Hello,

I need to report a grievous issue in regards to a business that is currently violating the federal minimum wage law and how it is applied to tipped employees. This business is Earl G. Dumplins located in Scottsville, KY. 42164.

Every week when a servers tips and minimum server wage are added together if the total does not equal 7.25 the employer forces the employee to pay the difference back to the employer. The hang up a sign over the time clock detailing just how much the employee owes and makes them pay out of pocket. Or if they make over 7.25 including their tips the employer takes that amount as well.

This employer mainly hires individuals who reside in the local half-way house and are too afraid of losing their jobs to say anything about it. They claim that it is legal for them to do this and I don't believe it. Are they correct? Is this the law as it is written?

Don't let em have your tips. Feck them. If they say anything to you, tell them they can fire you. See how they react. If they fire you, find another minimum wage job literally anywhere.

What the employer is doing is illegal.. Please read the info in the link from the US Department of Labor. Hope this helps. The employer can take a "tip credit" however if the employee's wages combined with the tips does not equal federal min wage, the employer must make up the difference. Also, the tips are the property of the employee, except in a tip sharing or pooling situation.

After reading this post...My wife and I will NEVER go to Earl G's again. We were good for 2 visits a week. Where I am from the working prevailing minimum wage is $8.oo an hour. Yes, for waiters too. Google Kentucky Labor Board in Frankfort. There will be a phone number for you to call. Explain your situation...they will help you. Also document every penny they take or you earn.

when i worked at sonic along time ago they took .25 of every dollar in tips you made i made min wage plus tips. never understood why . but it could be leagal

Why would anyone work there? Minimum wage jobs are a dime a dozen.

Also, if you work for minimum wage, please don't let some prick manager tell you what to do. If they tell you to do something and you don't want to do it, tell em to fire you if they don't like it!

They're asking you to claim all your tips. By not claiming all your tips you are breaking the law not them Good try

They are supposed to make the difference up if you don't make minimum wage. You aren't supposed to pay it out of your own pocket.
