The Florida Bar Fails To Perform Investigation Of John Fares Asmar
A complaint alleging serious ethical breaches of ethical misconduct against John Fares Asmar, The Florida Bar File No. 2013-00.231 (1A) was dismissed on the basis of documents submitted without conducting an independent investigation on the grounds that there was a lack of clear and convincing evidencing evidence.
John Fares Asmar, is a Pensacola lawyer with a long and controversial list of, shall we say dubious issues in his past. He is involved in Pensacola politics and if you Google or Yahoo his name you will see more on this individual that will shock your conscience. He is involved with the politics of Sigma Alpha Epsilon fraternity and the Pensacola City Council and you should be aware of the character of this individual. Do your homework!
Heidi E. Brewer, Bar Counsel, Attorney Consumer Assistance Program, ACAP Hotline, 866-352-0707 asserts there is "insufficient evidence from the materials provided that the attorney has violated any of the rules adopted by the Supreme Court of Florida which govern attorney discipline."
Then, she stated that "the Bar's records retention schedule, the computer record and file will be disposed of one year from the date of closing." Well, the public will be damned, won't they! Without records there will be no records to show a pattern and practice to show allegations of Mr. Asmar's conduct!
The Bar was just too busy to conduct an investigation on its own and I feel sorry for the people of Florida! We know Florida has a lousy governor! How about the long wait that Florida voters had and that national disgrace! Well, how about the disgrace that The Florida Bar is alerted to serious conflict of interest allegations, serious breaches of fiduciary duty allegations, and the like and the Bar holds its nose, closes its eyes, only looks at the paperwork and says, from the paperwork, I don't think you have enough here!
The people of the State of Florida are not well served by The Florida Bar, by Ms. Heidi f. Brewer, The Florida Bar, Mr. John Fares Asmar or those who are elected or appointed to serve the public in the State of Florida.
