It is interesting to imagine the good senator saying as he is sworn in that he intends to stand with the Will of the People instead of the State Constitution. I suspect that the word Constitution is an important part of the oath of office. As is the notion that he is a State Senator whose salary and perks are paid by all citizens. Can he say honestly that he did not have his fingers crossed when he swore as required in order to take his seat in the State Senate?
