"The medical examiner ruled the death an accidental drowning. The report indicated Gerst was still conscious when he first entered the water, he had a broken right wrist, a fractured rib, and multiple areas of scrapes and abrasions on his face and upper body."

How does someone accidentally drown while they're conscious?

The way the article reads:

-Kent Gerst was out with friends. His family claims witnesses saw him attacked multiple times.
-Kent Gerst did not fall as originally speculated.
-Kent Gerst entered 1 foot of water while conscious with a broken wrist, broken rib, and several abrasions on his face and body.
-Kent Gerst died from drowning in 1 foot of water.
-Remember, Kent Gerst did not fall.
-There will be no charges.
-The end.

Tell me….does that sound as absurd to you as it does to me? Am I reading this wrong?

The whole story doesn't sound right. I don't understand how they can justify not charging his attacker. All reports I read state he didn't fight back. This is a tragic story and I feel for the family.

Apparently, I have been living under a rock, as I am just reading this story for the first time. I would agree that nothing about this story makes any sense. I ask myself, what would happen to me if I was involved in a bar fight with someone who ended up "accidentally" drowning as a result of their retreat? The simple answer is that they would lock me up and throw away the key. This story stinks to high heaven and smacks of an O'Fallon / St. Charles County cover-up. The question that should be asked is, who was the person that attacked Kent? Off-duty cop, friend of a judge, a family member of the mayor?

O'Fallon - one of the safest cities in America? Part of feeling safe is knowing that there is justice for the fallen victims of crime.

My prayers go to the family of the victim of this tragic act and for our corrupt legal system.
