Update: South Hadley Man Arrested on Drug Charges Released on Bail

The man accused of running a South Hadley marijuana growing program is out on bail on $1,000. Stephen Opalenik was arraigned Friday morning in Eastern Hampshire District Court. Full Story

As of December 9, 2009 the state conceded to sufficient facts and the appeals court agreed and found judgement for Steve Opalenik. He is free from all charges. He Plans to set the record straight. He's hired a High profile attorney from Boston. Weeha!!!!!

Update: As of Nov. 2009 the Commonwealth of Mass conceded to non-existent evidence that procured a search warrant that was admittedly found to be invalid. On Dec. 17,2009 the Mass Court of Appeals signed on and a three judge panel agreed that the search warrant was so fatally flawed it should not have been issued. From the facts of the case it can be inferred that a conspiracy had taken place to fabricate evidence to acquire what appeared to look to like a legitimate search warrant but was not. With the States own admittance of no probable cause of stolen property from the house in Hadley, which generated the initial warrant, along with other substantial evidence can only suggest that there was a conspiratorial act by officers and a family from Hadley whose great uncle was the first constable of Hadley to get into the Opalenik home on March 13, 2008. There is also evidence of facts that show that the prosecution was malicious in keeping testimonial facts of the case from the Grand Jury for the indictment of Mr. Opalenik. Subsequently the prosecutor tried to subvert the facts by inserting false statements in order to persuade the Judge in her desperate closing argument during the hearing on motion to suppress. The motions to suppress were denied and Mr. Opalenik was subjected to a trial where he was convicted. In January 08 Mrs. Opalenik issued lawsuit to both towns under conspiratorial charges and other violations. Mr. Opalenik also presented his views to a local newspaper. It was shortly after that, that Mr. Opalenik was summoned to appear before a certain judge for what was suppose to be for an issue of indigence. As it turns out the first words from the judge was the issue about Mr. Opalenik speaking with the press. He was upset to the degree that he left the courtroom in a fit of rage, declaring, if I find any equity within the home of Mr. Opalenik I will hold him accountable. People need to know, who really needs to be held accountable in this situation. The prosecutor stated "not anyone can pick and choose which laws he is going to obey and which ones he is not". In light of all the issues, Mr. Opalenik is a minuscule violation compared to the lawless and sinful nature as demonstrated by the supposed up holders of Mr. Opaleniks constitutional rights. Good luck to Mr. Opalenik and may God grant him the continued power to battle against tyrants like these just as the founding fathers of this great country did. The means does not justify the ends, and if it shall, then anarchy will soon follow and the constitution will be of no effect for the moral protection against the immoralities of others. The Opaleniks have since submitted criminal charges against certain offenders which to date have not yet been prosecuted. They plan to issue more charges under laws pertinent to the Mass General laws and the U.S. Constitution.

UPDATE JUNE 1, 2013:EXTRA! EXTRA! READ ALL ABOUT IT! COPS LIED ABOUT THE SEARCH WARRANT. STEVE WAS ACCUSED OF STEALING CERTAIN ITEMS LISTED IN THE SEARCH WARRANT. SOMEBODY WENT INTO THE ABANDONED HOUSE AND TOOK PICTURES THAT SHOWS THE STUFF WAS NEVER TAKEN AND IS STILL THERE. THE TUDRYNS AND THE COPS SAID THAT STEVE AND HIS WIFE STRIPPED OUT ALL OF THE COPPER FROM THE ABANDONED HOUSE IN HADLEY. PHOTOS FROM MAY 31, 2013 SHOW THAT THE COPPER PIPE IS STILL IN THE CELLAR WITH NONE OF IT GONE. THE TUDRYNS AND THE COPS SAID THAT HE AND HIS WIFE ALSO TOOK SPECIFIC RECORD ALBUMS AND DISHES TO WHICH ARE STILL IN THE ABANDONED HOUSE. COPS LIED ON THE SEARCH WARRANT ABOUT STOLEN PROPERTY BY STEVE AND HIS WIFE. SO f--CK YOU ALL!
