This website absolutely disgusts me! Here's a link that will help you find out the IP adddress of the one that has slandered you or your loved ones' name on here. With that information, you can take action on filing a complaint to begin the court process. The name of the individual can then be released through a court order. Good luck with it!

Unless you can somehow get the person who posted something about you to send you an email, you cannot obtain their IP address from Topix without a court order.

LOL - Love the user name of "you are stupid". The irony of it all just cracks me up. Nevertheless, I had a computer whiz friend that got on my computer last night and pulled it all up within 5 minutes. No problem for him whatsoever!

freedom of speech. you can say what you want about what you want. our forefathers fought for that. but when it comes to people talking trash...man up and take your big people pill. they did it in jesus time to him. why are we any different. man is not going to change. just accept it, don't let it affect your life any(you know the truth) and let the trash talkers feel important. after all, they need that in their life cause they have nothing else going for them

Interesting posts. And I'm learning... So next question for discussion. It's my understanding that as long as a warrant has been issued, then the individual can be tracked.

I definitely agree with the comment that we have freedom of speech. People just tend to forget sometimes about the consequences that may also come with that freedom of speech.

You first must find a judge who's willing to issue a subpoena, requiring TOPIX to disclose the IP address and possibly any other personal information TOPIX may have about the person in question. Since most people use false names on TOPIX, it's not always that easy.

If/When TOPIX turns over the IP address to the courts, the judge must then subpoena the ISP (Internet Service Provider) for additional information pertaining to the individual in question. This is the only way you could possibly find out who is using the IP address.

Even if you are able to locate the person who's name is on the IP accound, this in no way guarantees you'll be able to prove who actually created the post(s) in question. In many cases, multiple people use the same computer, so proving who is responsible for the post(s) is not always that easy. Even if you know the people living in the home where the IP is registered, they have to PROVE who did it. Simply going on a "hunch" doesn't cut it in the court of law.

This is a very time consuming and expensive process, and that's exactly why it is rarely done. Even if you and the courts were willing to spend all that time and money on trying to track someone down for such a stupid reason, chances are, the person would get nothing more than a slap on the wrist, if anything at all.

Freedom of Speech protects us, even when we don't like what's being said. So quit being such a cry baby and move on.

LMBO - I'm really glad you called my bluff... the bluff that I had everyone going about having a computer whiz friend over last night that pulled up the IP addresses. I think you missed the point in my post that said I did not pull up the IP addresses, but that my friend did. Actually, you can say whatever you want under freedom of speech. However, if your talking about a private citizen, they can sue you and they will win. You can't just go around slandering people. If they decide to take action then you will get what you deserve.

As long as we're 'getting facts straight' spoken word is slander, written word is liable.

And, yes increasingly, people are being sued for publishing false information which is damaging to the reputation of another.

Will they win?
Much depends on the state where the suit is filed.
Once a legal notice is filed, and the machine is found, forensic analysis will determine the identity of the person logged in at the time the offense was committed. Deleting information from a machine won't help you. The information remains until the computer over writes that segment of the hard drive, or it is reformatted, the information remains.

However, the law is leaning toward allowing these suits to go forward, if the mac address points to a specific machine in your home, the adults present in said home, or business (owners, beware) being responsible for the minor,(or employees) who have access to that device, can and are being held legally responsible for the distribution of unlawful information.

Can the plaintiff win the suit? There are many determining factors to consider.

Though you must remember, should your home (or business) find yourself in the cross hairs, the legals fees will be astronomical, and the press coverage will leave a permit scar, damaging your reputation. Even if you win, the nagging question will always remain, "did they really do it"

Parents heed this message. You are legally liable for unlawful content published from a computer in your home. Should that unlawful information target a minor, you can expect the consequences to double.

True. But every computer has a mac id. When a computer connects with an IP server that id is logged.

Anonymity on the net is an illusion. Unless you have years of hacking experience, hiding on the net is increasingly becoming a thing of the past.
Admitting on line that you use a proxy is not a bright idea there sunshine. Individuals who have done no wrong, feel no need to hide.

my point was not to let it bother you. i know first hand what people talking can do. i had a gran mal seizure and my ex and fam told people in community that i was f..ked up on pills when i was helping at a school event. it caused me to have speaking probs and the medication was affecting me bad but i still wanted to be there for my son. when i was looked at as a drughead it caused me to doing anything anymore because of how it made me feel. i felt like i embarassed my family. yes it affected me but it affected my children more. now that they are a few years older, i explained to my son the situtation when he asked and his father looks bad, not his disabled mother. and for all the people in the community, it upset me and it hurt me. i also have m.s. they were there to run their mouths but werent to help me out. it took years for me not to care. thats why i have the attitude i have now. only your fam and friends will defend you. everyone else will run you in the ground. its human nature. you have a choice not to let it affect you. god give that to ya. dont ever let people determine how you see yourself.

What I've read on topix in general on several city locations border on some really poisonous statements.

The Freedom of Speech only goes so far. Research the subject of defamation, libel, slander, and it also gives opinion in the description.

To further the example above about prostitution...
Saying so-and-so is a prostitute would come under stating an opinion.
Saying so-and-so got busted for prostitution could be considered slander if repercussions occur from that statement. There are other variables to consider of course.

In the recent cyber bullying causing people to commit suicide, the courts are seriously pursuing intent.

Call that my opinion if you like but do the research first. Personally, I just think the unnecessary name calling and gossip is just bad freakin manners.
