Regardless if it was abandoned or not, entering a property with out permission is illegal. Period.

No im not saying what they did was right but what if there was a dead body in there or a drug stash in there they the police would have never known im saying they blew this whole thing way out of proportion.

They broke into someones property. They should be and will be punished accordingly. How is that blowing it out of proportion? They are not charged with murder are they? They are charged with a crime they commited, and their punishment will be according to the regulations set by the legal system and precidents that are similar to their situation. So I ask again how is it out of porportion?

What is anybody going to do with a burned down house. I doubt in this market anybody is going to buy the house and fix it up. And what if there was a dead body who else would know.

It does not matter if there was a drug stash or a dead body. The 4 teens did not go in there because of those reasons. They went in there to do some sort of mischief. If there was a drug stash or dead body it was the property owners responsibility.

You would not like it if your parents went into your room, and looked around because they thought drugs where in there, right?

It is not your business or the teen's business what someone is going to do with their property, if it is going to sell or not, fix it up or not.

Clearly these teens broke the law. You are also clearly showing your own lack of maturity, I agree with "My Experience" and saying more than likly you are a teen yourself. So i know you will never agree with me or the law. But you have yet to show how this has been blown out of proportion yet, especially with in the legal system.

Trespass The Trespass element of the offense signifies that it must occur without the consent of the victim. If the thief gains entry by misrepresenting his or her identity, the element of trespass is satisfied, as there is no consent to entry.

Breaking Breaking consists of creating an opening for entry into the building. It can be accomplished by removing an object that is blocking an entry or by blasting open a wall. The use of force is not required. The breaking element is satisfied if access is obtained by opening a closed door or window, regardless of whether these are locked.

Entry In the course of a burglary, entry is the act that follows the breaking. Literally, it occurs when there is physical intrusion into another's dwelling or building by any part of the intruder's body. A momentary intrusion will suffice. When a thief kicks open a window to gain access to a dwelling, the momentary insertion of the foot constitutes an entry.

Dwelling At common law, the entry had to be into the dwelling of another to constitute the offense. A dwelling was defined as a house or mansion where one normally sleeps, although it was not necessary that it be occupied at the time of entry. Structures and premises immediately surrounding the dwelling, such as an outhouse or a yard, were also protected since they were considered part of the dwelling.

This is what he is charged with along with MAL DEST PROP/VALU -$500

Burglary in the Fourth Degree
• A person may not break and enter the dwelling of another.
• A person may not break and enter the storehouse of another.
• A person, with the intent to commit theft, may not be in or on the dwelling or
storehouse of another, or a yard, garden, or other area belonging to the dwelling or
storehouse of another. A person convicted of theft may not also be convicted of
this offense based on the act establishing the theft offense.
• A person may not possess a burglar’s tool with the intent to use or allow the use of
the burglar’s tool in the commission of a burglary.
A violator is guilty of a felony and subject to maximum imprisonment for three years.

I hope this clears it up for all of you little one's out there, that think I am gay, or I blow. Either way calling me names and saying nasty things does not help your friend. He broke the law, I am sorry he did, but no one can help him now. Maybe you should have been better friends and stopped him.
