Court overturns Carroll Twp. man's window tint citation

I remember when I was young I was taught the policeman was my friend. How things change. Now it seems all they want to do is harass and nitpick. Aren't there enough real crimes they could be concentrating on? Did it ever occur to them that tinted windows could also protect the driver and passengers from potential carjackers? I guess he should trade in his tinted windows and start packing a gun.

Thats a new one! Never heard anyone say they got their windows tinted to avoid car jackings! I guess that tint is really alot stronger now and can stop bullits!

If you havn't read the ACTUAL court decision....it was a decision with 2 judgements.
It stated that the PA Vehicle Code section of 4524 can ONLY be used when the tint is so dark you actually can't see in the car. This guy had tint but it didn't meet that standard and the ticket was dismissed.
It also states that the police CAN and SHOULD use PA Vehicle Code section 4107 which references the 70% VLT regulation which is FULLY enforceable in PA.
This is what the police will now use on citations and nobody can point to this Superior Court case and claim it has precedence over a 4107 citation. The man appealed a 4524 case ( and won). If someone disagrees with the 4107 version , they will have to go through the courts and ATTEMPT to try to get what this guy got BUT the justices already ruled that 4107 IS THE CORRECT SECTION TO USE.
Be careful before you spend the money on tint that can and will STILL get you in trouble.

How unsafe is window tint ? If at the present time there our only 2 States that does not alow tint on back side windows of cars. PA an New York An 5 states that don't allow tint on front doors, an pa is the only state that does not allow tint on the rear window of a car. Do you think PA is behind the times ? Hold on PA can't even pass a budget!!!!! What people don't under stand is dark tint is illeagle every where but there is nothing wrong with liter films, Once you under stand film you will never do with out it.

Unless and until our state legislators and PennDot change 4107 , the law stands. Regardless of what other states allow or dont allow. Some states allow 75 mph on their highways , we don't. Some states still require motorcycle helmets, we don't. Some states madate seatbelts as a PRIMARY offense , we don't.
So the " but other states do...." is getting old. If you like what other states have done than get our laws changed or MOVE to the other state.
