Feds: 3 indicted in '09 home invasion death

Three people will be arraigned in federal court Friday on a grand jury indictment that charges them in the 2009 robbery and shooting death of a man in the basement of his Bohemia home, federal prosecutors said.
Rhamaad Spann, 30, of Brentwood, Elizabeth Baylock and John Moglia are charged with robbery conspiracy, attempted robbery, discharging a firearm during crimes of violence and causing the death of Steven Privitera through the use of a fireman, according to court papers.
The indictment said "the defendants did unlawfully kill Steven Privitera willfully, deliberately, maliciously and with premeditation ... during the perpetration and attempted perpetration of a robbery."

A spokesman for the U.S. attorney's office did not immediately have ages or places of residence for either Baylock or Moglia.
They are scheduled to be arraigned Friday in Central Islip.
Suffolk County police said after Privitera, 53, was shot and killed on Dec. 14, 2009, that two armed masked men went to his home on Sycamore Street to rob another person living there. The indictment said the three defendants conspired to rob a marijuana trafficker "whose identity is known to the grand jury."
The gunmen approached their victim, who was outside the home, shortly before 12:30 a.m. They demanded money and forced their target into the basement of the home, police said.
Privitera responded to the commotion and was shot after a struggle, police said.
Citing an ongoing investigation, police said at the time they would not disclose the identity of the person the masked men sought or of another resident who was then at the home.
"He interceded and died for his efforts," Det. Lt. Jack Fitzpatrick told Newsday in a 2009 report of Privitera's death.
