Victim's family endorses plea deal for Antioch chef

It is good he is remorseful. It is also good the family is understanding and forgiving. None of this should matter when it comes to protecting the public at large from a drunk driver. Reckless homicide resulting from driving drunk is not an accident. An accident is an event that is not planned or intended : an event that occurs by chance. David's excessive drinking to the point of being drunk did not happen by chance. He mostly likely planned to drink and likely did not plan to find an alternate means of transportation without putting us all at risk. None of the actions of him or anyone else involved in a DUI accident happens by chance.Prosecutors and judges should consider the wishes of the victim's family in plea deals, however their first obligation must be to protect the public

I was wondering why this thread resurfaced, now I see. I think he got off way too easy the first time, and by violating probation and getting shit-faced (look at the blood alcohol level), he remains a danger to the public. Did he drive himself to that probation check in? Is his "tearful remorse" because he's gonig to go back to jail?

Take away his license. Permanently.

It was a car crash in that he killed someone while driving with drugs in his system. He was given probation which he violated by continuing to abuse drugs and alcohol.

Drugs, alcohol in his system and I believe they tracked his cell phone to show he was also texting when he hit and killed the man. And yes, I live in Antioch too.

Well I see david (no capital to start his name on purpose) is up to his usual tricks. For all you people who support this scumbag you are right he is getting better. At least this time he didn't KILL anybody. There is no way in hell that he should be walking our streets let alone driving anymore for a long time. Is it going to take another death to realize what a loser this guy really is? Are we suppose to feel sorry for him because he is living in his basement because his mistakes? Same sentence as the first time which didn't seem to help. What make the judge think this time will be any different? Let's get this idiot off the street for longer so the next time (and there will be one) it won't be anyone else's loved one.

Yes, the victim was intoxicated and walking down the middle of the road. Unfortunately, Mr. Maish was also intoxicated. I just hope and pray Mr. Maish gets the counseling he surely needs while serving his sentence for this terrible incident. One life lost is enough.

Yes, he was asked to leave Dockers - my understanding is that "problem" involved Maish. How ironic that Maish ran him over shortly afterwards.

The problem as I heard it was a huge fight with a woman in the resturant. He was asked to leave and did then walked down the middle of rt 59.

Looks like a slap on the wrist. Acouple years ago a drunk driver killed my friend. That lady got 7 years. Straight to jail. And has to serve 75% of sentence before possible parol. It was her first offense. This guy must have some cash or strings to pull to get off that easy ?

Why is this guy not in jail?!! Why is he still able to walk around his restaurant laughing and joking?!! Why is he still able to sit outside in front and enjoy the weather on nice days?!! He is a 4 strike loser. Killing someone, drinking and driving, texting while driving, and violating his parole(still drinking).

Me too, one of my favorite places in town. I keep praying he straightens out his life and gets better. Everyone deserves a second chance.
