The answer is clearly yes if the three gay guys hate black people (which some do), and the black guy did absolutely nothing to provoke the beating. As a matter of fact, it is a hate crime if three black guys beat a white guy for no other reason other than hate.

This was far too easy of a legal question to ask. The law is not blind when it comes to hate crimes. The people who believe hate law is blind are the only ones who still don't see the light.

In this day and age, can't people just "live and let live"? why does a person need to hurt someone for no reason. If you are not gay, you can't catch it from a gay person. Seems like the more the government wants to force diversity, the more hate there is.....acceptance is the key...come on people grow up.

But couldn't you argue that most crimes are at least somewhat driven by hate? It's not too often you hear about someone beating up their best friend.

Come on. It's not "hate" as in, "I hate that dude for stealing my xbox." It's hating someone for who they are or are perceived to be, regardless of their actions or inaction. This isn't a difficult concept.

They "hurled" slurs at him? How much does a slur weigh? They sound heavy if they are "hurled". Or perhaps in the modern day vernacular, they vomited slurs at him.

The next time a group of minority yutes mug a white guy while calling him names, we'll see if your statement holds up, or if hate crime legislation is (as I suspect it is) a one-way street.

They wouldn't have been arrested if they'd just thought bad things about the guy they assaulted. No, they made the choice to act on those thoughts, violently assaulting someone just because they didn't like him or people like him. So this isn't at all about punishing people for their thoughts. It's about punishing people who make the choice to turn their thoughts into unprovoked violence.
