This extensive political attack on activists is the Santa Cruz version of the national attack on the Occupy movement. It also shows the opportunism, laziness, and vindictiveness of the police and D.A. who are certainly aware, if they've watched the videos and read the police reports, that none of us were responsible for any vandalism or criminal activity there--any more than Katherine Beiers, the Sentinel photographer, the SC Patch photographers, or any of the scores of other people who came in and out through the building, were.

Do we support the premise that Empty Buildings are the Crime (n the dead of winter with the homeless death rate a scandal year after year in Santa Cruz)? YES, I certainly do.

Do we recognize the obvious fact that Wells Fargo is the biggest tax-funded bankster in the country, whose crimes dwarf those of any drug user or petty thief? YES, I do.

Do we believe that the temporary occupation of this bank bears any relationship to an attack on the private property of individuals clinging to their homes or struggling to pay rent in apartments as Wells Fargo rakes in the profits? A definite NO on my part.

But reporting on, observing, even expressing verbal support for a sanctuary for poor people in the dead of winter has nothing to do with actually breaking into a building or conspiring to do so. There is NO evidence that any of the defendants were involved.

Instead, D.A. Bob Lee is acting as front man for Wells Fargo here and has acknowledged publicly he's simply trying to squeeze money out of the defendants.(Check out Lee on the You-Tube video, 55 seconds into it:

Instead of looking into foreclosure fraud and dual track loan chicanery, Lee's Assistant D.A. Rebekah Young is using a tortured "aiding and abetting" theory that claims that if any of us were in the building, that is evidence we "conspired" to vandalize and trespass. Burdick isn't buying it, but taxpayers are paying for it.

Judge Burdick has rejected the charges in the case of six of the 11 defendants. Rebekah Young insisted on refiling against them all and was slapped down in the case of 4 of them. Claiming new police witnesses, Young is dragging Alcantara and Laurdendau through a second Preliminary Hearing--even after the dismissal of all charges at the first. As I understand it, she can do this a third time, if she wishes.

This is a public waste of money, an attack on high-profile activists that the police and D.A. don't like for other reasons, and a diversion of time and resources that the courts need to deal with real crime. Naturally we don't expect Lee to go after the bankster gang, but perhaps he could spend a little more time on rape, assault, and murder.

Santa Cruz DA Bob Lee and his assistant Rebekah Young have abused their positions of authority under color of law to try to deprive the Santa Cruz 11 of their rights under the Constitution and U.S. law. They need to be sanctioned, losing their jobs and perhaps going to jail. Their abuse of their positions to persecute some activists who have criticized them is very serious. At the least they must be fired immediately.

Excellent post in #2. I couldn't agree more with the points made. I would also like to point out that the judge did issue sanctions against DA Bob Lee's office for numerous discrepancies, delays, frivolous motions filed, failures to pass over evidence while claiming to have already done so, and utter failure to comply with court orders to pass over evidence when not turned over.

The judge's sanctions were a tap on the wrist by a nerf feather. The uncoordinated efforts of the DA's office is what got your charges dropped. If the DA and SCPD stop enforcing the laws cracking down on bums, maybe then you might have gotten a "win". But I'm not holding my breath.

I don't always agree with John Colby. But I do agree with the points he has made in #2. For instance, I don't believe that 2nd-hand tobacco smoke is a nemesis that demands legislation and law enforcement involvement.

I agree that the sanctions were too little. Burdick stated he didn't think it merited a complaint with the State Bar of California. It wasn't just 'formatting issues' either. That wasn't accurate on the part of DA Rebekah Young. She delayed, lied, claimed she had passed all evidence on when she hadn't. Claimed all the evidence was the same for all 11 defendants (!!), then passed on different evidence to different defendants. She never did comply with Burdick's order to list all evidence, who got what and when, and she filed TWO motions to recuse the judge causing MORE delays (she lost both motions). And she didn't properly prepare police witnesses so they had a clue what they were supposed to testify to.
