"Mayor Lovely Warren's choice for development services director in the city's Department of Neighborhood and Business Development was charged with driving while intoxicated following a crash on Culver Road in July and later pleaded guilty to a diminished charge but did not tell Warren during the job's interview process.

Spencer Ash, 39, who was a lawyer for the city when the charges were filed, was recently named to the $109,325 post essentially the number two position in that department by Warren.

Warren's appointment came after Ash pleaded guilty Sept. 30 to driving while ability impaired, a violation. He was sentenced to a one-year conditional discharge, his license was suspended for 90 days and he was fined $300, according to a Certificate of Conviction/Disposition from City Court.

Warren said she first heard of the accident and charge when a reporter asked her about them Thursday.

Should Ash have revealed the charges and conviction to her during the interview and selection process?

"Absolutely, absolutely, absolutely," Warren said.

"We want to keep our people safe, we want to make sure that people obey the law, so this is something that I need to talk to him about and something that I'm pretty sure his supervisor will want to discuss with him, as well," Warren said. "I need to talk to him about it. He was a city employee previously and I just moved him over and promoted him because he was dealing with the legal side of a lot of the projects."

Ash did not return calls seeking comment Thursday.

Court papers indicate Ash was irate following the crash, which occurred about 2:25 a.m. July 6 on Culver Road near Interstate 490.

Rochester Police Officer Albert Weech said in court papers that Ash "was irate and kept yelling about the damage to his vehicle," a 2009 Mercedes.

"The defendant state that he was going south on Culver Road and a car turned in front of him causing the collision," according to the paperwork. "I attempted to calm the defendant down and explained to him that we would take care of his car shortly."

It was during that conversation Weech said he noticed a strong smell of alcohol on Ash's breath. A breath test administered by officers showed Ash had a blood alcohol level of .14. The legal limit for DWI is .08.

Court papers indicate Ash had slurred speech and watery, bloodshot eyes and swayed as he stood talking to officers. He also failed several other roadside sobriety tests.

District Attorney Sandra Doorley said it's "not completely out of the ordinary" to reduce a misdemeanor driving while intoxicated charge to a driving while ability impaired violation.

"We have a general driving while intoxicated policy but as in every case, we have to consider all of the circumstances surrounding the events, the individual and ultimately the interest of justice," Doorley said. "Here, a review of all those factors lead to the conclusion that an impaired was appropriate."

The driver of the other vehicle was also charged with driving while intoxicated, according to court papers.

Warren did not say whether Ash would remain employed, but others public officials have lost their jobs over drunk driving charges in the past.

Two years ago this week, Susan Walsh resigned from her job as director of Greater Rochester International Airport Director after being charged with misdemeanor driving while intoxicated in East Rochester.

Walsh, who was driving a county-owned vehicle when the arrest occurred in December 2011, was sentenced to 100 hours of community service and had to pay a fine and surcharge of $750 and $400, respectively.

Officers said she failed multiple sobriety tests and asked the officer to "help" her with her predicament."

How about running a criminal background check before you appoint someone? Geeee....POOR JUDGMENT MUCH?!? Annnd... I thought according to Crotchety/Pinocchio that only whites drive drunk! Bwahaha!

Just a thought here it has to be VERY tough to find a minority candidate with the proper background i.e. a advanced degree in public administration that has a lily white background .... I am sure that is a small limited pool of applicants in town.

Doctors must disclose DWI or drug related offenses during the credentialing process (once every two years), or risk losing their NYS medical license for non-disclosure. Many employers, prior to hiring a candidate, will have an outside company do a simple criminal background investigation - which would expose a DWI conviction.

She should immediately rescind the offer for not disclosing an important material fact. It would also send a message that she will not tolerate DWI and criminal non-disclosure in her administration.

If he had disclosed the conviction during the interviewing process, I would say give him a break. However, he blindsided his new boss, and made her look incompetent. Flush him.

This is her first real test. I say can his arse. He blindsided her and left her open to ridicule. I truly can't believe that she' would be so ditzy as to appoint someone? Without a criminal background check. How embarrassing. Walsh stepped down as Director of airport. Let's see if this dunce will do the same. Any betters out there? I say he will NOT! She needs to fire him pronto!

There are a few problems, 1st she should have "vetted" him and anyone else she appoints. 2nd, I wouldn't make any bets that she didn't know beforehand and thought that no one would find out like Obama does all of the time. 3rd, it is only her third day in office and she is sounding like Obama when she has to say that she didn't know about it until someone from the media asked her a question. 4th, how many more people has she or is about to put in other positions without "vetting" them? It seems that the city will be going the way of Washington sooner than we thought and that "ain't" good people. Hang on, it is going to be a real interesting ride and I doubt it is going to a good one.

This guy got his DWI while working for Richards. Should he have been fired by Richards? Just for the record, his background check was done when he was initially hired by Richards/the Government. That was prior to his offense. Lovely basically gave him a promotion. Government employees don't go through another background check for a promotion.

She should vet and drug test new employees, using the same procedure businesses use. And check resumes for inflated claims, like local businesses do. Verify education. Get professional references from individuals the person has worked for, not their relatives or pastors.

Run the City of Rochester like a real business, because, ah, it is.

If she wants to legitimize her administration, she must ask for his resignation... with hesitation. This is non-negotiable.

However, when you DON'T look for upstanding individuals and WANT the THUGS that you
KNOW, well. you have to just try and squeak them in so nobody notices.

Just the Facts-The story here is that he neglected to be HONEST on his employment documents. Regardless of who he was hired by or worked under when this happened he LIED now. This DWI may or may not have been a issue with him keeping his job under Richards. The fact is he omitted this now...gotta play by the rules. Life can be a bitch.

ALL upgrades for military and security and defense require NEW background, security, sometimes mental checks and definitely drug testing.
try getting a job at Martin Marrietta, Lockheed or RF Harris running that BS juice outta your piehole...
She needs to dump the Dude, apologize in public that being new, she thought all the bases were covered; but, that she is now INCHARGE and checking out EVERYONE.
Or, the alternative is that she loses whatever legitimacy that she was starting to strive for...

You sound like the typical democrat always whining that it was the other guy's fault, surprised you didn't blame Bush. He was convicted on 9/30/2013 and the election was in November so how much time did Richards have after he found out to fire him, if he ever did find out? How about explaining that to us. No matter what you think every new mayor, governor and president should have every one of their staff vetted because as Obama loves to say, the buck stops with him/her.

You are 100% correct Kat. When I worked for the government I was vetted at least twice a year and drug tested at least 6 times a year.

Wait a minute here , the guy was a city employee and yes his DWI status had to be known buy some at city hall, to throw the guy out for 1 mistake is wrong.

Those who are trying to compare him to Susan Walsh there is a huge difference and that is she was driving a county vehicle at the time of her DWI and thus that made the county liable for any accidents and that is a HUGE difference.

This guy was driving his own car so it is not apples and oranges after all.

At this point he could resign and save face for Lovely but IMO he really does not have to.
