Immigration fight splits family

In a bittersweet moment that put a different face on the issue of families split by deportation, Tony Wasilewski raised his right hand Tuesday in the Dirksen Federal Courthouse and became an American citizen. Full Story

Nice try Mr. Olivio. We as a country have a right to secure our borders and decide who we allow in. Because this family is white doesn't mean that the laws that excluded Elvira Arellano are unfair. She snuck in here twice and she used a fraudulent social security card. Then when she was caught and deported, she allowed her child to be used as a pawn instead of bringing him to her and caring for him. If Ms Arellano is such a great person to have in our country I'm sure she will be an asset to Mexico where she can help to rebuild her country and rid it of all the drug smugglers and corruption. Then maybe Mexico won't need to send it's problems over here for us to deal with. We're tired of the drugs, we're tired of the hundreds of thousands of gang bangers which infest our schools and neighborhoods and we're tired of outsiders who sneak over here and then tell us that we have to adapt to them. We will not tolerate our country being taken over by gate crashers no matter what country they are from.

All she has to do is get on a plane with her son, fly to Mexico, then cross the border into California, sign up for her free health care insurance and public aid. She can then live illegally until she dies. C'mon, if the Mexicans can do it, so can she.

OMG the Poles forced the little boy to retake kindergarten!!! This is so inhumane making the child learn the language of the country he's residing in now! Somebody needs to start protesting in Warsaw over this...

While that Elvira was, at first, insistent in leaving her son here in the U.S.(likely until she heard about all the negative things people had to say), this mom took her child with, showing that she doesn't need to be separated from her child due to deportation. Of course, her husband *could* go back with her now that he's a citizen and stay with her. I'm curious how she "didn't know" she agreed to go back...how does one not know what you're agreeing to? Guess that's one good reason to learn the language well, or you won't know what you're agreeing to!

I want to know what he'll do. If his wife and child can't get into the U.S., will he leave, or will he stay? Hmmm.......

Come here legally and you don't have to worry about all these issues. Illegal aliens, not immigrants, need to stop trying to get around our laws and follow them.
This is crazy. WHY CAN'T YOU DO IT LEGALLY?????? I don't understand. ALL OF OUR ANCESTORS CAME THORUGH ELLIS ISLAND LEGALLY. You should all be ashamed of yourselves, you did not earn ANY rights here, you are NOT citizen's. End of story. GO BACK AND TRY TO IMPROVE YOUR COUNTRY. Use all the evergy you use here fighting our system to try and make your country better.

Maybe I'm missing the obvious ... If the wife was here legally on a visa, why didn't the wife seek employment and attain a work visa BEFORE her original visa expired so she could stay. There are LEGAL ways to be get here and stay here. Filing for a political asylum is but ONE.

Yes, you are missing all the points. The most important point is that there is NOT a SINGLE way for an illegal Immigrant to legalize their status.

To apply for a Work visa, it takes 7-12 years (unless you are rich &/or know someone)

Even if the labor department approves your "Labor Certification" & the USCIS approves the petition for an Immigrant worker. Once you're out of Status (legal) there is nothing you can do become legal.

She originally was not illegal. If she would have returned to Poland when she agreed to she could return now because her husband is a legal citizen but since she violated the agreement to leave she became illegal and now has to wait 10 years. That is the penalty for violating the law. Case closed next case.

As much as I am against illegal immigration I do believe that it took them a little long to process her political asylum paperwork. I think it said she filed the paperwork in 1984 and they didn't process it until 1994 or something like that.(I can't remember, it's been a long day)Then they told her that it is safe to go back to Poland. Why did they take so long? I would have retro'd the application back to those dates. To me, it just seems unfair for her. She did come here legally and then applied to stay here, but then the application process failed her by taking so long. This is the type of person I can see granting amnesty to, but not the illegal immigrants who come here thinking we owe them something.

Gee, if we didn't have so many scumsucking illegals pouring over the border, we might be able to speed up legal immigration at least a little.

I agree, and just becasue it takes so long does not give a person the right to just completely ignore the law and come here anyway. There are laws for a reason, when did people start thinking they can take matters in their own hands.
