Man sentenced up to 90 years in prison for 40 home break-ins

He terrorized local neighborhoods by breaking into 40 homes in the city, Brighton and East Rochester and today Judge Richard Keenan ruled that Jesse James Barnes was a persistent violent offender and sentenced him to up to 90 years in prison.

And they give Greece Police Officer Joseph a year for being on cocaine, hit and run, leaving the accident, speeding and drunk. The law is made for some not all. This man should have got 5 yeas not 90.

He was sentenced as a persistent violent offender. This means he has at least 3 violent felony convictions. He probably did get 5 years the first or second time.

90 years?come on now that extreme.I seen where murderers get lighter sentces than that.A tv,dvd player is alot less valueble than someone's life.

They are mad that he was out in the suburbs doing them dirty and they couldn't catch him so it time to give him a little ruff justice.Sad

It said he was a "persistent violent offender".

Are they counting doing a high speed chase as Violent, and if so where does the "persistent" part come in??

You're right - it didn't say that in THIS article. However, it did in previous stories that date back to his date of arrest. Do us all a favor and don't broadcast your undereducated opinion.

To answer your question, yes, a burglary, whether or not someone is home is a "violent offense". If you read the small print in the law, the requirement to qualify as a "violent crime" is where there is a "potential" for violence against another person. If you enter a home, then the law believes you have taken the risk of committing violence against someone who maybe in that home.

Anybody who has the criminal history that qualifies them as a persistent violent offender, more than likely has an extremely lengthy criminal history. You can word it any way you like. Persistent, means that he has multiple felony convictions. He's a career criminal.

First, Mr. Barnes did 8 years in state prison between 1997-2005. He was subsequently released, and was arrested again a short time later in which he served another 3 years in state prison. He was released last July of 2008. Yes, he is a "persistent violent offender" and deserves his sentence.

I think that j.j. is very pleased with the sentence. He obviously had no plans on ever working an honest job in his lifetime, so he was looking for another option.. Three hot, and a cot, all free for the next ninety years, and no work involved. Sign me up, says j.j.
