklahoma County, DHS may try to have an Oklahoma County judge issue a different order and take the child anyway.

“We're hoping that doesn't happen,” Vorndran said.“My clients want to be able to take their grandchild home and care for it this time without any disruptions.”

Vorndran said there will be a hearing next week to review the temporary placement of the infant.

Her father, Sean Devon Brooks, 31, is charged with first-degree murder in connection with the child's death.

Sources close to the case said Wheeler argued vehemently against the girl's living with Brooks.

In recent years, at least two other children who had cases handled by child welfare workers in the Lincoln County office have been killed.

Melissa Ellison, 5, of Prague, was beaten to death in 2002 by her father and dumped near Meeker. Aja Johnson, 7, of Davenport, was kidnapped and killed in March 2010 by her stepfather.

The Oklahoman has not found that Wheeler was directly involved in those two cases.

no. He didn't have blood on his hands. The Lincoln county judges have the blood on their hands. Research both cases.

if my ex wouldn't have went to prison for robbing a gas station at gun point my son would've been one of the many lincoln county children in the ground. Judge Sheila Kirk gave him standard visitation after committing a violent 85% crime. A violent criminal! Thank God he went to prison shortly after. Only sentenced to 2.5 years but once again, welcome to Lincoln County!

YOU go back and research the case, the judge followed DHS RECOMMENDATION, the lie that the judge returned her '"against" DHS suggestion I perpetuated by the media every time the recant the story

No, you're kind of wrong here.

Has anyone actually looked at this issue?

The problem isn't with a DHS worker, it's with the system and the judge.

For everyone else, don't blame someone that follows the rules that we're all responsible for putting into effect.
The fact is, DHS is overwhelmed and most of you are awful parents.

The guy killed himself. He's not assuming guilt, he's processing his grief. The guy tried hard, for a long time, to ensure this kind of thing didn't happen. It was his final request at DHS that this not happen. When it did, he killed himself.

Perhaps people should stop assuming their opinions matter when they read actual news stories?

There is no hope for humanity.

Judge Sheila Kirk gives visitation to violent drug addicted parents all the time. A new tragedy is coming with more blood to be on her hands.
