Not that odd. It's a dumb-a/s/s story about a cop who did something really stupid. It's a waste of everyone's time and commenting further would just extend the stupidity and waste of our tax dollars.

It would have been smart to ask ahead of time.

Of course, it may have been asked, "What would I want if I were a pendulum?" The answer would likely be, "I want to swing; give me a push."

If this was intended to be a "hands-off" sculpture, a fence - or at the least a small sign - could have prevented the need to cite a visitor to our fine city.

Put up a pendulum and not expect people to push it? What a ticket trap. All that art on the mall now is really ugly and stupid, out of place. Get rid of it and stop harassing our tourists. Isn't there slightly more important crime on the to deal with down there?

One of my best friends Aaron van der Kerckhove is the artist who created this sculpture and I would venture to say it was created with kinetic abilities with the intent that it indeed swings two and fro. Why the city had it installed in a less accessible area that's now become ground for citing tickets puzzles me. Glad the guy got off from having to pay. Perhaps a more pragmatic approach to the installations should be taken.

I just heard that disorderly alcohol arrests and citations are freebees also. With 8-15 alcohol arrests per day we should be charging for the police efforts.

This is retarded even for Santa Cruz. You can't even lean up against a tree waiting for a movie to start without some dork telling you that you can't. Then there's that art across from the movie theatre. Designed looking like a place to sit and put out there where everyone is going to try it. Me thinks people need college classes to clue them in on something called human nature.

Apparently, instead of having "speed traps," Santa Cruz has "art traps" as a source of revenue.

Why put kinetic sculptures out where people can touch them when people aren't supposed to touch them?

Leave pendulum pushers alone. Arrest the OTHER kind of pushers downtown. No brainer. About as bad as ticketing dogs off leash as they walk by the drug dealers on West Cliff and in Lighthouse Field.

Ask who ahead of time? I have lived here forever, and even I have given it a push before. I had no idea it was somehow not allowed.

I for one am sorry that this pusher didn't get what was coming to him. We need to get these people off the street. Spokane can have him and his wife. Sleeping in his van, sure. That guy and his wife are on Pacific avenue every day pushing pendulum to every school child walking by. He should be locked up and throw away the key. He's probably not from Spokane anyway, probably an illegal from Canada. Remember it's for the children!

My theory on downtown is that the local powers that be enact all sorts of silly rules and regulations because they're too politically correct to give the police authority to hassle bums for loitering.

What the heck - are you serious? Why doesn't someone put a "don't touch" sign up? The sculpture looks interactive - as though one should go ahead and get the pendulum going (if it isn't going already). I have seen small children get in there and push it as well as adults with no intent to harm but to simply get the thing going. Does the artist really want it to just sit there motionless???
