She probably had someone come and drive the car for her. They can't arrest you for DWI if you refuse the test (unless it involves a MVA), however you do lose your license on the spot. She probably did go home afterwards.

There is NO WAY that she would have been pulled over by the troopers for going 100 mhp and drunk driving and not have to get out of her car. That's silly, just plain silly.
If she refused the Breathalyzer they would have took her for a blood test. They would have also made her do a road side sobriety test.
And they can and did arrest her, it was in the news, if she was arrested she would have been taken to a police department for finger printing and mug shots. And she could have even been arrested for driving over 100 mph.

From news10: " When troopers stopped the vehicle, they said they could smell a strong odor of alcohol and the driver, Darcie Tronolone, had slurred, mumbled speech and bloodshot eyes. When police asked her to step out of the vehicle to perform field sobriety tests, they say she refused.

Tronolone is charged with DWI and governmental obstruction. She is due in Penfield Town Court in December to answer to the charges."

It reads charges only, no arrest. You can't be arrested for dwi if you don't cooperate with the tests. You will however, lose your license for a year, and be ineligible for a conditional license.

To me, this is a clear indication that she has been through this before. Yup. Mandatory year with no conditional. Period. Even Fiandach can't get her outta that one. Those laws are from the DMV. No judge can overturn that. And no more DDP program...so she won't be driving (well not legally anyway) for a year.

Ok...

The law says the officer can still charge you with DWI based on their observations. Look it up.

Officers are trained to observe bevavior associated with inebriation. Look it up.

Refusal to take a breath test is given as consciousness of guilt evidence. Look it up.

Of you ate charged with DWI, you are arrested and booked. Look it up.

Again, the lack of common sense is an indictment of the parents and education system on this state...
