Then when the going got tough with questions from Dr. Kohls, the corrupt superintendent got going out of our school district. But, Mr. Baker worked closely with his old advisory committee and hand picked Mr.Lolli to "carry on business as usual, good old boy style!" But Mr. Lolli could no longer hold the fort of deceit, lies and hidden money after January 2012 when Mr. Petroni and Mr. Rigano came on board to review the pay to play fees and "get it right." Just like a domino effect, all the liers and deceivers are tumbling down.

Most organizations have a Treasurer's Report presented to the Board either monthly or quarterly, with a final yearly report provided showing all financial activity. Where are those reports? If the Board and Attorney never got financial reports, why didn't they ask the Treasurer for them?
Since the main purpose of the Boosters was fundraising, wouldn't it be likely that amounts raised and items or money donated would be the focus of their meetings?
As the Boosters attorney, would Mr. Kirby have been responsible for making sure that they filed the proper forms with the state and federal tax authorities? Doesn't an attorney have an obligation as an "Officer of the Court" to see to it that laws are followed if he is their attorney of record?
Can he really just say that they were misled for the last seven years, without having been provided a tax return(990) or a financial statement? Or were there actually falsified financial documents provided to the SAB Board?
Doesn't Mr. Kirby place himself at risk of, at a minimum, being accused of negligence, if not criminal activity, for not reporting malfeasance. Or is he willing to stand up and declare his ignorance? Either way, it is probably going to damage his career....do people want an attorney that will not ask questions and ascertain the facts to represent then?
I have a hard time believing Kirby is in any way responsible for any of this mess. Why do you think he is at risk here? Do you have something against the guy?

a "publicly known fact" I thought - SBC is Not school organization rather an organization of people who promote school activities outside the school admin's influence. the Parents (ie band boosters) are in the same area of influence. Much like the PACs they promote their own agenda but no one candidate is responsible for them. Mr Kirby provides a service ( he gets a title of agent for said group) if he gets one dollar contract is made so his view is an agents view he is the groups spokesman. Now if you talk about the Mr Long's status/relationship or AD/super status you are talking employer/employee completely different ,much like the treasurer of Boosters in other school dist. club she was responsible to club not the school dist. for financial mis-actions.

First, many may be confused and saddened by the news of this past week and of the potential events surrounding this district's support organization. For the record, Dr. Kohl's was a lone voice in 2010 and 2011, raising questions on this and similar matters. Dr. Kohl's attempts then were often met by silence. As reported in the press by Jim Rigano 2 weeks ago, and again today by the Dayton Daily News, there is an ongoing investigation, which has bearing on the depth of my comments.
Prior to today's Dayton Daily news article, we learned the Springboro Athletic Booster organization's 501 (c)(3) status had been revoked November 15, 2010, by the IRS. This information was confirmed by records posted on an IRS public website on July 13, 2011.
The Board was notified privately less than 2 weeks ago, that an officer of that organization made a substantial donation to the Springboro Athletic Booster group. The recent receipt of money paid to the Springboro Athletic Boosters for the benefit of Springboro's students is a good thing. It is also prima-fascia evidence of the need to make some immediate changes. It is now time to take action, and I have a few recommendations for consideration:
1. Establish and implement better controls over all third-party groups purporting to raise money for any program, building, club, student organization, etc.;
2. Create license and / or rights agreements to establish better controls over who has the right to use the district name, logo, sell advertising, sell clothing, etc., which promote any club, sport, or activity sponsored by the Springboro Community City School District;
3. Establish and implement a district wide branding and license program surrounding co & extra-curricular programs which would include but not be limited to the sale of apparel, advertising, marketing, facility use, sale of goods or services, etc.
4. Cancel all associated or relevant contracts related to these or any activity of which that agreement has not been approved by the board. Recent examples are yearbook contracts, the Fan Store donation activity, picture sales, and sport and / or band advertising agreements. In their place, make all agreements valid, binding, and open for renegotiation in the event they are not competitive, fair, or necessary.
5. Knowing there are so many volunteers, parents, businesses and residents who give so much to support the success of this District, it is disheartening to me to even raise the question. We should authorize legal action, which include but not be limited to injunctions to cease any activity, company, club, support organization, or other venue that has the appearance of ethical conflict or using this districts name for recognition to raise funds that do not benefit our district programs.
No longer can we dwell on these matters, which create exposure and lend opportunity for possible abuse. It is time this board has meaningful discussions and concludes with actionable items. Speaking for myself, it will be helpful for me if the entire administrative team evaluate the above items, add any other ideas, and be prepared to vet them fully at our July 17th board meeting, or a special meeting in July as may be necessary.

Under the direction of our Treasurer and administration, our district has taken immediate actions to change certain aspects and business practices surrounding co & extra-curricular activities (commonly known as our "sports and band" programs). As these events continue to develop and unfold, further actions may be required.
Clearly, the events of the past two weeks have changed the way we all must view the landscape that defines how our support organizations, club sports, vendors, and sports camps interact with this District. These events will necessitate urgency as exhibited by our administration and I support any additional action needed to protect our programs, children, and district community.

The principal at the junior high deemed it a better use of funds, however the diversion of those funds meant that the parents were now on the hook for those missing and diverted funds.
The Fan Store shows donations from TWO donations from 2008-February 2012. One was made just after the election of Petroni and Rigano, the other in February 2012. I have emails from Dr. Baker in 2006 exhorting us all to buy our spiritwear from The Fan Store because all proceeds go to Springboro Athletics. Yet they have made just two donations only recently, three months apart, in the past four years that we can document.
Every dollar that is raised from athletics should go to athletics. For no other purpose are those concession stand dollars being raised. If there are not athletes performing there would be absolutely no concession sales.
Every dollar that is siphoned off to other groups, no matter how well intentioned, is another dollar subsidized by the parents of athletes who must make up that lost dollar.
Every ticket that is donated to the PTO to sell is money the parents of the athlete are expected to subsidize.
Every shirt that The Fan Store sells and does not put the money back into athletics is another dollar the parents must subsidize.
Every dollar that is raised by volunteers manning the concession stands that does not get to the athletic department is another dollar that is expected to be paid for by the parents of the athletes.
Every dollar that is spent by a coach is a dollar that is made up by the volunteer efforts of the parents of the athletes or subsidized by those same parents.
The children have been used as pawns long enough. The time to be straight with the community, demanding the honesty and transparency we all deserve is now at hand.
This needs to be repeated.

since the question was asked - exactly what can the BOE do to regulate the "outside" groups the fan store can be throttled by license agreemets for SPRNGBORO stuff but not BORO/panther/etc to be licenced as the OHIO Buckeyes know and tried to stop with "THE" on all their LIC. stuff I can have blue and white Boro Panther on anything and there is very little that the BOE can do - "BOARD OF EDUCATION" by defination they oversee EDUCATIONAL issues how about they get that correct 1st. The SEA is running ramrod over the Politico issues while BOE does nothing. the SEA are employees and are far more effected and affected by BOE. By the Open market the Boosters will be affectd. the BOE needs to stay on point within their charter. Much like the boro 5 event it appears to me that someone is doing smoke and mirrors : the BOE needs to clear their own house 1st. otherwise the super and union will launch a new tax levy effort. New super has already hinted at that.

Kirby's very eloquent Springboro Sun explanation of this booster situation might hold a lot more water once the investigation's findings are made public (assuming this is an investigation).

The longer it's buried, the worse it stinks, but local taxpayers simply have to "hold our nose" and just keep digging, to root out this corruption for which our city/township/and school government leaders have now become widely well known.

Just keep digging. The answer lies in staying informed and engaged in local government concerns so that we can root out the bad and the ugly the right way by voting them out of office. The answer to cleaning up dirty leadership does not lie in trumped up lawsuits (in which our township government is involved) which simply transfers money from taxpayers pockets into the lawyers' pockets; and does nothing to clean up the politicians dirt--just offers a layer of green to cover up the dirt--as in the Wade Field project.

IMO it appears as though the only leverage strong enough to retrieve such information is a impartial, thorough police investigation. Please bear in mind that rapidly elapsing time at this specific juncture could at the end of the day, end up being one of the most decisive factors.

Now is the time for the BOE to demand an audit of all the sports accounts held by the coaches. These separate athletic funds violated Board Policies and should have been held by the school treasurer in the 300 student activity funds. The BOE needs to DEMAND the STATE AUDITOR do their job and audit these funds for the last ten years. It started with Debtwiler and Baker and continued until now. The blame can't all be on Lolli and the new treasurer.

Just turning the paltry ending balances over to the school treasurer after years of using the money for everything except the kids is not enough for all the hardworking parents and volunteers who raised all the money and worked all the camps, fundraisers and activities. We don't want what's left, we want what was collected and should have been spent on uniforms, equipment, safety measures instead of extras for the coaches and other staff.

The BOE and the parents need to write, call, fax, email the State Auditor at http://www.ohioauditor.gov/fraudcenter/siu/co...
to come and audit these illegal accounts that have not been used for the children, but usedg to enrich the coaches and all their buddies.
