I think the prosecuter has it right. It looks to me like an accident brought about by an incredibley reckless act, probably involving some kind of horseplay. May God have mercy on them both.

Once again, another Long Island teenage punk acts like he is invincible.

How stupid do you have to be to be playing with a loaded gun?????

AND how stupid do you have to be to stand near someone playing with a loaded gun?

Both kids got what they deserved. One died, and the other will hopefully go away for a long time. Accident or not, this is not the type of person who should be allowed to stay in society. He is too reckless and stupid to be allowed in the general public.

Good riddance to both.

Interesting, 2 days to arraignment for this guy who claims to have shot his brother by mistake. Mind you, the cop who claimed he shot his cop fiancee "by mistake", wasn't arraigned for 3 months......

My lil bro accidently cut my hand down to the bone, while we were mucking around with blades.......I duct taped the wound and avoided hospitals...

So, a non-cop shoot his kid brother, arraigned in 2 days. Cop shoots his fiancee...3 months.....equal enforcement of the law, huh?

I believe the cop who shot his finacee first stated someone else shot her and he was sleeping, it was only until he was charged did he come up with the "shot by mistake" excuse.

if Sean Clark shot his brother on purpose he deserves jail time. If it was an accident, if they were just goofing around, then jail time is not warranted.

You could be right, hmmmmmmmm thanks for the correction. Unfortunately, that is neither here nor there, as the point is, closely similar situations, with employment status enabling one suspect to avoid arraignment for 3 months.

I love the fact that the Judge scoffed at the proffered "accident" defense, as the suspects own statements belie same.

If this really was an accident then he shouldve known better than to mishandle a loaded firearm. Why was it loaded in the first place? You never load a gun in your house, unless there is a scumbag trying to break in of course. I feel terrible for him if it was an accident, I couldnt imagine killing a family member because of a stupid mistake. He sure doesnt look too bothered in the photos.

Of course jail time is warranted if they were goofing around. If it wasn't intentional, he obviously did not use the care required to handle a fire arm. If he was goofing around with it, it is absolutely reckless on a criminal level. It's not like he was playing with diet coke and mentos and popped a cap it was a friggin shotgun.
