You are quite wrong Rosie... I was on the jury... I gave 6 weeks of my life up to listen to this sniveling punk.... I do know exactly what happened. Unfortunately the first jury screwed up and gave the wrong verdict for which the judge had not given the appropriate instructions and therefore got it overturned on appeal... we were therefore limited to this particular conviction. Otherwise it would have been double jeopardy. Danny Rios, Sal Garcia and Jessie Salazar were punks in 2000 and they are lieing, sniveling punks 9 years later. I am glad they are away from my children ... I really hated being involved in this case... I had constant nightmares, put my life on hold for 6 weeks, and had to look at pictures of bloody corpses and entrance/exit wounds... stuff I would never let into my life... BUT it was worth every minute yesterday when the family of one of the victims came to thank us. I will never forget the bloody images of those victims and always regret hat I didn't get an opportunity to give this cowardly punk who shot three people in the back from a moving car the death penality.

I too was on the jury. Danny Rios and Jesse Salazar both lied on the witness stand and both showed NO remorse. I can't believe the first jury didn't convict them of MURDER. What an injustice for the victims and their families. 9 shots and 5 went into the 3 victims. Two of the victims died instantly.

Danny Rios pissed on his hands before he was arrested because he thought he could get rid of the gunshot residue!

The story seems to imply that those two won't be prosecuted because even if they were convicted, they could only be sentenced to an additional three months.

As is her usual pattern, Jennifer Squires fails to name the judge. But it couldn't possibly have been Almquist because he'd never subject himself to a six-week trial to put a killer in prison.

They got one hell of a defense attorney, I'll give them that -- He was able to work down from a murder 1 to a man 2 and got them less than 6 years! Oy vey!

Jesse Salazar and Sal Garcia both pleaded guilty and won't do any additional jail time. I wasn't worth having another trial and sending them to jail for a few months. They had already served most of their jail time years ago.

Danny Rios is scheduled for sentencing on Feb. 24th. He's likely to get 24 years in prison.

None of us will ever forgive him for taking our beloved Javier, he was young and on the right path. It hurts to remember that in one night we were notified that he was killed and then it hurt even more to find out hi killer was let out after a short time.I remember when he apologized, I wanted to just yell at him and ask why... why was he apologizing when he cold never do anything to fix his mistake. Now 14 years after we still cry... all the families cry, and he's out there free.
