Unless there is something in writing -- some sort of written disclosure advising of the policy to maintain supervision at all times - or - a signed statement acknowledging that this policy was verbally disclosed, there seems to be only a small element that can uphold the parents legally. Children run around all areas of the park all the time -- and have for years. It seems to be a convenient way for the state to avoid a lawsuit by placing full responsiblity on the parent. Without proper disclosure, this is clearly a split responsibility -- a percentage of responsibility to the parent(s) for not maintaining full supervision of their children. And, a percentage to the state for not properly maintaining the park and it's facilities. In conclusion, it appears that in this case, negligence is shared.
