Defense questions role of ailments in child's death

Nikolas Chavez Nikolas Chavez NEW BRUNSWICK - Assistant Middlesex County Prosecutor Seana Pappas made a chart of who 3-year-old Nikolas Chavez was with before his death in 2005. Neurologist Keith Meloff evaluated the child for developmental delays and possible seizures on Friday, Nov. 25, 2005. The boy's biological father, Nick Chavez, and his relatives saw the child during the weekend of Nov. 25-27. Nicole Rosol, Nikolas' mother, allowed her mother, grandmother, sister and brother to watch the baby at different times on Nov. 28 and Nov. 29. She then asked her fiancÚ, Robert Knutsen, to watch Nikolas on the morning of Nov. 30, the day the child died, because she had to leave for court.

Based on the testimony of lead Investigator Mark Clements of the Middlesex County Prosecutor's Office Homicide Unit, Pappas crossed out each of the potential suspects one by one, except for Knutsen. Clements said that while he was in the autopsy room on the morning of Dec. 1, he found out that the injuries the child sustained were a broken back and internal bleeding, and that the injuries occurred a half-hour to an hour prior to the boy's cardiac arrest. This led to the case being ruled a homicide and a further investigation began, with Knutsen named the one and only suspect.

Knutsen, on the other hand, told police that the child was involved in seizure-like activity when the man walked into the baby's room, just a few hours after he had originally checked on him. Vicki Craig, the pediatric critical care nurse who attended to Nikolas in the intensive care unit of Robert Wood Johnson University Hospital about an hour after he was admitted to the emergency room, testified that the doctors cared for Nikolas as if he had a seizure because that is the information they were given.

She said that blood loss can in fact cause a seizure, but that a seizure does not cause blood loss, such as the 40 percent of Nikolas' blood found in his abdomen during the autopsy, as she had learned afterward. She said that shock occurs when 15 percent of the blood is lost, because an adequate amount of oxygen is not transported to the brain, which could then lead to cardiac arrest. Also, when Pappas asked her, "Could a child have a seizure so bad that he snaps his back in half," Craig promptly responded, "No."

In Knutsen's defense, attorney Robert Honecker mentioned that the child was being evaluated for developmental delays, bleeding disorders and possible seizures in the weeks leading up to his death. Honecker used the testimony of pediatrician Vijaya Radhakrishna, who said that between March and November 2005, Nikolas was brought in on 13 different occasions for various ailments. She evaluated his blood work, which showed there were "no bleeding problems," but she referred the child to Meloff because of his speech delay.

The defense was contending that if the boy was suffering from a physical affliction prior to his death, due to an impending development of autism, which was observed by Sandra Sersen of the Eden Institute in Princeton, an establishment focused on early intervention programs for children with learning disabilities, he may not have been able to convey discomfort to the person who was caring for him, thereby counteracting several statements made by the prosecution that the boy never displayed any signs of pain.

Meloff also observed on Nov. 25 that Nikolas had some staring spells, and he wanted an electroencephalogram (EEG) done to make sure the boy was not suffering from little seizures. Honecker said that Nikolas had a family history of autism, bipolar disorder and Asperger's syndrome on both sides of his family, and could have been exhibiting precursory signs of a disease.

There were two trials there will not be another no matter what he tells you people ..Let that poor child rest in peace ..IMO

I think if Mr. Chavez comes clean and tells the truth about himself instead of becoming defense about the topix we can get a better picture of the type of person he is. I am happy that he is getting the support he needs and trying to change the law, but don't lie to people who are there to support you. I have a feeling he thrives all the attention he gets.

I have followed this post for a while and have yet to post. Well, I decided after reading the recent events it is time.
First of all, This child like bickering back and forth is utterly ridiculous.
This is pertaining to a Child's murder, Everyone should show some respect for the child who was lost!
A parent lost their child to murder, period. No one can argue that, and no parent should ever go through that. He wants to whomever is responsible to suffer the same way his son did, wouldn't you want the same for your child??
There is freedom of speech, so each of you can freely say what you would like. My question is how is what your saying serving you? Do you have a life of your own to focus on, instead of playing he said she said? Anything positive to contribute to society?
Maybe Nick has his faults, we all do!! I hope you are perfect to be passing judgement on others so quickly. I certainly am not.

How about focusing on Childs life who was taken soon from this earth?

Yes it is enough ,he needs to stop this ,the case is over it's done with .Please read the papers regarding t what happened ,this is not a cold case as he has told people ..it was in court not once but twice and he was not convicted on any murder ..why because there was no murder...Please read the papers ..IMO

The mother testified not Nickie,it was in the paper that she did nothing about him being called to the stand ..wonder why that was ,since he knew so much about the child and was always there for him .

Why does it not say a TEACHER ...just wondering::: Is he still running fundraisers and where is this foundation ...and what is it for ..Just asking a question ..

On the morning of Nov. 30, Nikolas was asleep when Rosol had to leave in the morning for family court.

What was she in court for that day ....not smelling very good here...

What is the name of his foundation or charity? Can I make a donation? Is there a tax ID to write off at the end of the year? Can Mr. Chavez or someone here post the link. I am happy to donate towards this cause, but I would also like to see how my money is spend and what it's used for...
