To Pocola Town Voters
The following facts are offered in response to unfounded allegations in a political ad placed by those supporting candidate Jerl Mitchell in the 3/27/13 edition of the Spiro Graphic regarding the races for seats on the Pocola Town Council, Wards 2 and 4.
• Allegation by Jerl Mitchell: That $25,000 of street materials was misused on a road on private property at the urging of Bud Williams, Don Didier and Phil Smith
• Facts:
o The road in question was not private property—it is an access road on school property (owned by citizens) to a public school building that also serves as a public storm shelter. The road is used by school buses and teachers, and is the only access road to the storm safe room, which is made available for public use after school hours. The police department has a key to the safe room and opens it as a public shelter after school hours. The road is not on private property.
o Mr. Williams brought the matter to the attention of a former Council, which approved the expenditure. He never requested or urged use of Town funds on a private road.
o This project was approved by a previous board of trustees in conjunction with other major street repairs. Smith and Didier were not on the Council when this action was approved.
o The current town council has been informed by the town’s attorney that this matter is not an issue.

• Allegation by Jerl Mitchell: That city drainage tiles were misused
• Facts:
o These drainage tiles were donated to the Town by a Fort Smith business for use as the Town saw fit. At that time Trustee Smith was liaison to the street department and had the tiles installed to improve a long-time drainage issue along Gregory Street.(Note that Mitchell had not just one, but two, tinhorns placed by the Town in 2 driveways at his residence on Morris Street.)

• Allegation by Jerl Mitchell: That Didier “harassed” street department employees for doing their jobs
• Facts:
o Didier observed a street department employee hauling expensive chip gravel stockpiled for street repairs to the sewer plant to be used as a pad for an equipment barn. Didier stopped and told the employee the material he was loading was not the proper material for building a pad—and that it’s also very expensive.
o Later Didier again observed the employee continuing to haul the gravel, and again told him to stop, and the driver said he would. Later that day Didier was physically assaulted by Mitchell in the Town Hall, as witnessed by 3 people.
o Chip gravel is the wrong material for building a pad as it will not compact. And it’s very expensive. Shale is the proper material for a pad, and the Town has local access to free shale just for the hauling.
o And regarding the pole barn engineered under Mitchell’s direction, the equipment bays are too narrow to accommodate the dump trucks it was built to house.
o Mitchell’s actions resulted in wasting THOUSANDS OF DOLLARS OF STREET MATERIAL.

• Question for the voters: Do we really need Jeryl Mitchell’s style representing the Town of Pocola?
o His racial slurs and harassment of previous town employees while previously on the Council resulted in 5 lawsuits and judgment against the Town because of his actions.
o He harassed a former city clerk into tears.
o He threatened a current sewer employee with bodily harm?
o He threatened a local citizen at a local business and invited him outside?
o He got into an altercation with a policeman in the Town parking lot, and then fired the officer.
o And during his current tenure on the Council, he assaulted another Trustee.

This ad is in the Southwest Times Record Saturday March 30th edition.

I would also like to inform the public that according to Jim Fienup, "Publisher of the Spiro Graphic" a retraction to Jerl Mitchell's campaign ad that was printed in the Spiro Graphic will be in their next issue, Wednesday April 3rd. Jim was at the Town meeting when this road was discussed.

How convenient of you to leave out some most interesting facts.

Didier did confront an employee - by cursing him, Jerl and the mayor. I believe the statement was "F!#$ Jerl and F!#$ Gaylon too!"

According to said employee - Didier chased him down E. Pryor and Oliver Streets. Flashing his lights and running up beside him to cause him to pull over nearly running into the deep ditch.

Again - he was cursed by Didier.

By the way the only person who can retract a statement is the person making the statement. If someone disagrees with what is said that is said they can offer a "rebuttal" to what has been said.

That is what I have offered; a rebuttal to untrue or almost true statement - thus by definition makes the above statements in your story a LIE! Partial truth is 100% lies.

Amazing what a little truth will reveal - huh?

JAQ: Thanks. It will be interesting to see what Spiro Graphic prints. A paid ad is a paid ad is a paid ad....they print whatever you pay them to.

The "editor/publisher" can do their own "editorializing" but I would not think they can comment on what a person pays for.

I read what was in the Spiro Graphic, if you want an eyeopener of half truths and innuendos start there.

& IF what you're saying happened actually did happen (the incident on E. Pryor) then why wasn't a police report filled out? Spare me any response abt GF or JM either one not wanting to file, I just doubt it ever happened.

SN: I suppose you'd know abt a paid ad since you already posted on Topix you were going to do that.

You must truly be a "political hack" to be buying newsprint space for a load of BS. Is that how the game works? Does one have to pay for and do the dirty work for others in order to be able to hang out at City Hall?

Lesson #1: This is how it works...at politics time you have to pay to have printed any specific info. I had something I wanted to say to the voters so I did so. BS?? I guess that would be in the eye of the beholder. I've certainly seen way way lots more money spent this campaign than I ever thought about spending in order to spread what I consider BS....so what's the difference?
I'm not sure what a political hack is but if it has to do with someone trying to educate the voters and get them to stop drinking the koolaid being poured around & check the facts before they vote then I guess I must be one. Good for me!!
Oh by the way, just in case you missed it, I have a letter in SW Times today. Why don't you post it on here for me?

Just on the off chance you actually don't know what a political hack is, here's what the free dictionary online defines it as :

Noun - 1. political hack - a politician who belongs to a small clique that controls a political party for private rather than public ends -- and that does seem to nail it :)

I saw your letter to the editor of the SWTR, it was boring, same old same old BS - but if you want it posted on Topix you certainly have the ability to post it.

Just a question: I have not lied about anything in my post. As I have stated, there will be a retraction to Jerl Mitchell's statements in Spiro Graphic this Wednesday.

I was not there when Don and the street department employee had their discussion. I can't say what was said.

I will say this again since you don't seem to understand what I have said. Jim Fineup will be making a retraction to the statements concerning the road you have mentioned.

No lies in anything I have said.

Sharon Nugent is the most jealous person I have seen in awhile. Very much a hypocrite. She wants to see a positive campaign but then out of the other side of her mouth she ridicules the positive ads that came out. How can you sit there and say that Jerl Mitchell fixed 20 streets?

Again, you don't ever get the facts!!! Just Jewell and Gaylon's.

Once again & for the last time for awhile 'cause I'm tired of same old same old baloney: I have no ulterior motives except to educate people. If I say "I know" when I post then I can prove each & every statement I have made on here. If you see Just my Opinion...that's what is.

I don't know how this election will go like I THINK IT SHOULD but certainly hope folks are smart enough to see the big picture. If not I'll bet the world will keep on going on as usual.....but IN MY OPINION Pocola will be worse off. Please note: I SAID IN MY OPINION & the last I heard this was a public forum with everyone having a right to post.

SN: We have all been hoping for a long time that you would get tired of typing your opinion and thinking peope really care what you have to say. We all know that you are friends with GF and JC and now again JM, so we know you have a motive. JM had you in tears alot when you were clerk and he was on city council. You of all people know the trouble in got the town in with his mouth and lawsuits but yet you are on here leading people to believe that the only city council member in the history of Pocola to have 5 lawsuits at one time and have all 5 of those people paid a settlement is the best option for Pocola!!!! Really??? Is that what you want people to believe? Well, if the election goes the way you want it to, which I am sure guarantees you a spot somewhere in City Hall, you can bet that it won't be long before the Town will be in another lawsuit over racial slurs or sexual harrassment, or discrimination of some sort because of JM. At that point, I would venture to say that the insurance company covering the Town for such things would say "see ya", we are not about to continue to cover the Town because its citizens are not smart enough not to vote in a man who has cost this town $$$$$ in lawsuits!!!
