Nothing to complicated here except the fact the fatal shot that killed him was in the back. Seemed a little strange, if the guy was attacking him with an axe, how in the hell was he shot in the back? Now Hmmmm thinks he turned when the gun was raised but the story says he was first shot in the leg so one would believe the gun was already raised somewhat. Now this being said, we could go with the Kennedy theory of a second shooter from the grassy knoll to the victims rear, using exactly the same rifle as gunman number one who shot him in the leg. OR, did the second shot ricochet off of the victims belt buckle, then off of the trucks fender, then off of a rock and then strike him in the back? Now do you see what I mean??? Nothing complicated in this story at all....

OK.. You got me on this one. And why is Mindy Jo stirring up a bee's nest in the back woods of North Carolina?? Maybe we can pull SKIDSEE out of retirement and have him post down there as I am sure those of the bible belt will be mystified by the teaching's of SKIDSEEOLOGY.. As i understand the facts..the guy threatened the shooter with an axe, at which time the shooter shot him in the leg with a deer rifle. The Guy started to run away and was then shot in the back. After which he was bashed on the head with the rifle butt.
What you have here, im thinking, is a case of a Vermont Grand jury sending a message to out of state thugs that certain behavior wont fly here.
Read up on the background of this incident...the citizen Grand Jury had the power to make the deciscion., they made it and its case closed, as far as the murder charge, hes still in trouble for bashing the guys head after.

I do believe he is only able to read our little squabbles here but unable to post again, as in being locked out of the forums. Same can be said for Fineman and Urkel... I guess either the banner or topix has the ability to block your ISP so a name change means nothing. That would mean NO ONE from his house is able to post here. I think it is horrendous that sand let this murderer escape justice. How can it be self defense with a shot to the back and the coroner report stated it was a homicide. As usual Sand did not have the guts to prosecute. The jury was from his county with neighbors and neighbors friends on the jury. We know the truth, how they lured him to the field. Brought rifles to the fight deliberately. And then several of them approached the car with his fiance in it. I would have chased them away also to protect my fiance. Sand has ruined this county. Crime has gone up, I'm afraid to walk the streets. And it's all because of Sand.

I have to agree with Disgusted in VT crime rate is skyrockiting, and not just in Burlington. But all over. and it seems the ones who should be punished are givin a free walk and those that deserve a second chance are having the book thrown at them. such is life and we all know that isn't fair!!!

Thats what happened correct? Coroner/ME reported correctly.

Of course being in Bennington I have only read what has been printed but if it is true that because of the lack of substantiating evidence I believe that the lesser charge of aggravated assault sounds more appropriate in this case! I feel that none of this should have happened to begin with and if as disgusted in VT says there were others involved with this there should be more people charged! Are there any additional charged people? Your story sounds a little off also! Bizarre !!!!!!!!!!

I dont like Sand either but in this case he was in a no win situation....if the Grand Jury refuses to indict ..that's the ball game.It would be interesting to see what testimony the Grand Jury saw, its unusual for a Vermont Grand Jury not to indict in a case with a death.

Ditto! The case had to be weak or inconsistent (not enough factual evidence to go forward with a trial) for the VGJ not to return an indictment!
