Does the state of North Carolins allow Police to cross county lines with out a warant in their county or the county the went into and Take someone by force across county lines with out permission from the county the Accused lives in?
I know In most States the Officer ""Other than the state police"" has to have a warant and then it has to be taken to the majistrate in the county the guy lives in and then permission is given to extradite. But in the case in Question, the police bypassed all that and Kidnaped the person from Irdell County and took him to Catawba County for trial. Is that Leagel In North Carilina.. i have never heard that they could do that. i know that if a warrant was issued out of catawba coutny that idell county could arrest them incarcerate them into iredell county jail until he/she was transferred into cawtaba but i never heard about it being legal for iredell to arrest and carry straight over , i am doing research on this because i am diffently interested in this..

i did find out that idell county nc does have what they call a prisoner transport team and what that is allows officier from that team to transport inmates across county lines to other detention/correctional facilities.

They have to authorize the arrest threw the other police department or DA but yes they can cross county and even state lines if its oked by the local police force

When you find out email me at shaggy_24740@hotmail.com I think any officer that crosses a county line has to have permission from teh county he goes too. And a authorisation has to be issued by the Judge of the county in Question. The reason I'm interested is the Police are creating criminals down there, and anytime a Lawyer tells the cliant to throw himself on the mercy of the court, the court presumes he is guilty,, that isn't fair for the accused. I know 3 cases so far of Lawyers doing this, one was in West Virginia where I personally know the man was innocent, but he took his Lawyers advise and is now pulling 40 years. I know cases down there where the police set a guy up,, basically because they have in the past went with the guys wife, and thats what started his problem,, he is now in the Catawba County Jail, they crossed over to Irdel County and virtually Kidnapped the guy and took his sister computer out of her house without showing a warrant. That just don't happen in America.. I have notified the Senator down there, and so far your senator hasn't re" to my email. I think you all need a new senator. |

Well what I'm saying is ,, the law don't state they can do that,, they are supposed to get permission from the local Judge, or Magistrate to issue a warrant. No one can cross a state line not even state police, they are not bonded to do that, and the county officers are not bonded out of the county. They can't go beyond their bond, to make an arrest, even in Pursuit they have to notify the next locality if they think the person is going to go over the line. The Judge says.... Did anyone Offer you anything or threaten you in any way to make this plea? Well who is going to say anything in a situation like that? They ask are you satisfied with your attorney,? Those are not questions to ask someone in a no win situation,. Thanks for the replies.. |
