This is extremely sad & heartbraking on all counts. The poor child that was killed, the almost a baby that killed him & the young woman (no age given in article) that was in charge. Horrible, horrible incident & no good outcome for anyone.

This is what I was talking about when I said people making comments without knowing what happened. Dottie kept the kids down stairs. Babies that cried were kept in the back room down stairs and then Dottie would go upstaris with her Grandchildren and leave the rest of the children downstairs. This all came out during the investigation. Regardless as far as Dotties culpability, she was not the one that was repeatedly hitting an infant. That falls on the 10 year old girl.
What if it was my child? Well first off, I have spent a lot of time teaching my children since they were infants that you must be very gentle with babies. This girl was attacking Heath. If my daughter was that evil where she was attacking defenseless infants, I would be horrifed and couldn't even look at her the same. I would lie in bed everynight not being able to sleep wondering where I went wrong, and how I raise such a monster. I would have to go through the justice system just like this girl's family is going to have to. From there, I would do everything in my power to get her the help she needs. This girl obviously has bigger issues that is going to require years of counseling. No one wakes up one morning and decides that they want to beat on an infant. This is a disturbing learned behavior from somewhere and I don't know if this girl is every going to be right after this. I only hope and pray that she will. I understand your compassion for a child, but she still has to be held accountable or it will only happen again.
you are from biglerville and you can tell us what was happening in ship, are you going from the testimony or are you gifted.

TBI is an injury to the brain or skull caused by an external force such as a strike or impact. Unlike other injuries such as broken legs or cut fingers that can heal, brain injuries are often permanent and disabling.
Unfortunately, there are other, natural causes, ie. seizures. For all the power it has, the human brain is a very delicate organ.

I would agree 100% that this 10 year old child does know the differnece between what is right and wrong. But, there is no way that this child could have understood what implications and results of what her actions would have led to. At this age, when a child gets in trouble, there is time out, spanking, or removal of something that the child favors.....not murder charges...they don't even know what that means. How would she know the difference?
Charge the caretaker with all responsibility......especially since she took no action in helping.
When I was 10 I was taking care of my baby brothers and wouldn't dream of hurting them, but I do not believe this girl intentionally harmed the baby. The babysitter should be held responsible and the girl should get counseling because she is going to have to live with what she did for the rest of her life and is still a child. It is going to adversely affect her and if we don't want another woman in prison she needs to get help now! I agree with you!

The 10 year child should be charged any babysitter could walk away within a min and this could happen i work at the hospital lets not be stupid. For every mother out there that thinks they are mother of the year are pretty stupid there is not one mother grandmother babysitter or any adult that knows what i a child is doing every seconds of the day. If you think you do you are the biggest lier around. A 10 year old gril should not have to have supervisor all hours of the day they need to grow up at some point or time. This babysitter i fell bad for because all the court is hearing is the ryders side of the family nothing else tha has been investigated. The Ryder family are very gredding people for feeling this way. i also like how all you nosey people run your mouth and not even know the whole stiuation. I dont know that stituation but by far would a i make judgements like all you nasty people
you sound like an idiot!! tobegin with what on earth are gredding people? What does "I fell bad" even mean? and by te way I have a 3 year old gril that sits on mt patio unsupervised constantly. and noone knows the situation or stituation, and why do you always put a and i together? I sincerely hope you never lose a child in a situation like this, but you have no friggin right judging the "gredding Ryders". Soundslike you are a friend of the so-called babysitter. Ifthis Biotch refused to call 911 she needs the book thrown at her!!!!!!!!

A man shoots his wife from 5 feet claiming mis-identification. Changes his story about the condition of his relationship. Gets secret hearings and deals ONLY GETS MANSLAUGHTER. AND HE BRINGS THIRD DEGREE MURDER AGAINST A 10 YEAR OLD.
I don't know all the facts but I suspect thier was no INTENT to kill...probably more like a temper tantrum over the TV or video game. But when that dude pulled the trigger there was certainly intent!
I am a republican but will not be voting for this goof ball. We can only hope he has a challenger...god help us all!

The babysitter did call the mother and she said she was 2 mins away. Never mentioned calling 911 herself. And the mother was also at the house 20 mins before she called 911 the babysitter also didnt refuse to call 911 once again that is other lie that came from the ryders side of the family. Not all information came out in court and by far the baby sitter passed everything at the police station this was the ryder family puching for more even know they knew that the 10 year old committed the crime. I think its funny that the baby mother didnt call 911 sooner but thats were a nurse get you you think she would of been a little smarter than that

According to the testimony of the witnesses, that 10 year old was abusing that baby. She had hit Heath on several occasions for no reason all all other than to be mean. I've seen several posts on this story over the past several months. Mostly like your's not wanting to hold this child or the baby sitter responsible for this infants death. Most of the comments are from people that have no idea of what happened. This 10 year old is evil and knew what she was doing and afterwards tried to cover it up. The baby sitter failed not only in her job, but also as a human being. While Heath's mother was giving CPR trying to save his life, the Baby sitter still refused to call 911. The doctors and the coroner both testified that had the baby sitter called 911 immediately, little Heath would still be alive. All of you who want to criticize the court and the prosecuter for this case, I ask you to think about how you would feel knowing that the person you trusted with your child aloowed this to happen then did nothing. Imagine giving CPR to your baby and begging for her to call 911, only for her to refuse. Imagine your other children sitting in the same classroom with the girl who murdered their brother. Would you still be on your high horse arguing that this prosecution is wrong. Wise up poeple! this is the problem in our country today, "Everyone" has an excuse for not being held accountable. Wise UP!!!

Is the child a fifth-grader? Most kids that age know when they are inflicting pain that can cause injury. Parents are well aware that older kids are not to be left alone with babies. They require fragile handling and some children aren't good at that. In fact, some fathers don't even like being left alone with infants or kids who can't articulate their needs. It's a fact. The 4th/5th grader had to know the level of violence could be deadly. Unless the case moves to adult court, we will never know what really happened and why. My condolences are for the family of the little boy. He will never be forgotten. And I pray that nothing like this ever happens, again. The pain and suffering are too much to bare.

Lexie Niel Is to young to get the death penalty, But that is what she should get. That sounds pretty dramatic but that is what she did SHE KILLED a baby.So what do you do with a 10 year old KILLER. Lock her up for the rest of her life???How can she live with herself, knowing she killed an innocent baby. I guess we will see what happens, I just hope she gets what she deserves.

I agree with you!
If I accidentally kill someone because I think their Topix post is foolish, I will (most assuredly) get prison time. We live in a society of crime and punishment. We send people to lockdown as punishment. Any counseling comes as a cherry on top of a pile of ****.

I think at 9yrs of age this girl was way too young to baby sit the parents of the baby should of known that and the parents of the 9yr old should of known that too.
Before you post another stupid comment, READ. The nine year old girl was NOT the babysitter, derp.
