Fearing Conviction Donna Deiss Accepts Plea

It looks as if Donna Deiss accepted a plea bargain. Charges were dropped against her as long as she accepted a lesser plea of littering. Fearing she would eventually lose her case Donna accepted.

Early rumors suggested Donna would not accept the deal in order to continue her civil suit against the city. Seeing the futility in such a move she caved.

With the possibility of enormous fines and jail time eliminated, Donna stated "I'm so relieved,this whole case has been a nightmare." outside the courtroom.

A woman outside the courtroom said of Deiss' lawyer "Ben spent all weekend preparing for trial,". After spending so much time reviewing the case it is obvious her lawyer suggested accepting the plea.

In retrospect her lawyer probably realized that Donna's story was flimsy at best. Considering her story, documented by Becky Johnson and Robert Norse, has undergone numerous changes, revisions and additions, the jury would have found her unbelievable. Becky and Robert's own reports of the incident do not match up, with the "documented" facts changing on an almost daily basis.

You should read Becky's "article" on Indybay along with Robert's take on the whole thing. They have been confronted with the fact Donna's story of the event has changed three to four times since it happens. Even how she broke her arm has changed has changed a few times!! Yet they brush it off as an evolution of facts.

Yeah right. The "facts" changed every time Donna talked to either Roberto or Becky.

I particularly like the part where Donna is now saying her arm was broken after she fell to the ground. In a previous version of the story Becky was adamant that LeMoss broke Donna's arm when he grabbed her from behind. When he grabbed her and spun her around she screamed that he had broken her arm and that she was in pain. THEN he put the handcuffs on her and put her on the ground.

NOW Becky is claiming that Donna's arm was broken when she was thrown on the ground in the handcuffs. When asked why she would have SCREAMED that her arm was broken PRIOR to that, when LeMoss had grabbed her, Becky says she was confused about what kind of pain she was in. Confused.

These jokers can't keep their stories straight.

The Indybay article spins this as a victory for Donna. They're claiming since the charges were dropped Donna is in the right.
But if Donna was so in the right and her case was so solid like Becky said why did she accept the plea? Why not press on with such a solid case?

YOU'RE RIGHT! THE STORY DOES KEEP A CHANGIN'!!

-- First the cops said that they observed people smoking marijuana (no marijuana was found)
-- then the cops said Donna assaulted and battered LeMoss by throwing scalding hot coffee in his face, and that Donna was injured while resisting arrest
-- then they said Donna was charged with possession of marijuana
--then they said Donna WASN'T charged with possession of marijuana
--then they said that Donna didn't throw scalding hot coffee into LeMoss' face
--then they said that Donna was only charged with 'resisting arrest'
--then they said that Donna's arm had been previously broken
--then they said that they would drop the 'resisting arrest' charge if she would
plead to an infraction. ANY infraction. She chose 'littering' She plead "no contest"

YUP, I can see why you have your doubts!!

No marijuana was found possibly because it had just been smoked resulting in empty pipes which were found? We all know that people can't be drunk or have been drinking if you don't find a full bottle on them. Right?

No one is disputing that coffee was thrown all over the place. How it happened is up for discussion.

First she said she was thrown on her front. Then it was her back.

First her arm was broken while she was being spun around causing her to scream "My arm is broken!", then she broke it when she was placed on her back and was confused about when the pain started.

First she knew it was a police officer, then she didn't.

Becky does not state the changing story on the part of Donna, because many of the changes happened after Donna talked to Becky and Robert.

Confused because she doesn't know her arse from her elbow. When her arm was grabbed, she anticipated falling on her arse, and therefore screamed "Oy! My arm is broken."

Perfectly logical.

Apparently Becky is afraid to post comments about this subject here. She's been posting away over at Indybay.

Here's one of her little gems.......

STORY KEEPS CHANGING WRITES: "-Donna changed her account of the baton from being brandished to being struck."

BECKY: True. Donna does not remember being struck with the baton. But more than one witness saw him strike her so she has changed her version of events to include events based on witness statements. She also inititially reported landing face down, but later changed that to landing on her back because she later said that she remembered seeing LeMoss standing over her waving the baton as though he was going to strike her, and she must have been on her back to see that.

Apparently Becky does not see the big deal with Donna changing her story to match what other people told her happened, and not what Donna remembers. Would she have said in court "Well your Honor, I don't really remember it this way but other people told me this is what happened so I'm going to go with that." Can you imagine how the Honorable Judge Symons would have reacted to that?

It's bad enough that Becky makes "mistakes" when telling the truth, now she's encouraging others to do it too.

Here's another.......

BECKY: When I first interviewed Donna, she told me how she believed she had been injured. However, after meeting with her chiropractor who examined the x-rays and Donna herself, he told her that her arm was most likely broken after she was in cuffs when he threw her onto the ground. Yes, as new facts come to light, the story must reflect them.

So, once again, after Donna heard something different from someone else she changed her story to reflect what other people say happened.

Becky thinks this is normal. Can you imagine what she says to the children?

I think it's strange that when Donna changes her story after thinking about things and accepting input from other people and their version of what happened (some of them not even first hand witnesses), Becky thinks it's a logical chain of events.
When the police drop charges or make changes in their investigation Becky thinks it's a conspiracy and a cover up.
Two groups doing the same thing. One is allowed to do it in Becky's mind. The other is damned for doing the same thing.
This is a clear example of the hypocrisy and bias of HUFF.

BECKY: My understanding of why the pipes were empty was because they didn't have any marijuana. If they'd had marijuana, the pipes probably wouldn't be empty.

BECKY: The court case is over.
She won't be testifying to any of it now. What the defense planned was to have Donna testify to what she remembers and the witnesses testify to what they remember. Just because she doesn't remember or know if he struck her with the baton doesn't mean he didn't. She said she was in extreme pain and terror from the second this man laid hands on her.
