"Israel’s recent use of white phosphorus bombs in densely populated areas of Gaza violated the rules of war, according to report issued by a leading human rights organization last week. The 71-pages-long Human Rights Watch (HRW) report, entitled “Rain of Fire: Israel’s Unlawful Use of White Phosphorous in Gaza,” states that even before the group’s researchers were able to enter Gaza, they had watched from adjacent perimeter areas in Israel as white phosphorus bombs exploded in the air over densely-packed residential areas in the Gaza Strip.

Israeli troops began using white phosphorus in Gaza after the ground phase of the military offensive started on 3 January, a week into the invasion of the Strip, and continued until the ceasefire two weeks later, according to HRW. The report notes that it was the first time that the Israeli military had ever used white phosphorus in the densely-populated coastal Strip, despite numerous previous ground incursions. The report also notes that Israel used white phosphorus twice in Lebanon, in 1982 and in 2006.

The Israeli military was well aware of the effects of white phosphorus and the extreme danger it poses to civilians, HRW says in the report. According to the group, if the Israeli army actually intended to use white phosphorus for its obscurant effect, it could only have done so lawfully in open areas, and not in downtown Gaza City, or downtown Beit Lahiya.

The legislation will serve as the implementing arm of the Prawer-Begin Plan, the government’s overarching policy framework for the Arab Bedouin community. If enacted into law and implemented, the plan would forcibly displace tens of thousands of Arab Bedouin citizens of Israel living in the unrecognized villages in the Naqab (Negev) desert in the south of Israel. It would dispossess the Bedouin of their property and historical rights to the land, destroy the social fabric of their communities, and condemn thousands of families to lives of poverty and chronic unemployment.

The representatives of Bedouin villages have repeatedly attempted to engage the government in a dialogue about the plan, but have been rebuffed. They assert that the law and the policy that it embodies are based on false and discriminatory views of the Bedouin as trespassers on their land. The Prawer-Begin Plan ignores the fact that most of the Bedouin villages have existed in their present locations since before the establishment of the state of Israel, or were created when the Israeli Military Government forcibly displaced the Arab-Bedouin to the Siyag region of the Naqab in the 1950s.

A just and feasible solution first and foremost requires recognition that the Bedouin residents of unrecognized villages are equal citizens with equal rights. The unrecognized villages must be recognized and planned according to fair planning standards, and the land ownership rights of the Bedouin must be formally acknowledged.

Critique and Analysis of the Prawer Plan:

The Prawer Plan legitimizes the displacement, dispossession, and eviction of tens of thousands of Arab Bedouin citizens of Israel.

The Prawer Plan does not recognize the right of the Arab Bedouin to ownership of their ancestral land, setting the maximum compensation at 50% of the land claimed is unacceptable

The Prawer Plan offers only monetary compensation for the land claimed by those Arab Bedouin citizens who were internally displaced from their ancestral land following the establishment of the state.

The Prawer Plan Law strips the court of its judicial review power to intervene or toprotect citizens from unfair state land and planning measures, thereby suspending therule of law, due process, and the constitutional rights of Arab Bedouin citizens.

The Prawer Plan Law establishes a legal framework to implement government policies that are valid only on the Arab Bedouin citizens and only in the area of the Naqab.

The unique involvement and wide discretion of the Prime Minister is unprecedented and unrestrained. The Arab Bedouin were not consulted and reject the Prawer Plan

then it’s a territory of Palestine…
We’re often treated to the completely false notion that the Palestinians could have had a state next to Israel “..if only they’d accepted UNGA Resolution 181..” or “if only they’d accepted some of the (so called)‘concessions’ Israel has made”.(offering to return the spare wheel of a stolen car in order to keep the rest, is far from a valid ‘concession’). Or “The Palestinians never miss an opportunity to miss an opportunity”? A notion usually voiced on the understanding that the Palestinians are to blame for their current situation. Unfortunately it is just another fallacy, based in ignorance or deliberate ignoring the laws surrounding the formation of states and the I/P issue in general. And, if one looks closely at the notion of a Jewish homeland in all of Palestine today, the dunce’s cap just might be on the other head.
According to the JCPA it is a pre-requisite for declaring sovereignty that the entity declaring must control all their territories at the time of their declaration. It is the reason the Jewish Peoples Council had to wait until the British Mandate ended May 14th 1948. It is the same reason Indonesia had to leave East Timor in order that they could declare sovereignty. It is the reason the Palestinian’s previous declaration was not accepted by the UN.
All or part of Palestine has been under the control of a succession of other entities since at least the Roman era. It’s citizens included Jewish folk who lived in the region.
Under the Mandate for Palestine it was under British control. When Jordan declared Sovereignty in 1946, what remained of Palestine, was still under the control of the British. It’s citizens including Jewish folk, were all Palestinians.
In the weeks preceding May 14th 1948, Plan Dalet was launched. This saw the Jewish Agency in control of territories slated for the new Arab State at by the end of the British Mandate. Jewish forces were not withdrawn from the territory slated for the Arab state when Israel Declared Sovereignty.(Israel has never annexed any of these territories) Israel has been in control of territories slated for the new Arab State since 00:01 May 15th 1948, making sure the Palestinians could not declare independent sovereignty.
At the end of the ’67 war we saw Israel in control of and illegally claiming even more Palestinian ‘territories occupied’. Israel now controls over 50% of the territories it agreed were not it’s own when it declared it’s Sovereign Boundaries.
There is no obligation for any entity to declare sovereignty or statehood. Even if the Palestinian had wanted to declare sovereignty, they could not have done so. There has only been ONE MINUTE in the entire history of Palestine, where there has not been another legal entity in control of some part of the territories known as Palestine. That was the minute between the end of the Mandate and the Declaration of the Establishment of the State of Israel coming into effect. However, at no time has it had full control of all it’s territories.
SO WHY IS ISRAEL STILL EXPANDING ONTO LAND THAT DOES NOT BELONG TO HER?

For there to be International recognition of an independent sovereign State, the boundaries of the sovereign state must be defined in order to know exactly the extent of the territory being claimed as sovereign. Israel’s boundaries were defined when the Jewish People’s Council accepted and declared sovereignty per UNGA res 181, in order to be recognized as an Independent Sovereign State. The Israeli Government confirmed it’s declared boundaries in statements to the UNSC on May 22nd 1948 and June 15th 1949

So why is it that Israel is taking more of the Palestinian land to this very day??
