The fact that a lawyer, with obviously a great degree of bias, is allowed to make such a dispicable comment or argument in open court is a hint of what is wrong today, not only with the legal system but society as well. To even be able to form such a warped thought pattern, that it condemns the victim as the guilty, is disgusting beyond words! I hope you never have a restful nights sleep for the remainder of your haunted life.

This sort of behavior that these people were engaged in that was the cause of this accident goes on all the time, all over the place. We see it on the highways every day, in road rage, people of all types going 20, 30, 40mph over the posted speed limits. Individuals in our society these days have very little regard for the safety and well being of others if it conflicts with their own behavior. The fact that this horrible accident happened shouldn't shock anyone who drives our roads. What should shock and anger us is if the convicted gets anything less than the maximum sentence under the law, his lawyer disbarred, and all his assets, any anyone who was remotely helping to promote the behavior of the speeding individuals at the time have all their worldly possessions taken from them, none of which will still equal the loss of the family who had their mother taken from them.

Itís sad when we have to fall back on the threat of punishment to enforce responsible behavior, but we must not wavier on that punishment when faced with this type of individual.

That is just sick to think they are blaming someone that was walking her dog like she did every day and to say that accident was her fault. The person should be shot in the head themselves

Sounds to me like there is plenty of reasonable doubt in this case. I find it a perfectly acceptable explanation that the woman accidentally walked in front of the car.

Did she have headphones on? Was her dog acting up? Jack Russell's are very excitable dogs.

It sounds like there is plenty of room for an appeal. Why was that lawyer allowed there in the first place?

That lawyer should be stripped of his license to practice law. Dave "the killer" Conent should spend at least 10+ years in jail and not be given a license to drive again. The rest of the crew should also loose their license and be fined hard for their stupidity!!!! As for Massachusetts, you live in a liberal state and vote in liberal law makers, this is what you get for justice...You started voting out the liberals after fat face Kennedy died, KEEP IT GOING, take back the Commenwealth and place enforcers in office that will change these tree hugger laws to punishments that will make idiots like this think twice! I agree with you 100%, there are some serious problems with the criminal justice system in this state, not only with the people who think they are above any law or rule and can drive or act any dam way they please. That's the biggest reason this countrys so screwed up.

You're not very bright, are you? A judge presided over this case. He heard all of the testimony. Don't you think the guilty party's lawyer would have discovered during the discovery phase if the woman was wearing headphones? If there was reasonable doubt the verdict would have been not guilty. That's how the law works. This judge thought there was no doubt that he was responsible and negligent and that his actions and his alone caused this woman's death.

An appeal is almost automatic. But this killer should man up, serve his time, and fade away into obscurity. And hopefully never have a good night's sleep knowing that he killed a person.

Stop trying to play armchair lawyer, you're doing a poor job and embarrassing yourself.

I heard she was texting while walking. Something that really bothers me. She probably walked out on the street in front of this poor guy while texting a friend about her new panties or complaining about a headache...something stupid like that.

Look they're white-trash. Their parents really messed these kids up and they will never learn or be productive to society. These kids should not be allow to breed. They will just make little bass turds like their parents and again not contribute to society but again kill another inocent person. The average citizen uses common sense and knows who was at fault (regarless of the comments of a very few morons).

Hey, I sat in on the trial and heard every word of testimony and argument. It was not even close.

The judge got it right. The police got it right. The average person got it right. The driver and his history of racing wantonly about for the past 10 years resulted in his sentence. A sentence that was too light even.

Would anyone trade 18 months in a county facility for their mother's life? I THINK NOT!

In my opinion the judge agreed that a message had to be sent to other rally club members who race around streets, cause numerous accidents (as the driver's record showed that he had over the past TEN YEARS) and put our families in danger.

Will they stop it? We can see there are a minority of idiots who STILL DO NOT GET IT!

This was NOT just going to fast on the highway.

This was about 6 bmw drivers racing at 70 or more miles per hour on a curvy, narrow, country road and killing an innocent mother of four.

The judge got it right (after the defendants "lawyer" managed to postpone and postpone and postpone for a total of 15 months.) The police got it right! The average person gets it. The neighbor who heard them racing on his street got it right. The mechanic that testified about the "handling" improvements got it right.

May god bless the children, the husband, and all of the family and give them strength to go on.
She was a 54 year old health, smiling, beautiful, loving wife and mother.

I do not text and don't have a tolerance for people texting while in my way or while driving. Supposedly, neither does the legislature because they are going to be the first to pass a no cell phone use in cars while driving, voice activated or not...maybe the roads will be safer then.

The sad part is David and his BMW owner group friends do not accept that he killed a woman with his dangerous weapon, and that he was using it recklessly and dangerously.

The sad part is the heartache and pain that both families have had to endure. I'm sure that the BMW community understands and accepts the gravity of the situation and the outcome but to attack an entire community isn't fair. I'm a BMW enthusiast that acts responsible and applaud the people who organizes the events that are available to us to enjoy our vehicles in a controlled environment. The message has surely hit home here in the south and hopefully Mrs. McCaffrey's death will at least make all of us more aware of our actions while driving.

I don't understand that if there's no doubt that these guys were racing why haven't any of them been charged it?

Mrs. McCaffrey is gone and there is nothing that any of us can do to bring her back. Was it a senseless death? Yes, but the guy who hit and killed was given his sentence and is serving time.

Oh and BTW some of the comments I've heard about the victim texting is disrespectful and has nothing to do with being stuck by a speeding vehicle.
