I complain about a student staff at MESA program at Mission College (a community college). Mesa staff and student conspired lied that I use profein language and racial slurs. English is my second language, and I don’t even know some of the words that they alleged. I was harassed while VP told me to investigate. One of the students emailed me that VP, MESA staff and Access staff told him to harass me while I investigating and/or talking about that incident. Every time while I chat or investigate about that incident; one of those three staff would come out and harass me to shut my first amendment right. Due to my health problem, I can’t take too much stress, so I have no choice to use California Public Record Act to request information rather be personal talking to those students. Vice President of student suspended me 2 semesters without due process hearing happening first. She ignored my request for a due process hearing, so I had to ask my ex to request for me. It worked. During the due process meeting, I was not given any evidence before my chance to present, which was a violation of law. This VP also mail me 2 degrees that I was never intended to get. She pushed me and other student who refused to lie and testify to graduate. Therefore, I wrote an email to formally complain about she violated CA evidence law, Mission college due process hearing procedure, and CA education code 66201. Two days later, I was expelled by the president of Mission college, which is a violation, including but not limited to, First amendment and retaliation. The vice chancellor violated equal protection clause by stating that “Due to the disruptive and unprofessional nature of your email communications with Vice President Penny Johnson and others, the District will no longer correspond with you via e-mail. Should you wish to communicate in writing with Ms. Johnson or any other member of the district community regarding the student discipline process, public records access, or other matters, please send the correspondence to the following address: West Valley Mission Community College District, C/O Bradley Davis, 14000 Fruitvale Avenue, Saratoga CA , 95070.” CPRA does not require me to request records by mailing, which is another form of violation my First Amendment right.
