The santa rosa courts seem to go easy on the rich.
he's probably covered by an LLC. They seem to really make it tough for the average guy with credit
card debt. If i had a child these days his last
name would have an LLC after it.

I can't say I'm unhappy to read this story. The owners of Bellach's were very difficult and unreasonable to deal with. I almost bought a sofa from them. But the owner was such a jerk, I ended up going elsewhere.

Well, I am another victim of the Bellach's scam. It's pretty pathetic that the owners will be able to walk away from the debts with all of their personal assets. Meanwhile, I and others will have lost thousands of dollars in deposits on furniture that was never ordered or delivered. The owner of this outfit should be doing a healthy term in prison.

Dash,
So, today is the day I learnded that I'm out of luck. I ordered $5000 of furniture on Feb 27. After waiting 3 months I called to check on status, but was told they didn't have a tracking # yet, and it would probably be 4 -5 months. He'd call to update me. No call. I've called the store 3 times with no answer. Finally, I looked for website/news, and learned of the bankruptcy. Have they never hear of a letter to their customers??
I'm guessing from your comment that I should simply consider this a loss of $2500 (downpayment) and 4 months of frustration and anticipation down the drain. Does anyone have any more information for the victims?

Per an e-mail I received today from a Bellach's employee, they were flipped into Chap. 7 by the court today.

I ordered my furniture On Jan6th. After repeated promises, nothing. I paid about 2,500 as down payment. Is there any way to recover any thing? Do we need to fill out any form?

I, too, was a victim of the scam. I ordered furniture in August of 2007. My furniture was expected around Thanksgiving. I got the runaround for months. When I finally demanded a refund, the General Manager told me to hold on a couple more weeks. The next time I spoke to him, telling him that I couldn't wait any longer he told me that they went into bankruptcy a couple days before. He had to have known it was coming! I ended up getting a refund through my bank (THANK GOD) since I put the deposit on my ATM card. It took 45 for the refund to be final - the bank had to investigate it, but I am so glad that I went to them. I advise you to check with your bank as this is FRAUD.

The best part of this story is that all of the furniture and knick knacks from all of the stores were auctioned off online. I bet you'll never guess who was somehow able to spend close to, if not more than,$200,000 winning all of his furniture back. That's right, Mr. Bellach himself. Kinda strange that he couldn't pay the manufacturers for the furniture in the first place, which is why he went bankrupt, and, yet, he miraculously had the money to buy it all back below cost and re-open his store in San Francisco...I believe it's called 540 9th Street Furniture (the address of his original Bellach's store in SF) or something like that, cause God-forbid the name Ballach be anywhere in the title. I can guarantee the service hasn't changed, and I would stay far away!!!

Too bad the Bellachs have been run through the ringer by people who are just guessing. No paper license plates for these folks and no scams intended. In fact, their home is falling apart. From what I understand, the worst day in their lives was having to declare bankruptcy and find they would have absolutely no control over the result. According to them, their plan was to reorganize and refund or fill orders dollar for dollar. The trustee who took over wanted to close up shop as soon as possible so her salary could be covered. In fact, when she found out about all the special orders, that had been placed, she ordered the office clerks to call and cancel every single one of them! So. please don't blame them for everything! They are wonderful kind people.

I purchased a unit in their Rocklin store and they sold me a worthless warranty on top of it. I brought the unit back for repairs- the store closes and now I'm out of luck because the credit card company wants proof of the return. They won't return calls- so if you are talking about integrity, unfortunately they are lacking.

(I'm talking about a 13,000. Elite Leather Sectional- not some small time purchase.) The trustee says I'm out of luck.

Apparently Jerome & Katherin Bellach are in a world of hurt - besides apparently collecting deposits for furniture that was never delivered to customers, there are of allegations of illegal business practices not to mention not having paid payroll taxes for many years. Word is they are in litigation with their neighbors regarding a crumbling foundation for their home on Belvedere Island and recently were dropped by their attorney (purportedly because they didn't pay his bills). No shortage of drama around this story! Ouch...
