My posts keep getting deleted, I know it is not an accident, bu here it goes...

I was denied medicaid dATING back to September of 2010. If I am not given it at a hearing tomorrow, I will have to file in district court, and when the finding comes back about my being denied, under Federal law, NM will have to immediately pay back ALL of it's federal assistance for medicaid funding for that time, which is over 1 billion. Since it is immediate, Gov. Martinez will have to either raise taxes or cut funding to pay for it, it's all due in one year.

That's one fifth of the state budget.

I have received racial-based harassment over this since the inception.

Follows are my notes about the subject, and about a Shirley Jaramillo who has harassed me since the beginning. I do not know if NM is going to do what is legal (I'm owed $170/month food stamps since april 2011, too) or try to drag it out further, mexican cartel style, to hurt me further. It's a bad bet tho, as a loss is a serious one for them.

This is a Florida Attorney's site. Florida has the same eligibility criteria NM does.

According to NM, I used to be in this group, and they put me into the QMB. But, that was illegal, as I received less than SSI then AND was under 65 but disabled. I had income below that of the mandatory coverage group, since I received less than the normal monthly SSI check, which is the standard for that group.

Uhm, I do more than that,I get SSI outright. I am not only less than twice, I am under the FPL, AND I get an SSI check, making me strictly categorically needy, not Medically Needy as NM claims. I am entitled to full Medicaid only, nothing less.

This proves it-I was eligible for Medicaid when I went to DVR, but Espanola ISD refused-and my DVR worker Wilma Gonzales had a calendar for Riverside Pharmacy on the wall. She mentioned she knew the family that owned it-I'll bet she did. So did my ISD rep. Bernadette Quintana, since her husband owns it, meaning she had a vested self-interest in keeping me off of medicaid, and on DVR's program for outright payment. DVR pays well above medicaid, which uses it's CMS client group of millions to negotiate lower payments for the meds I was ordered to use against my will, and which have removed parts of my memory. You can refuse treatment options of any type under Federal Law, and choose your own-but DVr re-stated that, and told me I only had a choice between their way, and the highway. Wouldn't you know it, they chose the most expensive and detrimental drugs for me to use. Netting Mr. Quintana a sizable profit, much higher than he would normally have gotten. When I started pointing this out, and informed DVR Santa Fe, Wilma split, and so did most of the office, too.

Espanola ISD's pushing me into COLTS, and also stating I will have to accept dual Medicare/Medicaid usage is a violation of Federal Law, and means that NM because of denying me is no longer eligible for Federal Matching funds, which make up 80% of NM Medicaid's funding. I have already gone over the eligibility stuff here, and previously for COLTS. I am not eligible for COLTS, nor any of the other weirdo combinations NM has tried putting me into so far. They do it, basically to cover their ass at ESpanola ISD, and to harass me because, as they have told me straight to my face, I am white (anglo)so I derve the bad treament. I am eligible only for the NM state medicaid, which I will choose the Presbyterian Salud option for, as I have already spent years helping my Honey and the kids make appointments and navigate their services, all without having to sign and fill out the forms I cannot, or travelling to SF or having any other criteria pushed onto me. I resent being put there. It's also a violation of Federal law, and voids NM from getting Federal matching funds for Medicaid, which is a seriously big revenue stream we don't have to pay the most of right now.

NM state mad, headed by Jill Bowles, but my insurance completely in December of 2010. I contracted the swine flu, had it for more than 12 weeks, and was unable to see a Dr. That happened again, apparently in this past December 2011.

I tried calling lisa medina lujan, and everyone I could speak to with the state, and no one ever did anything at all. I did however get more than 100 calls from the harassment center in Sf, with nm mad/isd, with threats and nasty messages and comments about my being white.

following is a post i made back then. I'd tried going to the emergency room ,but I did not have insurance, medicare or medicaid, at all.

SF Social Security has refused to return my calls, too, despite their giving mthe info, thru Tony Tecumseh, on how to get medicaid with ssi, as they had been asking since july 2005, and nm had refused without comment at all.

All very illegal, and discriminatory as it is based on race.

Yesterday was awful. I still am unable to have medicaid, despite everything I have tried. I will try new things today. I am somewhat sick. I have no way to get better as of right now, not even being able to attend the emergency room.
i have type 1 diabetes. Type 1 diabetics can also get insulin resistance, just as type 2 people do, and for the last few days, mine had been building, which I blame on the Gov't of NM and Espanola ISD-still cannot see a Dr., still am supposed to have medicaid, been over 6 months since I was supposed to have it, no one has done anything at all.

Espanola ISd is still trying to CYA after committing fraud, and claim we claimed Yg was living with us-we never did, not even once. They are counting the 77$ we got a while back for the January school fees, supposed to be paid in December, as the increase, despite no corresponding one in food stamps, and the fact the state of NM has already stated they committed fraud by claiming YG was the mother of YB. My mother has offered to pay for a lawyer if they try to push for it, I'm not sure if she means it.

My honey is being harassed by Casey Stone-Romero at DVr in SF, they are claiming she needs to get testing to prove she is mentally retarded, despite the fact she has automatic eligibility with ssi, and only needs a gas check, and does not want or desire or need the added testing.

We were not allowed to speak with her boos, despite that being state law and part of the appeal process, and we were told that person was Nadine Wells.

Earlier this past year, a Rich Smith person claimed to help, and instead put me down and called my honey a stupid retard too. I did eventually get ahold of the real guy, and he is much older, and then I sent a certified letter to Alan Graham who guaranteed my honey she'd get everything she asked for, and apologize. DVR reneged on that in toto.

A Rich smith, much younger too, then called ,and harassed us further, still the young it guy, not the real one, so dvr is doing it on purpose. He's a post I made, dated 03-28-2011, 11:22 PM.

One of my posts is already removed.

today I went to the hearing. According to H&HS in Washington, I have a year from when I file and a bad decision was made. They disclaimed this. The current FS amount is still wrong due to the intentional mistake on their part, but they won't let me re-apply or do it either.

It was dog and pony show. First, my info was not allowed to be reviewed. Then, Sam pineda (sp?) kept making wild accusations, the final being I have always had medicaid, but social security stopped me from getting it and put in medicare. That is not true, medicare exits once full medicaid is added.

I was told Evercare is my current, and they backdated the date, too. However, I do have the cms bills, and there is no listing ever for evercare at all. They then repeated the claim that my plan is medicare and medicaid, which is not true (see above) and that means medicaid, which means they are steamrolling me into it anyway.

I also cannot fill out the forms, and the above links I gave show I am supposed to receive medicaid 004, full medicaid, which they claim since I am a dual eligible, I have to accept with both AS medicaid, as if my having a mental conflagration and forcing myself to accept the wrong thing, will be okay.

So, basically hispanic bait and switch. I also have proof thru my church and priest that they did have me taken off of the insurance in toto back 12/2010 thru 8/2011, and they disclaimed that. When I pointed out anyone can enter a new number in, the guy said no, and umbled, then I asked when the new number had appeared, and he stated Nov. 23, 2011-a year after, despite his saying otherwise previously. They also stated that medicare lied.

I did ask the women at la urgent care about it, and they stated as I thought, that if I had been on evercare, it would have come up and been billed to that-so the records were obviously added later, and the cms billing records prove that too.

so, breaking the law. What is my next step? any suggestions?

Judge was rude, sam from mad was too, insulted my honey and interrupted her, they admitted the push into Evercare was wrong essentially, but did it anyway.

Paula told us too, the fAXES were all just copies of the top fax sheet, which is not true.

They lied, pretty adamant about it too.

We spoke to a Native american and a white woman right after, both said the area was filled with bigots, and they were not surprised at all. One woman had to quit her job and move because of the bigotry.

Judge basically admitted they were wrong ,were going to allow it anyway, my being put into a healthcare plan for senio citizens, with medicare and not medicaid.

Sam stated he had a piece of paper that said I'd been put into medicaid in september of 2009, and I ASKED for the date, he said Nov. 23rd 2011, I pointed out my working with lanl attorneys before that would not stand up in court, as the date can be changed, and was a lie. I also have a cms billing for September 2011, shows billing for medicare and medicaid QMB, he claimed it was a mistake. I checked with los alamos urgent care, they said the pop-up is automatic, so it obviously is not. I was not on evercare or medicaid alone.

Wow, more hatred and lying.

Well, the system apparently does not preclude people who have styled themselves my enemies, telling every bit of personal information they can to anyone else. I have been repeatedly confronted since the hearing with what happened during it. I also, within minutes of posting on FB, had a high schooler come in behind me and yell anything posted on FB is a lie.

That is not true, but they know that too. But everyone knew what happened at the hearing, and since that is illegal, it helped me to realize that NM is so far corrupted it's hard to get anyone to listen based on law, or anything else. Nothing about morality, it's solely about power. It does not matter about the underlings, like the people of Espanola losing their heating oil/NG, and it does not seem to matter hispanics have not gained anything at all by supporting the governor, either. It's solely about getting one of theirs in, and nothing more, not even if she is totally crazy, too.

I still have hope, and will play to that instead, and see what happens.

One addition-the person who helped and then intentionaly screwed up my appeal, was a Patricia Anders. I found out her name is actually Patricia Andres, she is hispanic. The day after the hearing, she called up and left a message on my cell gloating about what happened, and mocking me.

I had been given quite a bit of help, guidance and support but from a Sarah Anderson, who a priest at my church was told by the front desk male secretary at NM Poverty Law, still worked there. Andres told me she and Sarah were one and the same, a complete and total lie. Sarah and one other attorney gave me the original information I had used to obtain SSI and therefore automatic medicaid.

So, my main problem has been that, and the fact there does not seem to be anyone willing to listen at the offices I've tried to appeal to so far.

I suspect the male secretary's story about their not being any way to leave messages, except by going thru him alone, is bull too. It's a way to narrow my intercourse with NM Poverty Law to just whoever he is (refuses to give me his name) and the Andres person, and not allow me contact with Sarah. This happened at Protection & Advocacy too, until I confronted them and they dropped it, and then stopped helping me at all.

You really have to wonder about organizations who purport to help the poor and disadvantaged and say they exist to help people get thru a needlessly complex system, by adding more games with no work to go with it. I will bet if they were audited, most their work is like this-talking and speaking, with little action to help their core constituency. With P&A, they seem to glom onto legislation already being formed, and then acting as if since they offered some advice they did some work. You've experienced people like this before, I'm sure, in college, in groups writing research papers or doing a skit, the people who nod their heads and speak loudly, but do anything else, but want the A you and the people you and the others worked for alone. No one needs another nodding head, and they seem to have made a career and everything else from it. Their core activity seems to be spreading innuendo, lies, and rumor.

BTW, under state and Federal Law, if a person claims to be an attorney and helps you, even if they don't have you sign a contract, they are required to respond to you alone, and not sidetrack to someone else, too. I did check that out when Andres first started lying to me, and once you act as an attorney for someone, by giving them advice, you actually are their attorney in this state and country.Both of these pro-handicap organizations have broken State and Federal law, and made themselves eligible to lose it and their law license to practice in New Mexico too.

I was supposed to be getting a referral from the State Bar too, and they played the same and worse games also the others did. The lower level peopel in each org. are hispanic, and the racism seems to be continuing thru them alone. That explains the young thing at the library, a hispanic, spoke directly behind me about my post being a lie, which it was not.

This is not just about hispanics either, it's also tied in with the Catholic Church ,which seems to be making a pwoer grab, and is getting an excommunicated governo to help.

I have until Wednesday, or Thursday, it's supposed to be 15 days, minus one for the holiday, and that's 15 working days, not calendar.

Wow. I expected the higher I went, higher quality people. The secretary for the judge Montoya Y Baca or Whatever she's trying to go by and keeps changing, told me what we were experiencing was part and parcel of what happens at Espanola ISD all the time. Ours is more than lies and corruption though, it's also race and religious hatred. When I attempted to convert to Judaism, the people in shul told me the most anger I would ever get would be from half-as-ed jews, people who were jewish only by birth and knew their connection was much more tenuous. Funny how with catholicism the hatred comes from people who are normally unable to be Catholic in the form of having communion anymore, usually due to divorce or whatever else.

I'm guessing the bigotry the hearing gave me was due to race and also the catholic thing. I understand now why my ancestors fought against a central church authority and corruption, it's due to people and situations like I'm experiencing. Single-minded, uncaring, hate-filled. No law or anything else will stop them, either.The judge's admission during the hearing she knew I was right, and her high-pitched voice when she mentioned perjury, was pretty telling.

The constant repetition of stories, always by hispanics, exposes the entire thing as being hispanic too. No one else has done that so far. It also shows my opponents for who they are, since they have been unable to do anything honestly so far. When Sam Pineda (sp?) stated during the hearing the medicaid thing had been aded as of Nov. 23rd, 2011, he quite honestly started having a shaky voice. He knew he was lying thru his teeth, and his abusive act toward my honey just repeated something LAPD had already told me before-hispanic men abuse their women, regularly, and since the jduge refused to object, it seems the women buy into that, too.

Looking atthe DNA results from southernColorado, the hispanics invaded and killed off the Indians, not due to threats, but because they did not bring women to the new country. The Indian women ahd probably heard about Onate ordering the rape of the women in front of their husbands in Espanola, and still resisted, so the men created the habit of beating to subdue the wonmen that has continued to this day. professor from UNM to start up the black pottery her ancestors had made. She did it, and the pride in themselves this engendered in her tribe resulted in the hispanics being driven out in toto.
A former girlfriend of my step-son, her Father had been part of this attempted takeover, in the form of a hispanic male commandeering 4 native women on the OhKay-Ohwingeh grant, and then impregnating them all, I think. He used it as an example to help get me to drop my guard and speak of my own

Espanola was unsuccessful, though from talking to some local people, including an SC Indian, they keep trying, and are incredibly resentful of their failures too. Despite the fact Federal law makes it impossible to try and take over a reservation, they are still angry about it, and their hysteria and delusions have spread over to the point reason and facts no longer have any value to the believers. It's a belief too, just like any religious cult, including the weirdo race-based pentecostal ones in Espanola. They have to do that, because if they do not kick themselves straight into delusion, they will have to confront a whole host of facts and truth which contradict everything they believe. The only alternative other than truth, is delusion, which is why arguing is impossible. Given hispanic culture in NM is mainly based on attitude and this delusion, and putting up a false front, it's easy to see that most of the problems and poverty is explained away by claiming they had things, and the current poverty being caused by white people and Indians taking it away.

That is partially true, at least the white people, but most of that has been given back. The Indian thing has just been the excuse the locals used to explain their poverty instead of accepting it themselves. NM never progressed into the modern context, and the anti-assimilationist strategy Tijerina expounded helped cause it, too. If you notice, Mexico had the most race-based caste system, 40 levels total, of any civilization in human history, and it used to extend here. Most hispanics who have higher-paying jobs also have colored eyes, whiter skin, but dark hair. I have been present when they have explained to more Indian-looking people that the hair shows they are like them, and they can trust them. That is not true, it's just a hangover from Mediterranean ancestry (my ancestors have the same thing-dark brown and black hair, pale skin and light eyes, too!). But, they keep the locals ignorant to make sure they stay that way. The upper-level hispanics make money off of the near-slave labor of the lower classes, and then use the white and Indian thing to misdirect the hate towards anyone but themselves. The Reservations never made anyone poor, and their is no evidence at all hispanics ever lived their and were able to take advantage of the local area either. But the racial hatred gets stoked constantly so the people will not change the situation and take what is being stolen back from the people above them who are stealing it. Since it isn't true, no matter how much energy they expend to take it back just results in more rage, and the same upper-class ripping them off. It also gives pat explanations for why they never succeed and why they don't want to improve education at all, ever. Keep the people down, or they will take over. Meanwhile, the upper level can rip them off blind without a hitch. Just as they do in Mexico.

So, I keep getting crud from people in town, always dark, always hispanic, about how it's my fault they can't get anywhere, and it's okay for them to fight against anyone who they believe caused it. They never study harder, or try for better jobs, just believing if they get angry enough, something will change-the ghosts of the conquerors being the main thing here, that if they fight hard enough, they will get it back. But, they never do, and never will, because the people who head their culture are just using it to distract and steal it all for themselves. you can see that in the Manny Aragon and Lujan cases, too.

The conquerors won by theft, and trickery. They tried getting their own people to breed in with the Indians to steal even more, but were prevented by University people and the Federal government, so they continue by supporting Republicans who give some of the already rich more money, and getting University jobs. Since most of this is venegeance oriented, the curriculum gets corrupted, and Republicans get elected, but the people still get nothing at all. They never will either.

A corollary with this is that if they submit themselves enough to their own kind-other upper-level hispanics-they will benefit. Their is no evidence of that at all, either. Hispanics are not getting richer at a faster rate, it's lower than inflation. But upper-level hispanics are getting more than ever.

So, I'm caught in this loop-getting blamed for something I did not cause, and having spent a good deal of my spare time trying to help people who believe I'm just giving them back things I stole. My family was involved in this state's development, but we didn't make any money or steal from anyone either. We have buildings in downtown ABQ named after us, too, but no land thefts or anything else. But I guarantee that despite my helping in after-schools programs, given the rather goofy arrogance and hatred we've received, we will never help out again. I've helped jump cars, gotten into screaming fights with UNM bueracrats in defending hispanics, including one mexican national, and taught people how English is used to intentionally deceive and how not to get around it, too. Given also how much work I have done in my life, all this giving up did was screw the people I have helped, who have already admitted without my help they would have been unable to do it. But, never again. No point in helping people, who are so eaten up by delusion and hatred their main emotion each time is dictated to them by the idea you are stealing from them, instead.

I have been yelled at, and prevented from making it to my car, for 45 minutes before by people who I just got done helping, hearing about how I am guilty of burning a cross on their lawn instead of responding to a request to tutor them for free and doing it. I remember especially being at Movies 8 in ABQ on San Mateo, and being followed by a group of hispanics when leaving the theater who apparently didn't know we could understand spanish and were planning on jumping and killing us, until a friend of mine reached for the .45 he kept under his seat, and they ran like hell. It was a Tuesday, that day I had volunteered at John Marshall where I was one of the few people there, if not the only one, who could speak spanish AND do math.

That explains it. I kept wondering why the Lujan family kept bringing in money, but it only got to a few people. I also wonder why the Governor kept promising money for HUD to illegal aliens, basically stealing from Americans. It was to pit people against each other, to help the Perry family and the oil companies running the republican party get more money, in exchange for her ego to get stroked and her backers to get more of it, without really helping anyone else out. Most of the roughnecks are whites from out of state, so that money will do nothing, the money she's working to steal from the locals with oil, nothing at all. The pit rule is what she is after, and it preerves our agricultural sector from dectruction. Plants can't grow, and neither can people, with water infused with oil, even very small amounts. Her propaganda is that the pit rule's removal will help remove impediments to locals getting money, which is only true if you are white and from Texas (like her, incidentally, except the white part). In addition, it will allow them not to use the new drilling bits, which are more costly, to get around the water and to the oil, and instead poison the local water which will really screw the agriculture sector of our state, which uses 80% of the available water for irrigation, and has a rather constant and small group of people who actually are hispanic who have been working the land since their families arrived here centuries ago.

I do not have a copy of the ISD decision. Yesterday, we were harassed by an employee of eye Associates, who claimed they had sent mail to us, and it was returned to them.

We checked, and sure enough, my son when he returned home found the mail in the mailbox, not returned, but delivered the day of the appointment ,with an appointment change in it. They had don't it today. We had not received it b4 this (he checks mail every day).

We had attempted the appeal, it is due today. However, we never received the decision. Today we attempted to appeal the decision at District court in Sf, according to the NM Legal Aid society pdf file, which I'l lquote

"If you do not agree with the decision, you
have 30 days from the date the written
decision was sent to ask a court to review
the decision. Ask the Clerk of the District
Court in your area to help you file a
“Notice of Appeal” and send a copy of the
Notice to the Human Services Department,
Office of General Counsel (OGC). TANF
cases must be filed with the
Court of Appeals. OGC must
give you a free copy of the
hearing record if you appeal."

We were denied by District court (at Grant and Catron),who told me point blank they did not have a form for me, despite the notice above showing they obviously do know what to do, and they refused to let me appeal.

So, Justice denied, deliberately. Same group of people, too. Always hispanic.

Still do not have Medicaid at all, or any health care period.
