Who is responsible, St Marys City Council or the Hospital Authority?

Both. However, the consent order from the Superior Court Judge Pope stated that the SM-HA has to be in strict adherence to the GA Code 31-7-75. I think the Judge as pretty much locked up what was to happen and the Authority and its attorney never got a green light as to what to do. The law is pretty clear. They violated the law whether they think so or not.

The city council should have had better oversight of what was going on. However, because the HA is an entity created by the State of Georgia, City Hall have no say so as to how they spend the money..an appointed board with too much power...seems to be the norm in St Marys. Time to dissolve this unaccountable board. Get rid of em.

All the boards, committees and authorities in St Marys have too much power. That is the major problem with St Marys. Put all that with city councils and mayors scared of their own shadows and you have the disaster that is St Marys government. Ever action and ever thought must be run by attorneys; that is why the citizens pay such high legal fees for such a small city.

However, de facto, if city council puts them on a budget of $1.00 per annum, they will be starved into oblivion - unless, of course, they have $3,000,000 in the bank.

Spencer is attacking the problem in the right way. Like you suggest there is no death penalty. Having them follow the law and not allowing spending on frivolous back slapping "look at us the Big Shots" projects would be like a life sentence in solitary.

Great post. The back slapping "look at us the Big Shots" is the way it is in St Marys. They just love spending other peoples money (OPM). Makes them feel important. It gives them a chance to strut in front of the city hall suck ups. The Hospital Authority $3,000,000.00 slush fund and the $1,600,000.00 Gilman Yacht Club purchace are prime example of a city council that cares nothing for the average property tax paying homeowner.

I agree with you about the $1.6 M spent on the Gilman Boat House. That is money simply wasted and the property was taken off the tax role costing us more money.

The whole $3M Hospital Authority is a mess but I cannot agree with your analysis. If the Hospital Authority is forced to stop paying for the senior citizen programs, we, the taxpayers, will have to pay for them and we will see an increase in our taxes. I have to think that, in this case, the city council has acted for the tax payers.

Under what law does it say that St Marys property tax revenue must be used to pay for, support and subsidize "special" downtown seniors with free meals, entertainment and a clubhouse? What happened to social secutity, medicare and self responsibility?

It has been decades since the St Marys City Council has acted for the homeowners and property owners. We pay high property tax and high water and sewer bills to support that abortion of a government on Osborne Street. This council is like the councils that have gone before: a "special interest" council. They are on council only to protect their own little schemes to rip off the citizens of St Marys. None of them have a clue how to be an altruistic good council member.

It is obvious, Anon that you are one of the "special" downtown seniors being supported with this $3,000,000.00 HA slush fund. You don't want to let go of that money or teat do you?

Looks like Jim Stein/Hospital Authority have a big problem. Council did not do as County Commissioners. They now have to explain what happened to the money. Without a covering stating what Hospital Authority requested in the language from Council; they now have to produce all audits from 2007 to present.

Lets hope some people go to jail over this. A public audit and accounting for all the funds spent must be done. In addition to jail time for any illegal actions, any money illegally spend must be paid back to the people of St Marys.

It may be time for council members and HA members to individually lawyer up.

Your imagination is running away. No one is going to jail over this. For that to happen, there would have to be proof of an intent to defraud and then the question becomes, "who was defrauded?"

The money will not have to be paid back, the worst that can happen is an order to stop funding senior programs as has been done.

Many are making way too much of this. Even if proper procedures have not been followed, no money has been stolen and no one has become rich.

The Times Union did not lie, it reported what Jason Spencer told them. If anything reported turns out to be false, then Jason Spencer has lied to the Times Union and, thereby, to us..

Absolutely right. If there has not been a complete audit and report, it must be done ASAP. I have seen no proof that the Authority members have treated themselves to elaborate meals and entertainment but, if they have they should individually pay back the costs. If any members of the Authority have accepted any payment for their service as a volunteer me4mber of the Authority, that money should be returned. If there is any evidence of misappropriation of Authority funds, the member or members responsible should be held accountable.

But, any funds used in good faith for what the Authority and the city reasonably believed to be legal at the time will not and should not be repaid. When you say they should be repaid TO the people of St. Marys, you miss the fact that they were originally paid by the Authority to the people of St. Marys and the people of St. Marys would, if you get your wish, be the ones paying back the funds.
