Last December I was hit from behind by a car while riding my bicycle on West Cliff. The police report from the SCPD was carefully written so that NEITHER party would be at fault (though the driver clearly was). This is by design. The city obviously thinks it will avoid any potential liabilities if the SCPD can make every accident appear as ambiguous as possible. I wish the Myslin's good luck. Maybe a hefty judgement will get the city's attention in regard to the car vs. bike carnage that has been taking place on SC roads.

I agree, Robert. All it is, is blood money.

Yes, the police aren't on-scene judges or attorneys, like playground teachers at a school. In this case, there was some sort of low resolution camera at the Surf store which should show what happened. There is a possibility that the truck either was both passing and turning right at the same time (i.e. overtaking Myslin so he had no chance to see the truck blinking right and react to it), or they had been going at the same pace for a while, or the truck had been going slowly and they were shring the lane.

That is a bunch of crap. Any way to make a little extra money and not put any of the blame on their sons death.
I am so sorry for their loss but the fact is that he was riding on a dangerous road and taking his chance!

The judge should throw the plaintiffs AND lawyer in jail for a week. Stop the entire lawsuit lotto gravytrain overnight

Or bike was wrong...ever entertain that idea?

The only winners here will be the attorneys.

The parents attitude of it being everyone else's fault is precisely the mindset that raises these little spoiled brats to think they own the road. I'm sorry to hear these people lost their son, but if they spent more time teaching him to think and basic self-presrvation instead of what his rights are, perhaps he would be alive today. With the exception of a blind sense of entitlement and antagonism, there's no need to ride on Mission street.

I doubt this will ever see a jury.

Blame the city...that's just great, you all know who that ultimately affects. Money will not bring him back folks!

The lawsuit seems more driven by a need for revenge. If there is a settlement, I hope it comes out of funds that would have been used to improve bicycle lanes and put up silly signs.

Or...as happens to me all too often as I slow to make a RT turn with my signal flashing, a zippy bicyclist comes barreling past the inside of my pick up truck. In addition to watching for clueless pedestrians, motor scooters, and other vehicular traffic, I try to remember to check for these morons as well.

As an avid bike rider for many years-all of the accidents or close calls I have been involved in could have been prevented by(drum roll here)....ME!Had I been paying more attention to the tons of metal around me,the accidents could not have happened. Most were found to be the drivers fault, but I survived them because paid attention and anticipated what the driver was going to do.You DO NOT pull up next to a long truck...you stay behind it or in front of it,or just make sure you make eye contact with the driver. Now that I am older with relexes that are not as good I prefer to ride on the less congested areas of town.

Attitudes of all sorts, from sorrow, loss agreement, or greed. Great idea though with the Hell vehicles have brought to slow down the insanity of driving and playing follow the leader. It would be excellent to complete that total waste of money highway 1/17 expansion and cut off all gas hogs right there- don't like it - keep going. Maybe widening Mission in the first place would make sense. Cars/trucks following the pied piper are murder weapons- plain and simple- no matter how pretty they are. Whatever, bicycle friendly; Santa Cruz is NOT

It's just sad. As a cyclist, I feel for the parents. But no amount of money will bring John back.
